When the D.A.s prosecutor Jason Perez knew their case of me pointing a firearm at a person was weak, and their witness Steven Jay Sockey was having a hard time remembering the lies he had already told under oath.
He tried telling the jury what a danger I had put everyone in the Gym to, just by having this fully loaded DANGEROUS WEAPON in my gym bag.
If the jury could not convict me of their count one pointing a weapon at a person, just maybe they could go ahead and find me guilty anyway, just to show they cared about every ones safety.

I am glad my jury saw through their flawed scam, and found me not guilty.

It's interesting how people just Bow down to law enforcement like they are Gods or something...Hmmmm....weird.
There is a difference between Fear and Respect. I Respect the police, not fear them. If I was stop for doing something legally(like open carry) I would already have a copy of the penal code in my wallet right next to my license. This would be to show them, and you bet ur sweet honey ill educate the police on the spot, bc no one can know everything. If he still wants to arrest me, or tackle me to the ground with unreasonable force (oh yeah article 35- use of force) still applies to the police, or issue me a ticket then Mr Lawyer will have a little bigger payday. Sadly in NY we can't open carry so I don't do that. But even if I see someone open carrying, I'm not saying anything because its not my job to know if they are legal. Maybe I missed seeing their badge or they have a specialize licence. Either way, I tip my hat to this guy for standing up for his LEGAL rights. The moment we live in fear, there is no freedom.

What shall not be infringed? The right to bear arms. That isn't a self defining phrase. It needs interpretation - which is left to our judicial branch of the government.

The right to bear arms presently includes the right to own a handgun for personal protection in your home. It might eventually be expanded to more than than that, but right now everything beyond that is a mere fantasy.

Maybe in second grade parlance it does. But in the grown up world, our Constitution contains phrases that express principles that are given meaning by the courts. In case you didn't hear, the SCOTUS recently held that the Second amendment guarantees individuals the right to possess a common weapon in their home for self defense. Nothing more, nothing less.

Just another case of if a cop sees or hears you have a firearm, having it is all they want to know. it's off to jail and the DA jumps into it for all it's worth. Trust me they will offer this guy a plea first.
No matter what is really right it will cost him a lot of cash hiring a Attorney.
I sure know about this type of dealing, since my arrest and trial a few Months ago in Tulsa,Oklahoma.

So the other night, I'm on my way to work, and my car has been giving me problems, so I sort of do a "California Stop" at a stop sign. Next thing I know, there's a Michigan State trooper behind my car all lit up like a Christmas tree. So I pull over, and when he reaches my door, I hand over the usual, DL, registration, proof of insurance, and my CPL.

He asks, "Do you have a gun on you?"
Me: "Yes, officer, a 9mm on my right side, in a holster."
Him: "Do you have any other weapons?"
Me: "Yes, a .357 magnum in the glove box, a 9mm Makarov under the passenger seat, and a CZ-52 in the black bag in the back seat."
Him: "You been to the range or something?"
Me: "No, just my usual traveling companions."
Him: "What are you afraid of?"
me: after a momentary pause; "Not one damned thing, Officer." :biggrin:

I didn't get a ticket either. :wink:

SCOTUS "interpretation" is dangerous and unnecessary, especially when it contravenes laws in the Constition, written in plain English, and if that is not enough.Other documents written and placed into law by the very founders who wrote the constitution. On these basic principles,"meaning" does not need to be "given." by 9 political appointees, 4 of whom are functional socialists. That is the real grown up world.

I teach exclsively courses in tactical handgun defense and concealed carry. I have absolutely no prpoblem with OC. I accept it. I believe it to be constitutionally supported. I favor the right s of anyone who chooses to do so. I believe those who hassle someone because they OC are *********. But why engage in any behavior that invites trouble? When you look at the chat boards here and at other sites such as GlockTalk, the boards are chock full of people having problems. You'll never get ignorant people to understand this is legal. They will always call police and many of them don't know their own laws. Rarely do you see a complaint about someone hassled for concealed carry.

The first rules of civilian engagnement are avoidance, deterrence and de-escalation. Why pay a lawyer over principal? There's enough problems in our world without going around advertising for more. Besides, and there's no argument from any experienced tactical instructor... it ruins the element of surprise in a confrontation. You want to OC? Fine with me. Only now I will modify my offensive strategy to perpetrate a crime against you. In a tactical confrontation, never advertise your defense (Machiavelli) and never interrupt your enemy when he's making a mistake (Napoleon). Taught this by my father, who studied it as a U.S. Naval Academy graduate and verteran of two wars. He forced us to study Machiavelli and the mistakes of the greates commanders in history. Also taught this by Mas Ayoob at the Lethal Force Institute. Pure and simple tactical advantage. The point is inarguable.

Many would say that you are inviting trouble by carrying a gun. I say that you are inviting trouble by not preparing to defend yourself and others.
I feel sorry for you, if you think that principles are not worth defending, if it is inconvenient.

No place is a bad place for open carry, unless it's a bad place to be in the first place. The only exception to this is when private property is involved.

If you're aware of your surroundings, where you are has nothing to do with whether or not OC is "OK."
