I grew-up in the ninth most dangerous city in America, according to the FBI ranking. The hood was right in school, every day. Bad-asses in every bar and hangout. I've been in a lot of scrapes in my youth. Riots, shootings, murder, robbery and rape... all part of growing up here. Right in there with every kind of scum you can imagine. So, yes, I've been threatened a lot in my time. A real lot. I also did a of work helping put pedophiles away. Hell, I was threatened right in the newspaper by one of them. But none of that really matters. How many times have you, in your entire life, said "I'd like to kill that SOB?" If you say never you're lying. If you admit you've said it then should you be shot? Right? The person you were referring to has the right to shoot you, right? And I didn't claim anyone used SYG. I said this harms guns and SYG laws. That's because the anti-gun crowd uses every shooting to denounce SYG.

If I see a stranger in front of my home I do nothing. If I see one in front of your home I do nothing. There's no crime in being on the street. When you confront someone who's on the street in front of your home and they tell you to go screw yourself, what's your next move?

As a juror one may believe all, part or none of someone's testimony. That's right in the jury's instructions. If someone is caught in a lie I tend to throw-out everything they've said. He claimed the boy was outside the car. Forensics show the victim never left the car. He claimed the shots were patterned differently than the what was recorded by the video/audio inside the store. He claimed he told his GF that the victim had a gun. She testified, sorrowfully, that he never told her that. He wrote her a letter from jail trying to get her to testify to things she did not believe to be true. He's made racially charged statements. That's enough for me. He's a first-class nut-job and a liar. Now let him live with the animals. He'll be in protective custody. You want him? Fine.

I don't know....I've heard many instructions to a jury that premeditation can happen in an instant. The long pause after the first 6 or 7 shots and the final 3 or 4 being fired at the vehicle as it was in retreat certainly seems like premeditation to me.

Regardless of what the jury determined about that though, it still seems a logical oxymoron to convict on Attempted Murder for the people he missed, but hang on the killing. How can it be an Attempted Murder for the ones you missed, but something less than murder for the one you hit and killed? Personally, I'd settle for Murder 2, maybe even Manslaughter, but "Uh...gee Judge, we just can't agree on nothin' that he did when he killed a guy, but we sho' 'nuff know what he intended for the guys he missed!" Just doesn't make sense to me. And I heard a report that the prosecutor is going to retry the murder charge, which I think they should do.

I agree. I think it's just easier to prove premeditation if the individual goes home, gets his gun, and then comes back. But just because he does what he does then and there doesn't necessarily mean there was no premeditation.

There is no way that shots from the drivers side of a sedan would hit the rear door of the SUV like that if it was not OPEN.

Did the shooter move during the incident? There were three shots, a pause and then four shots. Couldn't he have moved during that time. Also, wasn't the car in motion? The driver was trying to get out of there. The last three shots were fired at the fleeing vehicle.

U cant argue with tough guys who can't wait to use their firearm and claim self defense! Dont initiate confrontations and if ones started with you always try to remove urself from the situation. Drawing and firing is always a LAST RESORT

That still goes along with the picture. To me it could have played out as him firing the first few shots into the back passenger door at a 90 degree angle, then as the car tried backing out of the spot the angle changes and he's firing into the front passenger door at an angle.
