CC in a restaurant...that has a bar...

I don't want to beat a dead horse here, but I keep asking myself where I CAN and CANNOT carry. Before I even get my permit, I find myself debating IF I should CC every where I go. I'm in and out of my vehicle constantly running errands. I applied for my CC permit in January and have since realized...I'm not going to be able to CC daily. Little aggravating to say the least. I'm not going to break laws to CC, but it's my right to do so (to CC of course). One shouldn't have to alter their entire way of daily living in order to stay a law abiding citizen. Just curious as to what others think...

Example...My family OFTEN frequents a Mexican restaurant in town that is NOT "primarily devoted" to dispensing alcohol. We never sit near the bar area which is centrally located; always in the non-smoking, family residing sections.

Furthermore...the way the law is written in MS it is prohibited... So, NO...will not carry there. I just feel I should be able to. I am wrong?

Restaurant...Bar? There is no clear cut definition. ALL restaurants around here serve alcohol...So NO CC in any restaurant(s)?
 

I will offer this: I have a gun vault in my vehicle and if I have to visit a non-carry place like the post office, I take it off and stick it in there. At least it's pretty close and not at the house.

Wasn't there a similar law in TN or KY that was held invalid because it was too vague with regard to the "primarily devoted to dispensing alcoholic beverages..."?

Move out of that socialist-cradle-to-grave state you live in an move to New York. . You can cc in any restaurant or bar and you don't have to renew your cc every 4 years because it is issued for life.
 
LOL...You are more correct than you know. My wife and family have seriously been considering moving for some time, but not northeast.

Blegh, what a poorly worded law! That's why I like math.

In my state you aren't allowed to carry anywhere that a person under 21 is not allowed as specified by the liquor board. Much better because in our restaurant/bars there is a line on the ground showing the no fly zone.
 
Every state is different ... in Texas, you can't carry if the place makes more than half its revenue from booze ... so, restaurant where they have a bar is usually ok, bar with a kitchen usually a no-no ... and the place has to be posted with a sign making it clear if it's a 50% plus establishment ... kinda wacky, but I'm not a barfly and always carry when we're out to eat ...

In the choice between the 2; NY vs MA I say neither... That was my point. Re-read my post.. Hence the statement south of the Mason Dixon line...

Both are "may issue" when it comes to a concealed carry license, leaving your right to self defense outside of your home, up to the discretion of the issuing body. Very unconstitutional...

I'll stipulate that MA is worse, but NY would not be my choice to escape the threat of ridiculous anti gun laws.

MA is 6 years for renewal by the way...
 
Now that my wife has turned in her application...This question is being debated between US.

She thinks ANY establishment that serves alcohol is off limits to CC.
The way it's worded, I think otherwise...

Here in Ohio there is a bill in the works again this year to make it so we can be in a place that serves as long as we arent drinking ourselves.
It was a real pain to disarm just to go into Red Lobster for Valentines day with my wife.
They dont have a GB sign, so I dont mind giving them the money.
 
Fortunately in Nevada serving alcohol not an issue

Interesting how so many states make laws as if serving alcohol or even drinking alcohol negates an individual's right to self defense. Here in Nevada almost every restaurant serves alcohol and our bars, restaurants and liquor stores can serve alcoholic beverages all night and day if they choose. We have no mandatory "last call". No big hang ups about alcohol in Nevada.

In Nevada a CCW permitee may carry anywhere alcohol is served, except the airport and college campuses (soon to change). When it is not legal to carry is the same as when it is not legal to drive regarding alcohol. One may drink while carrying (not advisable) unless or until one's blood alcohol level is at the legal limit (not a good or responsible gamble to take).

About 2 years ago a Reno man shot a gunman in a bar in Winnemucca, Nevada. Could have headed off a massacre. No details about whether the "patron" was drinking or not (I bet he was). No charges filed against the "patron". http://www.lvrj.com/news/19257519.html

I guess you'll have to ask the owner for his financial information so you know where most of his money comes from... food or beer.

That statement to me sounds like you can carry if they sever as long as it isn't the main part of their business. IE - income.
 
Interesting...well i am curious why in FL ... I a law abiding citizen issued my concealed cannot carry it wherever I need to go. I want the right to protect myself at arms length, not that I am unable to partake in some hand to hand, but I definitely prefer eliminating the threat and realize my limitations. Nothing to those tough GI Janes out there but I know there are men who can and want to hurt women and they know if I'm in a bar I am not packing. The law in Florida is "any portion of an establishment licensed to dispense alcoholic beverages for consumption on the premises, which portion of the establishment is primarily devoted to such purpose," and that would then include the main dining area of a restaurant/bar or bar/grill provided alcohol was served in that area. Moving to NC and same is there plus if you are consuming alcohol or have it in your system anywhere else you also cannot carry. So if I go out drinking I either have to leave it at home or leave it in the car when i come back because I am not permited to carry it from the car to the home because I have alcohol in my system. I think it is ridiculous...:wacko:
 
In SC, if we are lucky, the law will change. Personally, I read about more drunk drivers killing people than drunk gun owners. If 08 is good for driving, it should be good for CC. If you decide that you will CC and ignore thelaw, the problem is that if you have an altercation after coming from a restaurant, you have a lot of explaining to do as to why you have a gun on your person. Personally, one of my most urgent needs for carrying would be that late night dinner out and going to the parked car in the dark scenario. Right now you and I cannot have our firearm CC, as we walk the street back to our car at night because, in all likelihood, the restaurant served alcoholic beverages. Just seems that legislators have to treat everyone in a nanny state---they cannot trust us to CC in an alcoholic environment as if we are babies---it is ok to drive, but not to CC--ridiculous---and they tell us to do as they say and not as they do--when they get exceptions to all kinds of limits put on us. Recently in SC someone proposed a bill that would allow legislators and their staffs to CC at work but our governor, who is pro-gun, said that if they want to carry, everyone should be able to carry. It's like the airport security--you and I have to be undressed but if you are in congress or work for congress you get a free pass--why?--some of these slimeballs are closer to being felons than you and I, yet they get a pass. Goes for their health plan and retirement plans which have nothing to do with Obamacare and social security--those are great for us, but not good enough for them. Sick of all this crap. Love this country but despise this government.
 
Texas has the 51% signs, a place that obtains more than 51% of there income from serving liquor and you may not enter CC, and sign must be posted. You can carry into a food establishment with a bar as long as no signs are posted, If I am carrying I will not drink.
