CC in a restaurant...that has a bar...

As I have said several times before, if its a bar you don't need to be there carrying a weapon, if its a resturant with a bar, go in have your dinner, keep your weapon CONCEALED, and above all KEEP YOUR MOUTH SHUT, and leave, and when you go to work the next day, tell your buddys about dinner or the Band Music or whatever but just hush about haveing the gun, agreed resturants don't get robbed to often but what if walking to your car with your wife/girlfriend and some inbread degenerate jump's you, would you not rather have your gun than not............I am not advocating doing something not leagle, but would you as least not want to be able to do something to protect your self other than maybe call 911

Suppose you leave the restaurant and meet up with your worst nightmare and now have to explain to the LEO, where you were and why you had a firearm CC, not to mention the civil suit that will surely make you very poor. I also thought that way but-----.
 
Interesting...well i am curious why in FL ... I a law abiding citizen issued my concealed cannot carry it wherever I need to go.

So if I go out drinking I either have to leave it at home or leave it in the car when i come back because I am not permited to carry it from the car to the home because I have alcohol in my system. I think it is ridiculous...:wacko:


You are an adult. You have a choice. You don't need to go out drinking.

Send letters to all the CEO's of the liquor manufacturers and distributors and tell them you are going to boycott their products because you can't exercise your second amendment rights while using their products.

I understand what your saying, but if you have left the resturant and now walking to your car and said nightmere shows up and you dispatch him, I really don't thing the Leo is going to care where you just had dinner, also this is assuming that there is a state law forbidding specificly that you cannot carry in said resturant/bar, if there is no state law, and the resturant just has a sign on the door, this the resturants rule not the law, all the resturant can do is ask you to leave you are not going to get in trouble unless you refuse to leave, if there is said law, I must refer to my previous post, just hush about the gun and keep it concealed, agreed your takeing a chance in the senario you described, but I would rather have my gun than not
 
To answer this question I live in Iowa, as of now I can carry into bars whenever and however I want CC OR OC. Check your local laws but I'm thinking since they serve food that it would be considered a food establishment, if you have any doubts sit in a different section away from the bar
 
The restriction(s) themselves are a bit ornerous. Perhaps the authorities should treat "carry" and booze with the same requirements as they do for driving. i.e. IF an "incident" occurs with you and your weapon, you are "tested" for "carrying while intoxicated" at the same level as driving. You "fail" and your "case" is weakened accordingly in court.

An exemption to this would be, of course, at home. Home invaders are not concerned if you have had a few in the privacy of your home when they try their "game plan". Nor should the authorities if it is a "righteous shoot".

THAT would relieve a lot of the legal hair splitting Legislators try to write into gun restriction laws. Puts it right back on the citizen to demonstrate responsibility while "carrying". Fail to do so.... you lose your carry rights.

Move to Indiana. He have some of the best Carry laws around. the only places you can't carry is at a school (unless you're just dropping off or picking up children, then You still can) govt. Buildings, or the county or state fair for some reason. Plus we have castle doctrine stand your ground and the third party rule. I just picture Governor Daniels riding separately in his motorcade on horseback with a 30-30 in a scabbard and a cowboy hat on haha. Oh and none of those Fascist you can't carry near booze laws. Here your right is about as close to "not being infringed" as you'll get.
 
Also I hear a lot about civil suits. Idk about everywhere but here our castle doctrine clearly outlines that you are protected from civil penalties as well as legal. Is it different elsewhere?
 
CCW is an all around challenge in most states and most situations. It is my right but it is also a big fat political issue that the gov'mint just can't seem to keep their hand off of. That said, Mr. Boom and I go just about everywhere together and I never even question it. I'm so comfortable being armed around the straights that I have to be careful not to swagger into an establishment that don't respect Mr. Boom's presence. Was standing in line that the PO for stamps about a month ago when I had to excuse myself right quick!

When I visit these locations, which I try very hard to avoid....well Mr. Boom just hangs out under the drivers seat keeping an eye on a impossible to reach and ever shriveling French Fry or two.
 
In TN as the law is interpreted now, you can carry in a resturant with a Bar, as long as the resturant's sales exceed the bar's sales, whats a bit strange is the law also can be interpreted, that you can carry in a Bar but you cannot consume alcohol???????
 
Here in Ohio there is a bill in the works again this year to make it so we can be in a place that serves as long as we arent drinking ourselves.
It was a real pain to disarm just to go into Red Lobster for Valentines day with my wife.
They dont have a GB sign, so I dont mind giving them the money.

I live in Ohio as well and the bill is now a law. It does take the standard 90 days to kick in though and that 90 days is up at midnight, Thursday, September 29th. Beginning that Thursday, you will be able to cc in any bar, restaurant, or open air sports stadium that does not have a "no guns" sign just so long as you are not drinking.

Also, the newly eased restrictions for carrying your loaded weapon in your car take effect the same day. Now you can keep your loaded gun on the passenger seat next to you, under your driver's seat, or anywhere you feel like it inside your vehicle as opposed to having it in a holster, center console, glove box, or a case that has a snap, zipper, button, or other type of clasp. Driving around town wearing a gun in a holster is not always pleasant after 20 minutes. Finally some common sense will be law on the 29th.
 
I don't want to beat a dead horse here, but I keep asking myself where I CAN and CANNOT carry. Before I even get my permit, I find myself debating IF I should CC every where I go. I'm in and out of my vehicle constantly running errands. I applied for my CC permit in January and have since realized...I'm not going to be able to CC daily. Little aggravating to say the least. I'm not going to break laws to CC, but it's my right to do so (to CC of course). One shouldn't have to alter their entire way of daily living in order to stay a law abiding citizen. Just curious as to what others think...

Example...My family OFTEN frequents a Mexican restaurant in town that is NOT "primarily devoted" to dispensing alcohol. We never sit near the bar area which is centrally located; always in the non-smoking, family residing sections.

Furthermore...the way the law is written in MS it is prohibited... So, NO...will not carry there. I just feel I should be able to. I am wrong?

It seems clear enough to me. The operative phrase is "...that is primarily devoted to such purpose." Yes, the restaurant portion serves alcohol, but not as its primary function. its primarily devoted to serving food and any alcohol served is secondary to the food. The bar section of the establishment is primarily devoted to serving alcohol so you may not carry in that portion of the restaurant.

Yes, you should be constantly aware of where you can and cannot carry. That comes with the territory, so to speak. That also means keeping abreast of any new laws being enacted. I advise you to go directly to your state's codes and learn to read and understand them on your own. If at that point you still don't understand them, you should do two things: 1)Ask your local LEOs their interpretation of the law, since they are who you will be dealing with initially. 2) Spend an hour with a lawyer who specializes in firearms law to get the "rest of the story", if there is one.
