Drawing your firearm to scare away a threat?

Ok, let's visit this scenario. A man with a knife comes at you, you draw, he drops the knife as he sees you draw... if you have time to not pull the trigger, you will anyway?

We should be able to control ourselves from the pulling the trigger if the threat dissolves as we are drawing. If the threat continues as you are drawing, absolutely, stop the threat.

If there is no threat (as the OP asked), then absolutely do not pull out your firearm.

Also... those who have been in a draw/fire situation know about a thing called "time dilation" where it seems that time stretches so there is time to make the decision to draw and fire and then decide not to fire by the time the gun is out/pointed.

The "time dilation" you are referring to is called tachypsychia.
 
With the exception of extreme conditions unfolding, If I have to draw I shoot. Two round bursts, evaluate and repeat if necessary to remove the threat. I have been trained in take down procedures and fully qualified. BUT........ I'm a civilian now and with the rare exception if I have to break leather there will be rounds down range. I'm not going to second guess myself in that 10th of a second.

Wasn't there a thread about a knife-wielder able to cover 21 feet in less time (1.5 seconds or less?) it took some CCers to draw and fire? Think that study has been around for years.

I'm not debating what if's or what might be's. I'm am not LEO, my rules of engagement are different. My training will dictate my reaction. Which again as been reiterated in my multiple posts concerning this subject on the multiple threads concerning this subject.

I have heard of cases in SC (not sure if it is the same in other states) that if you flash, brandish, draw, etc to scare without another gun in sight (or other obvious and perceived threat), that you can be charged with assault with deadly weapon. I was told that if you do show or draw, be the first one to call 911 so they have your reason for drawing rather than the bad guys allegation that you started it.

Can you cite any sources or links?

(Definitely be the first to call 911 if you're ever in any type of altercation and have to use a firearm in any way whatsoever.)

I went searching for the training paper I read that in, but have not found it yet. When I do I will present it. Thanks for the reminder to cite my sources when posting

I know there have been some arrests for threatening & brandishing in SC. But, all of the ones I've heard about really don't involve a CWP holder in a SD situation. However, I do know that we do have some poor instructors in our State that seem to go a little overboard in training because of their unsubstantiated paranoia.

This thread reminds me of something I thought/think is pretty funny. Wonder if it would get a HS kid arrested today. Here's my story.
THis happened when I was a Senior in HS...never even had a thought of owning a gun back then or if I could even own one.
It was about 9 o'clock on a Friday night. I am driving along passing a Jr. High in a neighboring town.I suddenly felt and heard a hard thump from under my car. My friends asked if I saw those kids throw that rock at me. When I got to the light I whipped around the median and made a U-turn. I pulled into the Jr High and one of the geniuses of about 5 kids said "we didn't throw that rock!" Nothing was said to them about a rock and this kid was the first to speak. Obviously they did throw it because they knew and were the only ones there. While standing outside my car I said loudly to my friend, " Get my gun, it's in the glove compartment" I came up with a rag over my hand and put my rag covered "gun" (just my hand, no gun)
on the roof of my car and started aiming my finger at the fast scrambling kids. THey went over that 10ft. high cyclone fence amazingly fast. One poor kid got his pants caught up on the prongs. I actually felt bad for him. I yelled out " I'll let you go this time but it better not happen again!"
Right or wrong, funny or not, I bet they never threw rocks at passing cars again.:lol:

I like that, and those times. Back then the gangs would throw rocks to act tough for their friends, and run when threatened. Now a days it seems they have lost that common sense to run and instead try to challenge or call your bluff.
I can only hope that enough sensible people exercise their 2A right and scare that common sense back into the gangs.

I have to agree. Some of the stories I heard were substantiated by others in the class, some, were not, and those I have to wonder about.
 
In Michigan, one is allowed to use both less-than-lethal AND lethal force to protect one's self from imminent danger of great bodily harm, death, or rape. MI law does not specify that the other person must have a weapon - evidence of intent to do any of those things (reasonable man) is sufficient. Pulling a firearm but not actually firing it under those circumstances is less than lethal force.

It becomes brandishing when there is no imminent danger of great bodily harm, death, or rape and you pull and wave your firearm in a threatening manner.
