It's important to understand that NY did not outlaw the assault weapon, but rather imposed a means test requiring the guns meet certain requirements in order to be sold. Certain features aren't allowed. I didn't expect the larger companies to relocate over this. The cost of moving is massive, perhaps not survivable by the company. What it does show is that the only thing important in corporate America is profits.

An Army combat veteran with over 12 years of service is now facing weapons-related felony charges for possessing five empty 30-round magazines. If convicted on all five counts, one for each mag., the former soldier could spend up to 7 years behind bars.
In January, Nate Haddad of Watertown was parked on the side of the road waiting to meet someone who was interested in purchasing his magazines, which were built for an AR-15.
Although magazines over 10 rounds had been banned in New York since 1994, there had been a grandfather clause for mags made prior to that year. Haddad, who claimed to have purchased them at an Army surplus store, believed he was in possession of lawful, pre-ban mags.
When police officers showed up on the scene (it’s not exactly clear why they stopped), they disagreed with Haddad about the production year the mags. They arrested Haddad and charged him with five counts of Criminal Possession of a Weapon in the Third Degree, a Class D Felony.
“I certainly did not think I was committing a felony crime by having these [mags],” Haddad told local news affiliate Link Removed.
“My understanding of what I had in my possession was that it was manufactured before 1994, but the arresting officers told me otherwise after I showed them the magazines that I had in my possession,” Haddad said.
In court last week, the Jefferson County prosecutor offered Haddad a plea deal, WGRZ-TV reported. Seth Buchman, Haddad’s lawyers, said his client could have taken five misdemeanor counts and a conditional discharge following a probationary period to avoid a possible felony conviction and jail time.
Haddad politely rejected the deal.
“Even if I took that deal I would still be branded as a criminal, and I don’t think I should be,” Haddad said.
“At this point, I can’t say for sure how doing so might impact my access to Fort Drum,” he continued. “If it were to be restricted, then I would likely lose my job.” Haddad, who injured his shoulder during Special Forces training in 2010, now holds a civilian job at Fort Drum.
Given this tough decision, Haddad is now gearing up for a protracted legal battle in court. As such, his Brother has created a Link Removed where individuals can donate money to help pay for the cost of Haddad’s legal bills.
Thus far, in a little over a month, 1,137 people have donated $45,000, which is almost half way to the ultimate goal of $100,000.

Beyond the scope of Haddad’s personal plight, New Yorkers should view this as a cautionary tale. Following the passage of Cuomo’sLink Removed, known as the Link Removed, it will soon be illegal for anyone to possess a magazine holding more than seven rounds.
What’s more, there is no grandfather clause. Consequently, it stands to reason that many otherwise law-abiding New Yorkers will be slapped with criminal chargers for possessing what is currently considered legal property.

Bans possession of any “high-capacity magazines” regardless of when they were made or sold. The maximum capacity for a detachable magazine is reduced from ten rounds to seven. Magazines owned before passage of the SAFE Act able to hold seven to ten rounds can be possessed, but cannot be loaded with more than seven rounds. .22 caliber tubular magazines are exempt from this limit. Previously legal “pre-1994-ban” magazines with a capacity of 30 rounds are not exempt, and must be sold within one year to an out-of-state resident or turned into local authorities. The magazine limit takes effect April 15, 2013.

That list is all BS. Those companies are not selling firearms to NYS. All vendors with NYS have to be registered and that information is available to the public on the Comptroller's web site.

Claiming they are not going to sell firearms or ammunition to NYS when they aren't selling fireams or weapons to NYS in the first place is pure BS.

Second, any company that already had a contract with NYS would be bound by contract law to complete it.

Many Gun Manufacturers and Retailers are refusing to sell guns and ammunition to Law Enforcement in New York and other antigun states. The latest report on The Blaze claims that "now over 44 gun companies have stopped selling to law enforcement" in states that limit a private citizen’s right to own a gun.

Link Removed Serbu Firearms, a manufacturer of bolt-action and semi-automatic .50 caliber sniper rifles, is refusing to sell their wares to the NYPD. Their reason, of course, is that owing to unfair gun laws, they will not support law enforcement in New York.
Serbu is one of almost 150 companies that has officially refused to sell to law enforcement in New York following the passage of the SAFE Act, the controversial gun control package that has been met with scorn by gun owners across the nation.
The company posted the NYPD’s inquiry as well as their refusal to their Facebook page, with names omitted.
Company founder Mark Serbu said, “Unfortunately, we have a policy of selling to state law enforcement agencies only what is allowed to be sold to private citizens in that state. Since the passage of the NY SAFE act, the BFG-50A is considered an assault weapon and as such is no longer available to private citizens in the state of New York. Therefore we have to respectfully decline to supply your department with BFG-50A rifles.”
He also said he felt bad about not being able to outfit the officers, because although he would like to get his guns into “as many police departments as possible,” his decision is a matter of principle.
“Because of a stupid law the venerable NYPD won’t have the best tools for the job.”
What’s interesting about this is that while Serbu makes a fine firearm and impressive .50 BMG rifles, they’re not a first-tier company in the sniper rifle world and are perhaps best known for their compact Link Removed shotguns.
Two of the biggest names in sniper rifles, Barrett and ArmaLite, have already stated that they will not sell to the police departments of New York. If the NYPD is calling Serbu, we have to wonder how many other companies have told them to keep walking.
Serbu is the 137th company to halt sales to New York law enforcement according to the unofficial official New York Boycott list, which is now up to 142 companies (at the time of writing) and likely to keep growing.
The New York State Rifle and Pistol Association, an NRA affiliate, along with the Westchester County Firearms Owners Association, Sportsmen’s Association for Firearms Education, Blueline Tactical Police Supply and several other plaintiffs Link Removed and the SAFE Act.

While the President and the rabid left continue to pursue a ban on semi-automatic firearms, manufacturers are fighting back by refusing to sell to government agencies that support the President’s plan.
Chicago Mayor Rahm Emannuel tried to pressure Bank of America to stop doing business with firearms companies. Viewed as perfectly acceptable behavior by a large portion of America, firearms manufacturers copied the tactic and returned the favor.
Larue Tactical, Olympic Arms, Templar Custom, Extreme Firepower and now RAM Arms have vocalized that they will not sell their products to government agencies that support the President’s position on gun rights.
The President believes that ordinary citizens do not need shotguns with more than 5 rounds, pistols with more than 10 or rifles with more than 10. The math is a bit fuzzy as most murders are committed with handguns containing relatively few rounds. The number of rounds is actually irrelevant. In fact, the gun is irrelevant – apparently, when someone decides to kill someone else, they prefer baseball bats or choking the life out of them over guns.
The number of gun crimes committed by lawful gun owners is infinitesimal -yeah, like, near non-existent compared to the total. I know, who wants facts when emotion can lead us to a final decision?
Oddly, criminals get guns that the lawmakers in Chicago, New York and LA have banned. How is that possible? They made the law, certainly that means everyone will follow it?
Sarcasm aside, many firearms manufacturers have decided to answer the government’s unconstitutional overreach by refusing to sell government agencies arms or ammunition. As the President says, the people should come first – and so they shall.

Now comes a quandary question for those who would boycott guns made by Remington. Remington makes guns for others and while bearing the Remington/Remington Arms Co. name and Ilion, NY rollmarks, they are sold by/manufactured for a southern company. So would you not buy from that company too?

Guns are tools and meant for one thing and at some point in the next twelve months you are going to get a chance to find out what for.

When I see threads here about gouging and coloring on your gun with crayon...well...what can I say, what I should not say, but you get the drift.

President Barack Obama is trying to solve big problems in his proposed 2014 budget. His efforts to curtail entitlement spending have gotten most of the headlines. But he also seems determined to complete the U.S. Department of Homeland Security’s new headquarters, the largest federal construction project since the Pentagon rose in the 1940s. The cost: $3.9 billion.

The project would unite at a single location nearly all DHS’s 22 divisions devoted to thwarting terrorists and safeguarding the populace from natural and manmade disasters. The site is the campus of St. Elizabeth Hospital, a former federal asylum that was once the home of poet Ezra Pound and John Hinckley, Ronald Reagan’s would-be assassin. There would be 4.5 million square feet of workspace in the new facility and ample employee parking.

The project’s supporters say the price tag is justified. They say it’s not easy to get the various DHS divisions to operate in concert with each other if they are scattered throughout the capital area. At the 2009 groundbreaking, DHS Secretary Janet Napolitano herself made the case for the agency’s costly new digs: “It will help us have meetings. It will help us create a culture of ‘one DHS.’”

It didn’t take long for the project to become mired in politics. House Republicans, a number of whom see the DHS as an inefficient and fiscally profligate bureaucracy, were loath to fund the new headquarters fully. A new headquarters for the U.S. Coast Guard, which involved more excavation than any real estate development in the District of Columbia’s history, moved forward. The rest of the endeavor languished, becoming a symbol of Washington dysfunction. The tighter integration that Napolitano promised also remained a work in progress. The DHS is on the U.S. Government Accountability Office’s “high risk” list, a distinction it shares with such troubled federal agencies as the U.S. Postal Service.

Now Obama is trying to ensure that the DHS headquarters eventually rises. On Wednesday, the president included $367 million in his budget to continue construction.

Getting the money won’t be easy. In February, one of the DHS’s more persistent naysayers, U.S. Representative John Mica, a Florida Republican, boasted about how he and his fellow party members had curtailed the project. He said he would also like to dismantle much of the DHS.

He’d better act swiftly. If the White House ever gets all the DHS’s divisions on one campus, nobody will want to move them again.

How easy you are fooled.

They are not NYS vendors.

It's like a bachelor claiming "I'm going to stop cheating on my wife"

I'm not going to buy crack cocaine anymore.

I'm not going to pray to Allah anymore

I'm not going to wrestle alligators anymore.

All meaningless BS because I've never done any of those things.
 
They can stay wherever they want and I won't complain.

However, I try really hard not to spend any money that ends up in the Oppressed States and there are plenty of other great manufacturers out there.
 
That list is BS - those companies didn't have contacts to sell anything to NYS. All public contracts are public information and are listed at a website maintained by the nys comptroller.

Barrett opposes those who are illegally disarming the American public from their efficient arms and creating superior armed elitist government agencies.

Elected state officials of New York, having been sworn to protect our Constitution, have instead committed an offense against it and their citizens by stripping inalienable rights duly protected and guaranteed under the Second Amendment. By their deliberate and sinister actions, these officials now cause their state and local policing agencies to enforce these unconstitutional and illegal so called “laws”.

By current law, Barrett cannot be an accomplice with any lawbreaker, therefore, cannot and will not service or sell to New York government agencies. In the course of world history there have been officials that strip inalienable rights from the people that were given to all by our Creator. Most of these officials inevitably come to trial, some do not.

Intentionally violating constitutional rights by officials that have sworn to uphold them should have severe prison sentences.

With the clear vision of horrible events in history repeating itself, all manufacturers of firearms or related equipment remaining in partnership with such violators should have a respectable fear of being found with the guilty on their day of trial.

Civil war battle lines being drawn as Magpul, Colt, Beretta and other gun manufacturers relocate to pro-Constitution states

(NaturalNews) A civil war looks likely to break out in America, and it will pit gun rights advocates (people who love liberty) against gun control zealots (people who hate freedom and love tyranny). The battle lines are being drawn right now as gun manufacturers are leaving anti-Constitution states like Connecticut and Colorado and relocating to pro-Constitution states like Texas and Arizona.

Why does this matter? Because in effect, the anti-Constitution states are disarming themselves by expatriating weapons manufacturers. Thus, they are eliminating their own weapons infrastructure and leaving themselves relatively defenseless should a civil war occur.

States like Texas and Wyoming, where gun manufacturers are increasingly moving and setting up shop, are simultaneously building up a massive arms infrastructure that may ultimately spell the difference between victory and defeat in a civil war.

This is the tragic truth of the current anti-America, anti-Constitution, criminal government takeover happening in multiple states across our Republic right now: those who hate liberty are disarming themselves.

Colt moving to Texas, others likely to follow
If the majority of people in states like New York, Connecticut and Colorado wish to be disarmed slaves living as subjects to a tyrannical government, then they are also going to see more gun owners leaving those states and seeking new lives in gun-friendly states like Texas, Montana, Arizona and Idaho. I can tell you firsthand that here in Texas, we shoot big, heavy firearms on the weekend (.50 BMG), and if the local sheriff shows up, it's only because they want some trigger time, too! (You gotta pick the right county, though. Stay away from Travis County at all costs...)

Because Texas is a state that upholds the Second Amendment rights of its citizens, Texas is already attracting both gun manufacturers and gun-friendly citizens who are relocating there. For example, firearms maker Colt is leaving Connecticut and moving to Texas, bringing valuable skills, hardware, manufacturing equipment and jobs to Texas.

Magpul industries, makers of 30-round rifle magazines, also says it's leaving Colorado and looking for a destination more aligned with the Constitutional rights of American citizens.

Such moves are not only valuable for the Texas economy; it also means that once the Civil War is unleashed in America and the collectivist anti-American, anti-Constitution leftist gun grabbers try to force national disarmament at gunpoint, states like Texas will be cranking out Colt rifles and putting them into the hands of freedom fighters who will send as much lead down range as is necessary to reinforce the point that the Bill of Rights is not negotiable.

Texas also controls much of the national energy supply
If leftists living in treasonous states try to push their criminal agenda onto the entire nation, let 'em figure out how to live without energy, too. Texas not only has the guns, you see... it's also got the energy. Over one-third of America's oil and natural gas flows through Texas-based refineries and ports. Any attempt to mess with Texas means the rest of the country won't get its energy needs met.

Texas can defend its resources with -- guess what? -- citizens armed with rifles made in Texas, loaded with high-capacity magazines made in Texas, shooting bullets loaded in Texas in full alignment with the Bill of Rights that's defended in Texas.

That's why every time another criminal state government (like that of Connecticut) passes another unconstitutional law stripping its own citizens of the right to own firearms, I cheer when the gun manufacturers in that state announce they're moving out. If Boulder, Colorado wants to fulfill its socialist dreams of total government tyranny, then we all welcome MagPul exiting Boulder and setting up shop in a pro-Constitution zone where the company's many talents will be fully appreciated.

Traitorous states are disarming themselves
I love the idea that all these companies are moving out of wannabe communist cities like Boulder, or traitorous anti-Constitution states like Connecticut. Because in truth, we want the anti-Constitution states to have no weapons manufacturing infrastructure. It will make them easier to defeat in a military campaign designed to free the enslaved citizens living in those states from tyranny rule.

This fact is multiplied even further by the fact that many U.S. gun and ammo manufacturers are REFUSING to sell equipment to anti-Constitution governments, including the state government of Connecticut. The full list is posted at The Police Loophole.

It's a huge list of weapons manufacturers and retailers, including Barrett, Midway USA, Cheaper Than Dirt, Larue Tactical, Rock River Arms, Bravo Company USA and more.

What this means is that if the traitorous, criminal federal government attempts to overrun the People with the 2 billion rounds of ammo DHS has been stockpiling, they're going to find themselves outgunned and out-supplied by the private gun and ammo manufacturing and distribution industry which will absolutely NOT sell any equipment to the federal government.

By the way, private individuals are buying up hundreds of millions of rounds of ammo each week, vastly out-pacing DHS stockpiling. On top of that, there's also the fact that brain-dead DHS employees are too stupid to know how to use firearms effectively in the first place. If DHS hands all their stockpiled guns to TSA agents, for example, they're far more likely to shoot off their own toes than wage anything resembling a tactical war. They would be almost instantly out-maneuvered and out-gunned by veterans, hunters, sheriff's deputies and privately-trained citizens.

It is important to bring all collaborators to justice
It's going to be hilarious seeing all the governors and state representatives of the traitorous anti-gun states trying to defend themselves against armed arrest squads when they have no weapons.

I'm just curious how all these traitorous lawmakers think they're going to defend themselves against real justice once the shooting begins. Are they so delusional that they think nobody is recording their names and votes? To be on the record voting to destroy the Second Amendment is nothing less than treason. To cast such a vote in a nation founded on armed resistance to tyranny is nothing less than suicide.

Because the anti-Constitution criminals have disarmed themselves, the pro-Constitution justice teams will be able to march right in, arrest these traitors for sedition and round them up for a mass trial where they can join their fellow traitors from Colorado, New York and California (among other states).

For the purposes of law and justice, it will be very important to make sure that all those who have actively violated the Bill of Rights be arrested, charged and brought to trial for their crimes. Historically, the typical punishment for those found guilty of acts of treason against their own nation has been the death penalty (i.e. firing squad). Even further, those who have actively conspired to destroy America's Constitution and Bill of Rights are, by the government's own definition, "enemy combatants," meaning they may be held and imprisoned under the rules of war.

It's time we all began to understand that lawmakers who vote for unconstitutional gun control measures in America are, by definition, "enemy combatants" who are engaged in actual warfare against America. They have moved the nation far past the era of polite debate. These traitors now have put guns to all our heads, demanding we comply or be arrested. In New York and elsewhere, many innocent citizens have already been thrown in jail for the "crime" of exercising their constitutional rights. The war against liberty has begun, and the battle lines are being drawn as gun and ammo manufacturers relocate to states that choose to side with the Constitution rather than outright tyranny.

You would be wise to make a similar choice. If you are a person who believe in anything resembling liberty -- owning a gun, growing your own food, homeschooling your children -- you will be arrested and imprisoned during the civil war if you stay in the criminal anti-Constitution states.

On the other hand, those very same activities will be openly welcomed in pro-Constitution states that actually abide by the law of the land. And it is those states that will have the hardware advantage once the fighting starts.

I for one am not boycotting all Freedom Group companies. Why should Barnes Bullet employees in Utah suffer for the outrage of Remington/Bushmaster not moving. We too often jump to boycott calls when offended. Did the Remington Arms employees cause the SAFE act? These guys are probably more pissed then you are, but I don't want to see them in the unemployment line. Can you imagine the threat to their business if they tried to move their production out of state while completing an $80 million military contract? Or the humiliating shellacking they'd take in the press if they failed to deliver on a DoD contract and had it cancelled?

Hey, years ago I supported the S&W boycott when they signed the deal with HUD to produce those James Bond style owner recognition systems in their handguns. Thank goodness that agreement was terminated by the Bush administration and S&W was subsequently sold to a Pro 2A company! But in this case, the company proactively subverted 2A rights. Freedom Group has not. Be careful of who you want to send to the unemployment line!

Combat Vet Faces Felony Charges for Possessing 30-Round Mags in NY

Haddad, who claimed to have purchased them at an Army surplus store, believed he was in possession of lawful, pre-ban mags. When police officers showed up on the scene (it’s not exactly clear why they stopped), they disagreed with Haddad about the production year the mags. They arrested Haddad and charged him with five counts of Criminal Possession of a Weapon in the Third Degree, a Class D Felony.
“I certainly did not think I was committing a felony crime by having these [mags],” Haddad told local news affiliate “My understanding of what I had in my possession was that it was manufactured before 1994, but the arresting officers told me otherwise after I showed them the magazines that I had in my possession,” Haddad said.

The NYS Safe Act bans possession of any “high-capacity magazines” regardless of when they were made or sold. The maximum capacity for a detachable magazine is reduced from ten rounds to seven. Magazines owned before passage of the SAFE Act able to hold seven to ten rounds can be possessed, but cannot be loaded with more than seven rounds. .22 caliber tubular magazines are exempt from this limit. Previously legal “pre-1994-ban” magazines with a capacity of 30 rounds are not exempt, and must be sold within one year to an out-of-state resident or turned into local authorities. The magazine limit takes effect April 15, 2013.
Just a couple of things...

First, this is in response to my comment that NYS has not banned assault rifles but has rather changed the means-test criteria for weapons that can be purchased. The means test requires the weapon have no more than one of the features defined in S265.00 NYS PL. AR's that contained more than one of the features are grandfathered-in.

Second, this mag capacity arrest has nothing to do with the Safe Act. In January, when he was arrested, the mag restriction on 10 round mags was not yet in effect. It took effect April 15, 2013. So he was arrested under the old law defining any 30-round mag manufactured after 1994 as criminal possession of a weapon under Article 265 NYS PL. He had until April 15, 2013 to dispose of those mags. However, under the old law one is required to be able to prove the date of manufacture is pre-1994. And that is usually not possible. Of all the guns I own, none of my mags have a date of manufacture or a serial number that can be traced back to a date of manufacture. So if I'm in possession of a 30-round mag without a serial number or date of manufacture I am unable to prove the legality of the mag. Had the mags contained this information he couldn't have been arrested. For this reason I have always taught NYS students to get rid of it if there is no date or serial number.

Third, and most importanly, ignorance of the law is never a defense. As someone who teaches the NYS Penal Law we must understand he has an obligation to understand the laws in effect in January 2013. Although we may not agree with a law there are procedures for overturning bad legislation. Ignoring it, pleading ignorance or defying it will ony bring trouble. On January 15, 2013, the day the Safe Act was passed I began teaching my students to reduce their mags to seven-rounds. Immediately. Start getting used to it. Don't make a mistake and carry more than the law allows after April 15, 2013. Carry another mag if you feel the need. But don't test the law.

Now I personally don't agree with the law. It's a joke. It's ignorant for Andrew Cuomo to submit a position that possessing mags with a capacity exceeding ten rounds will reduce crime. It's nonsense. It's part of a larger agenda and I believe he'll pay dearly on election day. But I will follow the law until such time it is overturned because if I don't, I'll surely be charged and lose my firearms. And moving out-of-state is not an option. Too much $$ involved with uprooting everything.
