Weapons Ban

i'm all for open gun trade and rights, but dont forget this either. there was some good out of it in the form of longer permits, grace periods, and the board to review denied permits, but the fact of the matter is he still signed the PERMANENT ban and the bolded area below tells you how he really feels (or it's ANOTHER thing he's flip-flopped on).

Romney signs off on permanent assault weapons ban / iBerkshires.com - The Berkshires online guide to events, news and Berkshire County community information.

Governor Mitt Romney has signed into law a permanent assault weapons ban that he says will make it harder for criminals to get their hands on these guns.

"Deadly assault weapons have no place in Massachusetts," Romney said, at a bill signing ceremony on July 1 with legislators, sportsmen's groups and gun safety advocates. "These guns are not made for recreation or self-defense. They are instruments of destruction with the sole purpose of hunting down and killing people."

Like the federal assault weapons ban, the state ban, put in place in 1998, was scheduled to expire in September. The new law ensures these deadly weapons, including AK-47s, UZIs and Mac-10 rifles, are permanently prohibited in Massachusetts no matter what happens on the federal level.

"We are pleased to mark an important victory in the fight against crime," said Lieutenant Governor Kerry Healey. "The most important job of state government is ensuring public safety. Governor Romney and I are determined to do whatever it takes to stop the flood of dangerous weapons into our cities and towns and to make Massachusetts safer for law-abiding citizens."

The new law also makes a number of improvements to the current gun licensing system, including:

• Extending the term of a firearm identification card and a license to carry firearms from four years to six years;

• Granting a 90-day grace period for holders of firearm identification cards and licenses to carry who have applied for renewal; and

• Creating a seven-member Firearm License Review Board to review firearm license applications that have been denied.

"This is truly a great day for Massachusetts' sportsmen and women," said Senator Stephen M. Brewer. "These reforms correct some serious mistakes that were made during the gun debate in 1998, when many of our state's gun owners were stripped of their long-standing rights to own firearms. I applaud Senate President Travaglini for allowing the Senate to undertake this necessary legislation."

"I want to congratulate everyone that has worked so hard on this issue," said Representative George Peterson. "Because of their dedication, we are here today to sign into law this consensus piece of legislation. This change will go a long way toward fixing the flaws created by the 1998 law. Another key piece to this legislation addresses those citizens who have applied for renewals. If the government does not process their renewal in a timely fashion, those citizens won't be put at risk because of the 90 day grace period that is being adopted today."

"Never before has there been such bi-partisan cooperation in the passage of gun safety legislation of this magnitude in this nation," said John Rosenthal, co-founder and chair of Stop Handgun Violence. "I applaud the leadership of the Governor, Senate President, House Speaker and entire Legislature for passage of this assault weapons ban renewal. They have shown that Massachusetts can continue to lead the nation in protecting the public and law enforcement from military style assault weapons."

You really need to give both sides of that story . The NRA also signed off on that bill in Massachuetts, and the reasons were very obvious. The Dem's wanted a 'ban' that was much stronger than the Federal one (remember they had a veto proof majority in Mass). The NRA, Republicans, and Romeny got them to agree to one that replicated the Fedl one, and no more. Romney stated if they did that, he would sign it...... so then the Dem's could go home and tell everyone they passed a AWB ... which really "did nothing" different than the Fedl ban. But, it looked good. LOL.

So, would you have not agreed to that and negotiated for that, if the alternative was that the Dem's would pass one that was a lot stronger than the Fedl Law, and had the veto power to pass it no matter what Romney did ? They did good, getting it to where the AWB in Mass was essentially no different than the Fedl one already.

Remember : the next President will likely appoint 2 NEW Supreme Court members, who will have a lot of effect on rulings within the court for the next 40 yrs....... are you in support of Obama being the one appointing them, given the one's he has appointed thus far ?

he re-signed a bill that had better things in it for gun owners, but he still made the AWB permanent in that state.

Wrong. The ban was already permanent. As you can see in number 4 below. The ban was already permanent but didn't contain the exemptions that were in the federal ban. They knew they could never get the ban lifted so they worked to get the federal exemptions added. All the other provisions below were also added and were good for gun owners. The facts are plan, this was a good bill for gun owners in MA. The other facts are clear. He has stated that he doesn't support new laws. Obama has called for a renewal of the AWB and has started the rumbles of "Saturday Night Specials". Romney has chosen as his running mate an avid hunter and gun owner. Obama has the idiot Biden. Don't even try to delude yourself that a vote for Ron Paul or Gary Johnson would absolve you of blame. Facts are what they are. Every vote for a candidate that has no chance of winning is a vote for Obama and when he does come for your guns it is absolutely your fault because you handed him that power.

Chapter 150 of the Acts of 2004: An Act Further Regulating Certain Weapons

This is a perfect example of don’t believe in titles. The bill was the greatest victory for gun owners since the passage of the gun control laws in 1998 (Chapter 180 of the Acts of 1998). It was a reform bill totally supported by GOAL. Press and media stories around the country got it completely wrong when claimed the bill was an extension of the “assault weapon” ban that had sunset at the federal level. They could not have been more wrong. Unfortunately for the Governor, someone had also wrongly briefed him about the bill. As a result the Lt. Governor and the Governor made statements at the bill signing ceremony that angered GOAL members. The following is what the bill actually did:

1. Established the Firearm License Review Board (FLRB). The 1998 law created new criteria for disqualifying citizens for firearms licenses that included any misdemeanor punishable by more than two years even if no jail time was ever served.

For instance, a first conviction of operating a motor vehicle under the influence would result in the loss of your ability to own a handgun for life and long guns for a minimum of five years. This Board is now able to review cases under limited circumstances to restore licenses to individuals who meet certain criteria.

2. Mandated that a minimum of $50,000 of the licensing fees be used for the operation of the FLRB so that the Board would not cease operating under budget cuts.

3. Extended the term of the state’s firearm licenses from 4 years to 6 years.

4. Permanently attached the federal language concerning assault weapon exemptions in 18 USC 922 Appendix A to the Massachusetts assault weapons laws. This is the part that the media misrepresented.

In 1998 the Massachusetts legislature passed its own assault weapons ban (MGL Chapter 140, Section 131M). This ban did not rely on the federal language and contained no sunset clause. Knowing that we did not have the votes in 2004 to get rid of the state law, we did not want to loose all of the federal exemptions that were not in the state law so this new bill was amended to include them.

5. Re-instated a 90 day grace period for citizens who were trying to renew their firearm license. Over the past years, the government agencies in charge had fallen months behind in renewing licenses. At one point it was taking upwards of a year to renew a license. Under Massachusetts law, a citizen cannot have a firearm or ammunition in their home with an expired license.

6. Mandated that law enforcement must issue a receipt for firearms that are confiscated due to an expired license. Prior to this law, no receipts were given for property confiscated which led to accusations of stolen or lost firearms after they were confiscated by police.

7. Gave free license renewal for law enforcement officers who applied through their employing agency.

8. Changed the size and style of a firearm license to that of a driver’s license so that it would fit in a normal wallet. The original license was 3” x 4”.

9. Created stiffer penalties for armed home invaders.

Obama Calls for Gun Bans, But "Nanny B" Wants More

In Tuesday's presidential debate, President Obama said that he supported a ban on "assault weapons" and implied that he supports restrictions on "cheap handguns" too. No surprises there. As detailed on NRA-PVF | PVF Home and Home Page, Obama supported banning both types of firearms and many more when he was in the Illinois legislature, and supported banning "assault weapons" when he ran for the White House in 2008, a position he reiterated in the most recent presidential debate.

ANOTHER TROLL, VOTE FOR YOUR GUY IT'S QUITE OBVIOUS WHO THAT IS.

So you prefer a guy who says he wants a ban over a guy who says he won't go for a ban? You prefer a guy who gave guns to Mexican gangs to be used to murder Mexicans and Americans so that he would have an excuse to ban guns? Really?
And does he prefer that to the nomination of Kaitlin Halligan for Supreme Court Justice, Remeber her, she's the NY judge behind the Cuomo's attemp to sue manufacturers for crimes committed with their gun. She's O's top pick for a Supreme Court nomination... read America's First Freedom this month. Does he take that over the possibility of justices Holder, Emanuel or Clinton. After all, O has to repay Clinton in some way for taking the Libya hit. Given the choice of being burned with a match or set on fire are they the same? Know what this reminds me of? Sometimes I put a stone in my shoe and walked around with it there all day. Cause when I take it out later it feels so good. Insane behavior begets insane results.

i'd much rather vote for someone else than these two, but that's what we've been given. yes obama said he wants an AWB, but romney isn't as pro guns as he leads others to believe either. neither is right and both have done things to suppress guns in their own right. look at Blue's posts in here. he despises obama, yet shows the fallacies of the other nominee. people need to get off this one side or the other BS. it's never as cut and dry as they make it out to be.
Do you need a summary of the actual attempts Obama made to outlaw ALL GUNS? Cause if you do I'll post it again, complete with links to the legislation and voting record on each one. Not opinions. Not the media. The actual record. It's massive. There is zero argument on this subject. There is NO comparing these two on the subject overall. Get educated on the subject. Then you can speak from direct knowledge.

Regarding last nights debate the Pres. stated he will imlpement a full ban on certain weapons. But we all know if re-elected the ban will be for all semi autos
and much much more.
I'm curious to learn how you all feel about what could happen.

Sincerely,
DUKE

Personally I do not care. Scalia has assured the guarantee for owning handguns of every make in his write up of the Heller decision.

As for the issue of whether assault rifles (here having the meaning of magazine fed gas operated) are appropriate for civilians, which Obama and Romney both firmly believe in their hearts are not, I don't care.

Blah blah blah.

Blah blah blah blah blah.

It never ends. The BS piles up forever.

Not even sure I want to jump into this pissing contest but….

First, Obama did not say he’d implement an AWB, neither he nor any other sitting President has that authority, he said he’d like to try to get one passed. That means the key is our representatives to the house and senate, we need to let them know where we stand on the Second amendment and we need to let them know that if they sponsor, co-sponsor, introduce, vote for or other wise support and bill that restricts the second amendment rights of law abiding citizens they will lose our vote forever.

Kind of curious how many folks here have ever sent a letter to the congress critter?

Second you guys need to get a little educated on the new AWB. The bill that keeps dying in committee is not just a reinstatement of AWB 94 it would effectively ban most magazine fed semi automatic weapons (many by name). The new bill doesn’t focus on cosmetic features it specifically focuses on the way the weapon works. I’m trying to find the language of the new bill but my goggle fu is weak tonight.

Bottom line , if you don’t have a clue what you’re talking about you probably shouldn’t

obama has already said that he doesn't care about Congress and that if he wants something, he will do it. That was proven in his stand on illegals. Next problem is whom he puts on the SCOTUS. We only are ahead by one vote on most issues. Any loss for us would mean years of anti gun rulings and even the possible loss of the rights granted under the Constitution.

Yeah, I'd like to see how far he got overturning a Constitutional amendment.

Next problem is whom he puts on the SCOTUS. We only are ahead by one vote on most issues. Any loss for us would mean years of anti gun rulings and even

and yet with all these years of a fairly liberal (I meant to type conservative) court no one's managed to over turn Roe V. Wade

the possible loss of the rights granted under the Constitution.

And our most important point the US Constitution grants no rights it merely codifies preexisting rights.

Obama said he will go after Americans' firearms and you can believe him. He can be expected to go after all semi-auto military style long guns. The illegal Fast & Furious run by the ATF and DOJ is an example of Obama administration's ploys to outlaw guns by building a case against US firearm ownership through facilitation of gun walking and use of guns in crimes. Obama has typically bypassed Congress when they wouldn't let him have his way and it is reasonable to expect him to sign an executive order banning the guns should he be re-elected.

Just because I disagree with your view does make me a troll. Your comment shows how little you think of other peoples opinion.

And yes I am a Democrat, I am a member of the NRA, I am a gun owner and I don't want gun control but I am not opposed to idiots like you being denied access to guns.

Why are you all picking on the black guy?

Because he's a socialist bastard
