Non-citizen with permit but no CCW in SC - where can I carry?

Hi all,

I'm from the UK and have a purchase permit in NC but no CCW / CHP. I have lawful permanent residency as the wife is American and I have various rights, one being 2nd amendment.

I notice SC is NOT an open-carry state, but concealing a firearm must be in conjunction with a CCW permit, which I cannot obtain in SC. I have applied for a VA permit (after being refused twice and contacting IA which made them do a 180). I'm not a citizen and therefore unable to get a CHP in NC.

My question is - just where can I carry my gun in SC if I can't lawfully open or concealed carry it!

Obtaining a non-resident CCW permit or license from any other state, like VA, won't help you in SC. They only honor permits from residents of states they honor.

So your only recourse, IMHO, is to figure out how to get a permit in NC.

There are several lawsuits in various states, led by the Second Amendment Foundation (saf.org) challenging state laws that prohibit non-citizens from obtaining a permit/license. You might browse SAF's web site and contact them for insight.

Unfortunately, it's probably not going to be easy for you, but it may be worth a legal challenge for you and others in your predicament.

I don't think I actually directly answered your question.

From www.handgunlaw.us,

"Anyone who can legally own a firearm can carry it loaded if contained in a closed Glove Box, Console, Trunk or a vehicle without a trunk in the Luggage Area in a container secured with fasteners. Their law is very specific on the only locations where it can be carried."

You can probably also carry on private property with permission, or inside a hotel room, but would need to review the SC law (linked previously) for specifics.

Hold on a second. You have a Pistol Purchase Permit for North Carolina and want a Carry Permit for South Carolina? What is your actual state of residence?

NC law clearly states that non-citizens can get PPP's, if they meet certain conditions and provide that information to the sheriff. So yes they can purchase guns, but NC law also specifies you must be a citizen to obtain a CHP

have you noticed the affiliation of your 2 senators and 1 congressman? isn't Burlington a city long in socialist control? they just haven't gotten around to stripping you of your rights

Resident in NC, am able/have a pistol purchase permit for NC. I can't get a CCW permit for SC (don't own property or reside there). SC only recognise the resident CCW permits, which rules me out for this state.

I thought Americans were clued up on gun laws! Federal law says all citizens, permanent resident aliens, conditional permanent resident aliens and certain other non-resident aliens can lawfully obtain pistol purchase permits. Any agency which says otherwise is breaching civil rights.

In short - from what I've read of SC state law and above, I get the impression that it's car carry, or nutin! Thanks for your help though!

Federal law allows states to impose additional regulations, and that has caused many problems. Unfortunately, few of the additional regulations are consistent with the 2nd amendment of our Constitution--the right to keep and bear arms.

I wouldn't expect any legal action you may take to "backfire." I guess it's a small risk, but retribution could in and of itself provoke additional litigation.

Interestingly, I am a US citizen serving in the military but stationed on duty in another state away from my legal residence. It's absurd, but I can't get a concealed carry permit in my current state either since they only issue to residents. And I took an oath to defend the very rights I am being denied. :(

I think you're right, if I can/have applied for a VA CCW, then how come another state says I'm no good! Bizarre.

What is your state of residence? Have you applied to your original state or another state for a non-res permit with good coverage (I'm thinking TX, ND, UT etc) - or is your stationed state one which only recognises reciprocal resident permits

P.S. Thank you for your service to not only the USA, but UK armed forces too! Remember to teach the Brits about gun safety!!

I'm a resident of Pennsylvania, and do have a PA license to carry. I also have a Florida CCW license (as a non-resident). With those two licenses I'm able to carry in 36 states. My current duty station is in Illinois, which unfortunately doesn't recognize licenses from any other state and requires me to be a resident to obtain their license.

Were you able to obtain a license or permit from any other state? Or have you found most require you to be a citizen as well?
 
The lawsuits are actually a good bet, they have ended in the citizenship requirement being dropped in several states.

I am from NC myself, German, non res alien and currently carry with a UT non res permit here in NC.

I come from a LEO background in the UK, and my only thoughts here are whether a lawsuit would be remembered by someone within the LEO field in NC when I apply after getting citizenship? I'm sure someone would remember some British dude suing the Police before applying! If this situation was reversed, this would definitely cause issues in the Police in the UK.

Almost - You can have it in your car without a problem. But otherwise you are restricted to private property with permission. This means your home and yard along with your neighbor's home and yards along with any property such as farm land etc. where you have permission from the property owner. This does not do you any good in Wal-Mart unless you could get a letter from Sam Walton saying it is OK. :) One specific area that is included is any place you "rent" such as a motel room along with to and from your car to the room.

They will NEVER strip me of my RIGHT to defend myself or my family!

Have you ever had an encounter with a LEO while carrying (where you by law advised you were armed)? Does your UT permit list your NC address? If I move even within the same county, I have to get my NC CHP updated to show my new address within 30 days. So it seems NC is a real stickler about permit and ID addresses matching.

We reciprocate with NC so you're good to go carrying concealed just make sure you've got your NC permit in your possession.

We also allow peaceable journey meaning you can travel through our state, armed, and not worry as long as you're not a criminal.
