More Gun Owners Than Non Gun Owners

I just can't resist....

Exactly where in the Constitution does it specify that one loses their rights under the bill of rights if they are in jail?

be careful, it's a trick question.

Are you referring to where it states no one shall be deprived of life, liberty, or property, without due process of law?

Nope. I'm asking where in the Constitution does it say the Amendments to the Constitution (the 2nd is an amendment, remember?) are suspended while a person is in jail?

I don't see anything in the second that says "except where otherwise limited by the Constitution, the right to keep and bear arms....)"

Nothing in the 5th or 14th authorizes the government to suspend the rights secured by the Constitution and the Amendments. it prohibits the government from doing so without due process.

But let's run with the construct that the prohibition in the 5th assumes the authority to suspend the rights in the 2nd upon due process of law.

Who of the following can't carry a firearm in a jail under that construct of the 2nd and the 5th?

1. A convicted felon housed in the jail.

2. A person convicted of a misdemeanor housed in the jail.

3. A person convicted of a traffic infraction and housed in the jail.

4. A person not yet convicted of anything but held in the jail on suspicion of committing a felony or misdemeanor or traffic violation?

5. A person visiting a relative in the jail who has not yet been convicted of any crime or violation.

6. A lawyer visiting a client in the jail who has not yet been convicted of any crime or violation.

7. A heating contractor in the jail working on the HVAC system.

and you have no ability to respond to the issue.

So tell me professor, does the right to keep and bear arms include any gun, by anyone, anywhere at anytime?

Here's your problem - a yes or a no answer is a definition of the term whether you like it or not.

But I'm curious, do you adopt the "Yes it does" definition? If not, then pray tell, what is your definition of the phrase?

See the corner you are painted into? You can't apply the right to keep and bear arms without defining it, but you are not the final arbiter as to the definition. that role was reserved for the courts by our founders.

Yes, I know that is painful for you to swallow. you thought you could just throw the phrase "right to keep and bear arms" up on the wall and it would stick to whatever you wanted it to stick to.

Life is tough. Here, I'll make it even tougher for you - dose the right to keep and bear arms include the right to discharge a weapon any place at any time for any reason? No? Then...ummmm...we have to start defining what is and what is not covered by the right to keep and bear arms now don't we.

Thanks for playing but as you can see from how easy it is to deflate our delusional balloon, I'm looking for a little more challenging discourse from people who in fact, rather than in their own fantasy, do have a clue.
I ALREADY answered your question, but you ignored my answer......

The post of yours I quoted above makes absolutely no sense at all, you are just rambling about nonsense.....

Perhaps you should go read the article I posted a link to and get yourself educated......

Don't remember "the right to discharge a weapon any place at any time for any reason?" listed. That's not the point. Keep and bear arms shall not be infringed is the point. The reality of the Amendment has been bacterized by the politicians aided and abetted by the liberal media. The same media that stands tall on First Amendment Rights but gives a rats a$$ about any other Amendment. Still haven't seen Constitutional Right to abortion but the same media states and supports this tripe.

Looking left... Looking right... Where the He!! is Vernsimpson he started this stuff.

You have to remember that nogods is from New York where you must ask permission from the state and obtain a license just to own or even pick up a handgun. In New York we have no second amendment rights. They are considered civil rights. Civil Rights are granted. Second Amendment rights are inalienable.
He is also an attorney. Lock 10 Attorney's in a room and ask a question and you will get 10 different answers. Why? Because they get paid by the hour.
Never ever ask an attorney a rhetorical question especially if he is on the clock.
I am a transplant living in New York. The people that were born and raised here just don't understand how it works in most other states. They have become conditioned to the Sullivan Laws which were originally written by a syphilitic Irish gangster to keep his rival gangs from legally owning handguns. Then once you are granted a license you were licensed for life and everyone was happy happy happy. There was a widespread attitude of I got mine and screw you.
That all changed in 2013. The life licenses now have to be renewed every five years.
Suddenly and thankfully, New York gun owners are starting to wake up and are realizing that their rights are being molested, but it may be too little too late. The progressive's are in a full blown sprint to the finish line to institute their version of the New Order.
** Progressives are people that believe the only reason communism failed in Eastern Europe is because THEY weren't in charge.**

Answer to the question: That is why it is called JAIL!
Amendment 13 abolished slavery except for:

Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction.

The original gun control laws were written out of fear of black freed slaves owning guns. Not much has changed. The so called free people in the progressive inner cities still aren't allowed to own guns and look how that is working out.

I see a lot of romantic BS but no ability to answer rather simple questions.

One poster claims the 2nd allows any gun, anywhere, by any person, but then puts in the "person in jail" exception without any authority to do so.

And when asked about specific instances of people carrying in jail, he is stumped.

If you can't answer the simple question of does the 2nd protect carry in anyplace, anywhere, by any person, and if you you try to answer it with a limitations but no authority to support your limitations, then it is obvious you have no comprehension of the 2nd Amendment other than the "Conan gets a gun" idiocy.

So I'll give you all a chance to redeem yourselves:

Does the 2nd amendment protect the right of the following people to carry a firearm while in a jail? If not, why not?

I don’t know if there are more gun owners that non gun owners but I’ll bet there are more gun owners than the government thinks there are.
