Can I Use Deadly Force to Defend My Home?

An NRA instructor who teaches the law and is not certified to do so could potentially lose his credentials.

I pray for the sake of human decency that this occurs. It probably won't though, because the N R A is as much a FUDD organization as the poster here who bears their name.

I woke up this morning ( Thankfully ) and did my med tests and took my meds.. went to my computer to check emails, etc. went to my several forums and finally wound up here... went to general discussion... looked through the new posts and found the same thing I found yesterday and the day before

I read thought the few post and laughed at how so those who compromise this forum are like High school Kids... insulting each other, and using history to thinly veil their childish and immature attitude, about life in the United States of America. either they are putting someone down, or attacking new people here who have a right to an opinion or in general point out that anyone can own a computer, despite their level of intelligence or maturity and how these very few people compromise this forum,
Many people come here, but a very few remain... some come here to laugh at those who's life is so mundane, that its more like a soap opera here, then a genuine forum were people can respectfully discuss their differences of opinion.. without the school yard mentality.
the childishness I see is comical and entertaining, but the scary thing is that there are people in this world with thes immature ideas about life in the U.S. and the fact that they may be walking arounf with a lethal weapon on their hip just hoping to use it... the ones that promote the use of deadly force when alternatives are available, ( and there are many ) its like a bunch of pimple faced kids, with a playboy in their hand. That is coming here to boast of their macho ways, and How they are going to do it when someone makes the mistake of giving them the opportunity to shoot them

So , I came here several months ago to offer my experience but immediately fell prey to the cyber predators.. in this forum there seems to be very little respect for anyone... some one referenced this forum in a survet that this forum was a " Boys Club " .. I have to agree, after a few months here, its hardly worth my time to be here. Some may know I am very sick, and use these internet forum to help me get though the day... this is one of them that give not return for the time invested.

What I have noticed is that the people that post frequently (myself included) spend a lot of time trying to debunk ill-advised "advice" or correcting people that we believe are mistaken in their interpretation of our Constitutional rights. Since we all have the right to choose, and the right to vote, I think it is important to voice my interpretation of what it really means. I have read the Constitution. I have read most of the pertinent Federalist Papers (explanations by the founders in trying to get the Constitution ratified) as well as most of the Anti-Federalist papers (the views of those opposed to ratification, based on the thinking at that time). Some have valued my opinion, others have not. No skin off my butt either way.

This is the only forum I visit, as a break from the other stuff I do. I have always had an opinion, and while in the service I had an outlet (and rebuttal) for that opinion. This is my chosen venue for that now that I have retired from the military. I don't despise those that disagree with me, but a character flaw I have always had is the refusal to let an idiot have the last word, since that seems I am admitting they were right.

Also, the NRA courses are taught by instructors who are barely trained themselves. People take an instructor course, demonstrate some teaching ability on the range and get a certificate. Then they're gun experts? They start talking to students about the law. I get NRA students all the time who really never were trained at all. They pay for a class, the instructor boots the class in one hour and gives them a certificate from the NRA. They come for a PP class and have no dexterity or even rudimentary safety training. I won't give them the PP class until they attend a safety and fundamentals clinic on-range.
 
However, what I recommend in PP classes is to simply tell LE that you have nothing to say at this time but will gladly answer questions after you've had a chance to retain an attorney. Then shut you mouth. Not another word. Not even casual conversation. Nothing!

This is the exact instructions I receive upon my renewal training from the security firm that advises me. His exact words "keep your mouth shut" they are there to gather EVIDENCE.

There are two very practical reasons for not speaking to law enforcement without your attorney present, besides the legal reasons:

1. When it is just you and the LEO's, whatever they write down is what you said. Without your lawyer present there is no way to dispute what they say you said.

2. Even if their interpretation is a good faith one, it is not necessarily what you meant. Here is a simple example. Pete and Mike are at a bar. Pete says to Mike "I'll give you a quarter for every $1 bill in your wallet." Mike has four $1 bills in his wallet. He thinks he is going home with $5 consisting of his four $1 bills and Pete's four quarters. Pete thinks he is going home with Mike's four one dollar bills in his pocket after giving Mike his four quarters. Your lawyer, a 3rd party listening to the conversation, can recognize such ambiguities and get them corrected before they become solidified in the official record of the investigators.

Now let me give a real life example. Several women were raped at different times in a park in Buffalo NY in the early 1980's. Anthony Capozzi’s schizophrenia caused him to have “strange” behavioral patterns that a former police officer noticed at a coffee shop about a mile from Delaware Park. The officer pointed investigators towards Capozzi as a possible suspect; he was placed in a lineup, where the victims identified him as their rapist over a year after the actual attacks occurred. There was no physical evidence linking Capozzi to the rapes. He was convicted of the rapes based on eyewitness testimony and sentenced to 11 to 35 years. Capozzi maintained is innocence for 22 years while in prison (he was refused parole because he would not admit to the crime.)

In 2006, a woman was killed along a bike path in a Buffalo suburb. The initial suspect was her husband, who was wise enough to retain counsel and refuse to speak to the police.

Eventually the police connected that murder with a string of serial rapes and murders in the area over the previous 20 years that police believed had been committed by one individual. DNA tests on evidence from the crime scene led authorities to a suspect Altemio Sanchez, who would eventually plead guilty to the 2006 murder and two others. DNA evidence from at least eight crimes has been linked to Sanchez.

That investigation also eventually lead police to retrieve evidence from the Capozzi investigation and DNA test proved that Sancheaz, not Capozzi, had committed the rapes. Capozzi was eventually exonerated and set free, and received a mulit-million dollar award for wrongful conviction.

But let's go back to the husband of the woman murdered in 2006. Had he spoken to police, they might have used whatever he said to pursue the case against him resulting in another conviction of an innocent man for a murder committed by the same man who committed the rapes for which an innocent man already had been convicted. The local papers made a big deal of the husband refusing to speak top the police, as if that indicated guilt. Thankfully he ignored the pressure and listen to his lawyer. Otherwise he and Capozzi might still be in jail today, and Sancheaz would still be on the loose murdering and raping women in the Buffalo area.
 
I don`t care what the law says (and I`m not looking to hurt anyone), if I find someone in my house that shouldn`t be there (burglar, home invasion, ect) I will do my best to see that they are carried out under a blanket in the end.

It's been my experience most people who talk like this in regards to home defense, usually don't have a whole lot in their lives financially to defend.
 
Yup. My best friend is a criminal defense attorney. He's taught at some of my PP classes. During class I ask him, "I've been charged with homicide for shooting an intruder. I need an attorney. Can you help me?" His answer shocks people... "sure, I need a $20K retainer and when that runs out it's $225 per hour out of court and $300 per hour in-court. You'll also be paying he expenses." That case may run $60K in legal bills and he could lose. There could also be additional federal charges or a civil action to defend. The result? Say goodbye to the equity in your home, your retirement plan or kids college money.

Only use a gun when the threat is so great that one must ruin their life to save theirs or anothers.

It's amazing the people who either don't understand this, or else refuse to accept it. Especially if they're discussing it after 3 beers.
 
Look at both George Zimmerman's life, and Darren Wilson's life since they both pulled the trigger in self defense, killing their assailants. Ask either of them which life they would prefer to have. Before or after the shootings they were involved in? The answer is quite obvious. Regardless of how "justified" you were in dropping the hammer, the consequences for doing it will be harsh no matter how, "in the right" you were, or think you were.

And that's the unfortunate part of our world today. Once attacked you're either getting banged by the perp or the judge.

I can guarantee you if Zimmerman could transcend time knowing what he knows today, he never would have gotten out of his car that night. Now he will never have a thing financially for the rest of his life. Whatever he acquires will be taken from him. Remember, he owes this money to lawyers. Wilson was never charged. He had no choice, Zimmerman did. If there will or won't be civil action against him, (Wilson), remains to be seen.

There is one vital difference here....when Zimmerman initially left his car to follow Martin, he was not in his own home nor was he under any attack at all.....Zimmerman is completely irrelevant to a discussion about self-defense in one's home.

It's all totally relevant. It makes a well taken point about these guys who you hear constantly put forth all this cheap barroom talk every time this topic comes up. Such as:

Especially when you take into account by the time you're finished, IF you manage to somehow keep yourself out of jail, you'll be bankrupt.

Insurance statistics show most home break ins are committed by local kids between the ages of 12 and 16. Most are in the house for 2 minutes or less. "Smash and grab" type hits. Most ALL of these kids are unarmed, and are looking for a quick buck. You kill one who is not a direct threat to your life, and you think you're simply going to walk away? And you're the one who jumps on the band wagon to get rid of trigger happy cops every time the subject comes up. Why? So you can take their place playing Mrs. Action Jackson in your living room? You'll be hit with so many wrongful death civil suits, (every one of which you will LOSE), you'll be waiting tables at Denny's the rest of your miserable life trying to pay them all off.

Yes, I HAVE THE RIGHT TO SHOOT ANYONE WHO HAS BROKEN INTO MY HOME, because their very act of BREAKING INTO MY HOME shows ANYONE WITH A BRAIN (that means this does not apply to you) that they KNOW they are there illegally, and they are doing it on purpose.... THEY GAVE ME PERMISSION TO SHOOT THEM THE VERY SECOND THEY BROKE IN...
 
It is very simple, so simple in fact that the liberals on here (we all know who I am talking about, except the liberals themselves) cannot think it through logically...... They think their feelings trump logic and facts, and that we should all think like they do... what an utterly repulsive idea..., to think like a liberal....

The guy in the first high profile CCW shooting here didn't go through ANY of that.

Of course HERE, we don't have a lot of sympathy for armed robbers, home invaders, rapists, etc.
