NY State: First Blood is Drawn.

Ha at least you have a Republican representing you in Washington. I have Durbin (enough said), Mark Kirk the RINO who's anti-gun (the alternative was a mob banker and Obama's personal friend). In Congress, thanks to Chicago Machine gerrymandering, my Republican Rep lost his seat to a "I'll take your considerations in mind while I screw you" liberal. At least my state legislators are both hardcore pro-2A. Durbin actually replies to my emails whenever I ask him to vote against gun control measures (I know he wont I just wanna annoy him) and says "thank you for...blah blah blah"

Perhaps it was an activist action. Maybe the N R A will take up his cause and fund and/or provide his defense with an eye towards getting to the Supreme Court again.....Oops. Did I say "again?" That's right, the N R A has never taken a case to the SCOTUS. Nevermind.....

Just some friendly ribbin' 2Aw. Please don't call me a chihuahua or something over that, OK? Seriously, the guy could have activism in mind. He could be just a stupid guy with a blank stare on his face too, but the fact is, someone is going to have to be a sacrificial lamb to the court system to get anything done about the SAFE Act. Since the vast majority of the country can currently own the types of weapons this guy sold, why not make it about those kinds of weapons? Tailor it to already highly-restricted types of weapons, and it's not going to seem to the rest of the country that your state's gun owners are very serious about restoring their rights, as taking the baby step backwards from ultra-restrictive to highly-restrictive is not something the "unabridged 2nd Amendment" crowd is likely to donate time and/or money to.

I resist including myself in the collective by saying things like, "As gun owners, we need to do..." whatever, but I'm going to make an exception here. I honestly don't think "we" do "ourselves" any favors by accepting the premise that any small arms should be outlawed in any jurisdiction in America. I understand differences in 2A interpretation between ARs and say, Abrams tanks, but if we can't all agree that small arms should unequivocally be protected by the 2A, then we are unnecessarily diluting our strength as an influential constituency no matter which, or how many, gun-rights organizations we employ to aid in our struggle.

Instead of calling the victim of unconstitutional laws passed by tyrants "stupid," why don't you drop your ol' buddy Wayne a line and suggest he and his .org at least take a public stand against this kind of prosecution? Or the JPFO? Or the SAF? Or whomever. Just don't accept the premise that he acted illegally. It is your state government who is acting illegally, and who has been for years.

I see no reason a law abiding citizen should be barred from owning a fully working M1A1. Afterall, we are selling them to our "friends" in Egypt.

Oh, I agree wholeheartedly. It's such a ridiculous argument anyway. Pure economics would control the private ownership of tanks and fighter jets and nukes and blah blah blah better than government ever could anyway. The overwhelming majority of citizens couldn't afford the ordinance to arm such weapons, much less afford the weapons themselves.

It was probably kind of patronizing, but I was trying to get anyone who might be accepting the premise that Mr. Wassell "deserves" to be prosecuted because (at least one) of the weapons he sold already "had no place in NY" to divert that premise to weapons that no one is going to be buying anyway. But I definitely do agree that original intent was to protect any and all arms that a run amok government might bring to bear against the citizenry. I get it.

This guys crime was selling an AR15 that had the evil and threatening 'bayonet lug' in New York. A firearm that is perfectly legal in most other states.
He took it to a gun store and tried to sell it to the FFL. The dealer told him he couldn't buy it because it was an assault weapon that is illegal (bayonet lug) so he leaves.
The dealer reports it to the State Police. State police undercover calls the guy. Hey JJ at JJ Guns said you have a gun for sale. They text and call back and forth. The calls JJ guns and says hey they guy said you refereed him. Can you vouch for him? Dealers says Yeah he is a good guy. Deal goes down.
Jury came back to day with guilty of Possession of illegal weapon (bayonet lug) Possession with intent to sell, and the actual sale.

New Yorkers can sleep better tonight. One less bayonet lug off the streets.
PS Used Cambria Law firm for defense. If you are ever in gun trouble in NY don't call them.
This vets life is significantly screwed now.

The FFL tells you that you're trying to sell an illegal weapon, then some random guy calls you out of the blue asking about it with his only reference being the guy that told you it was illegal? Should've said "wrong number", then moved the weapon out of the house as I'd fully be expecting a search warrant after that.

Yeah, cause complying with the law is not an option.

Mr. Felony is going to learn that unlike him, the majority of We the People don't think that the banned for life felony thing is silly.

Well, you gotta remember that the guy is not some gang banger that has experience with cops, and therein lies the rub. There are a lot of people that are law abiding and don't have a clue how vulnerable they are. Remember ignorance of the law is not and excuse. Rural area where guns are tools. Where if you hear shooting you figure something needed shooting.
In the cities you hear shots. you duck for cover. Either way the state spent a lot of money on this guy.
