I live in ohio and when i was younger i was stupid and got three criminal charges the first was reduced to a misdemeanor the second time and third time were both drug charges but the second time got dismissed because of illegal search and sizeure so the only charge i think i have is drug abuse (marijuana) my last charge was 2 years ago well after i started getting my life straightened out one of my uncles thought taking me out hunting would keep me sober well it did and i have a new found love for guns i was just wondering if anyone lives in ohio or knows ohio laws that could help me getting the stupidity off my record so that i can buy a gun and hopefully start a collection thank you for reading. My suggestion is contact an attorney. Federal regulations prohibit those who abuse drugs from purchasing firearms, and Ohio only requires you pass a federal background check. Since you are clean now, I wouldn't consider you an abuser, but its not me you have to worry about. A lawyer can help you with the answers you need. Unfortunately it can be expensive, but that is the only way to get the RIGHT information on the law.

If all you have is misdemeanors it shouldn't be a problem. My brother has a misdemeanor marijuana charge and has no problem buying guns. A felony is another question. Laws differ from state to state, but under federal law you cannot buy a firearm with a felony record. However most states have a process for which non-violent offenders can have their rights reinstated after a statutory waiting period after all terms of the conviction are satisfied. My father in law just went through this process for a 23 year old cocaine possession charge. There are several law firms that specialize in this process for a flat fee. He paid $1000 and the lawyer did all the work. All he had to do was show up to the court hearing.

Asking as you don't have a felony I am pretty sure that you're good. If you do have a felony, from my knowledge, you wait 7 years to exponge it ($$$) then you will be good. But again, talk to an attorney.

This is a perfect example of why they don't "prosecute" everyone who is denied a sale by a background check. How are you supposed to know if you are prohibited unless you try?
