Governor Cuomo's Ban Is Unconstitutional

Probably a stupid question, but how the heck can states restrict 2A rights? I assume the usual answer is the courts just let them!

I guess even 10 round mags for my Ruger 10/22 will be illegal. Are there any 7 round mags???

States cannot restrict the 2nd Amendment. That was the point of the McDonald decision. Regrettably, some legislators have a serious problem with the Constitution. The ex post facto magazine limitation is even scarier than the second amendment violation. If this is allowed to pass, states can criminalize ANY permissible activity and make a criminal out of the entire population. This CANNOT stand. WE WILL NOT ALLOW THIS TO STAND!
 
i believe we still have some hope guys. i just read an article that says it as moved fowards but it still needs to pass the assembly as well. it said assembly postponed action until 10am tomorrow

The fact that this law violates the Second Amendment is bad enough, but the problem is much worse than just that. If the government can pass an ex post facto law and get away with it, then they can criminalize any sort of lawful behavior. If you know anyone in Western New York, please pass this along. We need to get this out to all the websites and forums we can. This law must fall dead from the press. This is just too important to our freedom and way of life as American citizens.

Sorry but what don't I understand. If states can't restrict 2A was the previous ban on assault weapons with 2 military "components" illegal? NYC also has very strict 2A limits!
 
Just because NYC has these limits does not mean that such limits are Constitutional.

Second Amendment case law is in its infancy.
 
So glad I sent out those 200 emails and letters and made those 125 calls to local politicians. Really feel like I got a lot done!

They would have saved me a lot of time and anguish if they just would have come out and said, "it doesn't matter what your opinion will be, we are going to do what we feel like doing regardless".

Can you claim a law is ex post facto if it provides time for potential violators to transfer their firearms/mags out of state or to an FFL? The way I'm reading this, it immediately bans the sale of those items and gives everyone a year to a) register their firearms if they are assault weapons, and b) sell out of state any firearms/mags that cannot be made to comply with the ban.
 
Don't forget were are they going to find the money's for all of this garbage. Ill bet they will increase the license fee to 350 yr just like nyc
 
So because some nutjob in CT go's crazy and uses an illegal gun in a mass shooting in CT, Now us law abiding citizens in NY have to pay for his crimes via sticker gun laws and bans. This is just total BS!! This is nothing but liberals using a tragedy to further there political agenda. Count me in...
 
Haven't read the new law yet but if 7 round mags are the max, are such mags even available or any chance manufactures will make them? IF NOT, then this essentially makes all guns that use mags useless or am I missing something??? Even if a court over turns the retroactive nature of the law, I assume it will still stop new sales?? As others have said, the only winners here are the criminals who don't care about the law!!!

Sure wish I had an option to move of this corrupt cesspool of a state!!!

First coined by Nancy Pelosi when referring to Obamacare. Now NYS. This seems to be the new way of doing business in government. Meet behind closed doors. No public comment period. State constitutional provisions bypassed. Palms greased, pockets lined. A failure to achieve any results and no repurcussions for failure. Welcome to Russia. They apparently won the cold war.

JDT, correct me if I'm wrong. I believe the ninth district federal court dismissed a challenge to NYS whereby residents were not allowed a carry permit in Westchester County (summary judgment granted). But the the fourth distrit court ruled the complete opposite in maryland? Is this correct? If so is the SCOTUS the next stop for these issues? It needs to be heard before Obama gets another nominee. My concern is that he'll nominate Caitlyn Halligan.
