A perpetrator assumes the risk of loss, injury, or death resulting from or arising out of a course of criminal conduct involving a crime, as defined in this chapter, engaged in by the perpetrator or a person who aids or abets the perpetrator, as defined in § 22-3-3, and the crime victim is immune from and not liable for any damages as a result of acts or omissions of the victim if the victim used reasonable force. However, the perpetrator's assumption of risk does not eliminate the crime victim's duty to protect against conditions upon the premises which the crime victim knows or has reason to know may create an unreasonable risk of harm or which may cause a foreseeable trespass by minors, nor does the assumption of risk apply to perpetrators who are mentally incompetent.

Buddy explained it best above. Insurance is for accidents and acts of nature. I would consider anyone who collects premiums for some sort of specific type CCW policy or rider suspect. I bet they could not be relied on to pay up if it comes down to that.

Curious to know the background and payout history of that CHL protection plan outfit. Cheesy web page, Paypal, looks like a scam to me.

And like FN1910 said, better read the fine print.

I thought the same thing when I saw it, but it was the only CCW insurance site (if you want to call it that) I could find. So I posted the link. However in reality it will come down to you and your lawyer.

Could not find the Introduction Form. I recently received my CW license and currently shopping for carry weapon. I am looking at three weapons in particular: Cal-Tec AT?, Rugur LCP and a Taurus. Does anyone have any suggestions. Also, what is the best way to FIND an attorney who specializes in weapon carry?

I don't have insurance per se, I would question the validity of the coverage and extent.



The best insurance is between your ears and at the tip of your trigger finger.
Personal liability is just one reason why the decision to carry is a serious consideration for each of us.

I carry a Taurus P140 as primary and have a KEl-tec 380 as BUG with a Ruger Millennium 9 as my alternate carry.:biggrin:

I notice the original poster is located in Plano, Tx. Keep in mind Texas Castle Law. If it should be determined you were justifiable by a grand jury, Castle provides immunity from the bad guys or their families civil lawsuits. Having a relationship with a good attorney is also good advice.
 
Every time that I've looked into the cost of a $1M dollar umbrella policy the cost of the policy was affordable. However, in order to write such a policy I was told that I would have to increase the amount of insurance coverage on my autos and my motorcycle as well.

I don't work to support the government and the insurance companies! They're getting enough of my hard earned money. So I don't look for ways to give them more! :mad:

This topic has come up before. Yes, if you use your weapon in self defense, there is a chance that you will have to go to court. Insurance is a good idea. Even if you don't opt for insurance, find a good gun-friendly lawyer and make his acquaintance. Find out if they will represent you if needed. Once you have located such a lawyer, put them on speed dial so their number is easy to find.

The lawyer you would need in a self defense case probably will not be the family lawyer. I've found several in TN who participate in gun owner forums.

Great idea but, how do you find a gun friendly attorney it's not like they advertise it.

If your state requires any kind of training as a prerequisite to getting a carry permit, most instructors will be able to recommend a suitable attorney.

My pre-license instructor also teaches a course on how to best protect yoursellf from both criminal and civil actions if involved in a lethal force incident. Much of his course is actually taught by a local attorney, who is regarded as a specialist in lethal force cases.

What if you didn't break any laws, but the police still arrest you and charge you? What then? Is there no insurance you can take out that will help with attorney fees?
 
There is an organization that is dedicated to Concealed Carry. Membership gets you the usual freebies like magazines and stickers, training videos you can purchase. Another benefit is insurance to pay attorney fees to defend yourself when charged with a crime involving self defense. Here is a link to their website. Something else you can do is do an internet search foe CC insurance. My nephew shot an killed someone in his front yard. Here in OK the make my day law extends to your property line and not just inside your home. Anyway, for some reason he was charged with 1st degree. The DA was coming up for reelection and claims he will prosecute all murder cases. His trial took forever to actually happen. Because it was so expensive to defend himself, my family especially my sister and brother in law cashed out all of their retirement accounts and took mortgages on their property just to pay the lawyer. Final attorney bill was $200K. He was finally acquitted of all charges. Had he taken out insurance the financial strain on the family may not have been so steep. As I just got my CCL (Finally) I have the insurance provided by this organization and my wife and I are looking into more. I am an appellate lawyer and really don't have much of a stick in this fight. When a case comes to me, that race was run.

The problem I see with the clause is that it requires the charges to be dropped or for you to get an acquittal. When a prosecutor doubts their case, they often come with a plea offer that many people can't refuse. What do you do if you are charged with first degree murder and the prosecutor comes with a reckless discharge of a firearm and a $500 fine. Prosecutors will give such pleas but not dismissal because it protects the police departments from Section 1983 liability. That was why the West Memphis 3 when they were exonerated still had to take some sort of a plea. The prosecutor knew they were innocent but was trading escaping civil liability for the department for their freedom.

Consider this guy who spent 42 years in a prison for a crime he didn't commit and whom 60 Minutes has three times don't stories on the bungled investigation, crackpot fire expert, and bad interrogation:

He took the plea to get out the door.

Some of you will "stand your ground," but let me tell you it isn't as easy to say no when you are unsure of the future, dumped thousands into your defense, you have restrictive bond conditions, and your significant other "just wants closure." As an appellate attorney, let me tell you that juries are fickle, prosecutors may come with bargain basement pleas but very few just give up and throw in the towel. Bond pending appeal in my state is a paper tiger, the black letter law (People v Giacalone) is pretty good, but the practical implementation sucks.

If you yield and plea, a motion to withdraw the plea filed the next day is likely to be denied. While we have cases from as recently as 2002 which say such motions should be granted with some liberality, I do ten or more appeals a year where they are denied despite timely motions.

Stated another way, the charges dismissed or acquitted exception is larger than it looks on paper.
