Wa state CWP/CPL denied!!! , told to surender guns!

Shall issue State. They will tell you why they can't. Then you can go from there. When it wa a May issue State they denied me. But now they fixed it and no problems
 
You mean you had to wait until they changed it to a shall issue state to get a CPL or did you just have to fix the issue when it was a may issue state? I'm thinking if there's a problem with the local background check that I should be able to give the paperwork directly to the Edmonds PD in order to clear it up, can anyone confirm that? I just find it much easier to talk directly to someone instead of mailing things back and forth.
 
When it was a may issue. The issued me a cpl. Then decided not to and revoked it and when I asked them I had to come in. I didn't. That was 10 yrs ago. I applied last month and they said they had to give it to me because there was no reason not to.Fill out the form truthfully and they will take care of it. If you have DV on your record and got it taken off let them know show them the paper. I had to wait 60 days for them to be 200% okay with it. Just don't lie. You will be fine
 
Good advice and I'm glad you finally got your License. I was reading about NCIC on the FBI website and they say "Once the NICS establishes that the requisite domestic relationship is present, which is typically made by reference to the police report..." So it looks like I can just provide the police report to show that the requisite domestic relationship is not present and all should be well. I hope this process can help someone else in a similar situation in the future although I'm not sure how common it is to plead guilty to the wrong charge.
 
Assault is never a good idea. Neither is denying rights that are supposedly gauranteed. We learn to control our temper and learn also to join in the fight against tyranny. Two lessons learned?
 
Absolutely. It's better to learn as a kid where no one is hurt than later in life when things can get more serious. I don't think it's right to lock up a kid for a schoolyard type argument but that's how the system works. It did, however, open my eyes to the importance of civil rights and the need to protect them.

I started the fight for my right to bear arms some time ago but have just recently decided to pursue gun ownership after thinking about this responsibility for a long time.
 
May Issue???? Ironmike86, what are you talking about? I've only had my Washington CPL for 36 years, but Dad predates me by quite a few years. As far as I know, Washington has always been a Shall Issue state. In fact, back in Dad's day, the law was printed on the back of the carry license.

I suppose Dave Workman would be the man to ask for Washington gun law history. But I think I'm right.

Yeah I believe your right. But that's probably why the Sheriff said the person who issued my Cpl then revoked it. Really didn't have any grounds to.

Edmonds PD only does new CPL applications by appointment on Wednesdays so I have to wait until Nov. 9 just to get started. I'm pretty sure they are supposed to accept them during business hours but maybe they do the background check right then and there? Is there any way to run an NCIC check ahead of time so I can get the paperwork together to contest it if I have to? I already have a non-official copy of the order to restore firearms rights in WA.
 
Nope. Just go for it. Then you will know what to do if there is a glitch. They can do it it a day if they want to. Some ppl get one in 2-3 days. It takes longer when they are not sure.

No.. there's no way to do the NCIC III ahead of time.. though it takes about 4 seconds total.. there's really no reason to have the info ahead of time.


Each agency is different when it comes to CPL issuance and the times involved. While the law SAYS we have 30 days.. (60 days in some cases) a dirty little secret of the CPL world is that we CAN turn out a CPL in about 10 minutes.

*SOME* agencies will take your application and put it on the pile of applications (think: The warehouse at the end of Raiders of the Lost Ark) and they work on them and turn them out as time allows..


whereas *SOME* agencies will have you wait and will have it completed in 20 or so and you're out the door.

I get through MY pile of applications at about the week and a half rate on average.. depending on things that pop up during a background.

You hear people all the time with the 'MINE took 30 days' thing..

Things can pop up from one's past that require detailed investigation to determine the outcomes. Keep in mind that most agencies don't keep general records for more than 6 years or so, so we have to dig through the court system to determine the outcome of an arrest.

A common example: During the CPL background, we find that someone was arrested 25 years ago for a prohibitive crime. We need to determine if there was a conviction based on this arrest. The arresting agency had long destroyed the paper record and the NCIC III says something like 'Disposition Not Received' .. meaning it's a loose end.. and we don't like loose ends..

So, we need to query the court system for the disposition of the charges.. often times requiring court staff to do a hand search for the info (again..think the warehouse in the movie)

This adds a LOT of turnaround time to what would normally be a quick CPL issuance.


Don't even get me started on out-of-state or federal or military snags.. THAT can add weeks whilst trying to communicate back and forth.. sometimes 30 days is hardly enough time..


bottom line is that if you have your documents in order, you should be ok. Be sure that you have your court orders signed by the judge or they're just useless paper..
 
I suppose I average about 50 in a week. That'll spike in the summer, Christmas, after any worldwide natural disaster and presidential election (regardless of the party in office)

I had some copies emailed to me from the attorney that took over for the attorney I hired to vacate my case so it's not an original certified copy, just a copy of a certified copy.

This is the second page of the order to vacate/seal and restore firearms rights, would this be acceptable?

Applied for my CPL today in Edmonds. Even though you have to make an appointment all they do is have you fill out a little paperwork and take your fingerprints electronically. She said it usually takes a week or two. I showed her my court order restoring my firearms rights but she said she didn't need it as long as it's been sealed so we'll see.

It's official, I am now one big step closer to being able to conceal carry. Never mind that I don't own a gun and haven't taken a safety class, those are just minor details after all I've been through to get this CPL. It only took two weeks just like she said so there must not have been any issues with the NCIC check. For those just reading this the CPL application wasn't the problem, it was dealing with misinformation about federal firearms laws from both my attorney and the internet. Knowing how attorneys are I'm sure it was an honest oversight because he did a great job otherwise.
