Yes, the magazine can be in the gun or outside of the gun. There can even (shudder) be a round in the chamber! Or, you can have one magazine inside the gun, and a spare magazine outside the gun.
You do have to have a permit (CCW type) recognized by GA, however, unless you are GA state or US military or other exempted type person. GA is the only state that I know of that exempts a military member from their license requirement, even when carrying in a personal (not military) capacity.
Hey, are you sure you have to have a GFL to open carry? I thought GA was an open carry state.

Yes, a license is required to open carry. Without a license it must be enclosed in a case and unloaded.

Wow... I open carry about 70% of the time (not supposed to carry at all
at work) because there are a few places that are just too crowd for ME to be
comfortable with my gun exposed. I have NEVER had anyone call the cops
on me nor have I had an officer "freak-out" because they saw that I was
carrying. I DO carry a pocket full of GeorgiaCarry.org cards to attempt to educate
the ones that take exception of seeing my gun.
Last night several of us went to dinner at the Golden Trough (Corral to most
folks) and we were all open carrying. All I got was one person asking if I was
a police officer and several asking about obtaining their GWL.
Having said that.. if you read the posts over at GeorgiaPacking.org , not
EVERY encounter goes perfectly, but more and more... it is becoming less
and less of an issue.
So according to this "(a) Any person who is not prohibited by law from possessing a handgun or long gun may have or carry on his or her person a weapon or long gun on his or her property or inside his or her home, motor vehicle, or place of business without a valid weapons carry license." you can have a gun in your car with it loaded without a GFL and you are safe? Does it have to be visible or in the glove box? Seems like you could have it on you in the car without a GFL but when you leave your car you have to take the gun off (without a GFL)?
This is why I went ahead and got my permit, the laws are just confusing and there are too many of them, I also wish the GFL lasted 10 years...
Heheh... a bit on the confusing side true.. yes - w/o a GWL you can in
in fact have your gun (even loaded) in your car, IF as stated above you are
not prohibited from having a gun at all (think convicted felon). You can also
have it w/o a license in your home and your place of business (assuming that
the business owner doesn't have an issue with it).
It used to be worse, more confusing, more places that your couldn't carry..
THIS is why I am a member of GeorgiaCarry.Org (GCO). Their successful
efforts to get SB308 passed last year went a long way to making the mazes
of laws and clauses easier to understand. I support their continued efforts
to work with the Legislature to preserve and extend our 2A rights in Georgia.
As much as we say the second amendment is a basic right and cannot be
infringed upon... we have seen it over and over in too many states to ignore.
There will always be someone to try and infringe on our rights, in the futile
belief that the next law is the one that criminals will respect. :fie:
I am anxiously awaiting the Legislative session to get fully underway this
year to see what we can accomplish and know that my voice is carried to
the General Assembly, not only by me, but by an organization with a proven
record of accomplishment and the support of thousands to my fellows here
in Georgia.
