HB 4027, storing firearms/ammo in vehicles in parking lots….

HB 4027 was introduced in the MI House in 2013 and sent to the House Judiciary Committee - where it stalled in spite of the fact that there are SEVEN repubs against only THREE dems. There is no excuse for them not to approve this bill and get it to the floor for a vote.

HB 4027 would facilitate the right of individuals to store firearms and ammo in their vehicles in the parking lots of businesses. It includes an indemnification for employers in Section 16 (3),

"EXCEPT IN CASES OF GROSS NEGLIGENCE, A BUSINESS, COMMERCIAL ENTERPRISE, EMPLOYER, OR STATE SERVICE AGENCY IS NOT LIABLE IN A CIVIL ACTION FOR DAMAGES RESULTING FROM OR ARISING OUT OF ANOTHER PERSON'S ACT INVOLVING A FIREARM OR AMMUNITION THAT IS TRANSPORTED OR STORED AS DESCRIBED IN SUBSECTION (1)."​

First, we need to revive this bill and get it out of committee to the floor of the MI House for a vote. With SEVEN Republicans versus only three Democrats on this committee, one would think this should be an easy task, but as I have been told by legislators, Republicans are "hesitant to burden businesses" with such regulations.


In addition to getting this measure out of committee, legislators need to consider the addition of the following wording to this subsection:

"... OR CARRIED ON ONE’S PERSON IN A CONCEALED OR OPEN FASHION IN ACCORDANCE WITH MCL 750.227, 750.227A, 750.234D, or 780.972 WHILE ON THE PREMISES OF A BUSINESS, COMMERCIAL ENTERPRISE, EMPLOYER, OR STATE SERVICE AGENCY."​

The first three citations deal with lawful carry of a firearm, and the last citation is Michigan's SYG law. If this wording was added, it would indemnify business owners from responsibility if an employee/customer found himself in a situation in which he had to use his firearm to defend himself. The CEO of the company for which I work said he would allow employees to carry in a heartbeat if this indemnification were to be passed as part of HB 4027, and I am sure there are other businesses that would also be on board with employees carrying if they were indemnified.

We need to get this bill out of committee and onto the floor for a vote. Here is the contact information for the members of the MI House Judicial Committee:
