WV Constitutional Carry Effective May 26 2016

HB4145 - the 'Constitutional Carry Bill' - was VEOTED by Governor Earl Ray Tomblin on March 3 2016.

On March 4 2016 the WV House of Delegates voted 64 - 33 to OVERRIDE that veto.
On March 5 2016 at 10:08 AM the WV Senate voted 23 - 11 to OVERRIDE that veto.

HB4145 will become effective on June 5, 2016.

Governor Tomblin issued the following statement on Saturday after the announcement of the override:

“West Virginia’s law enforcement officers have dedicated their lives to keeping us safe and helping us in times of need, and it’s disheartening that the members of the Legislature have chosen not to stand with these brave men and women – putting their safety and the safety of West Virginians at risk. It’s unfortunate that the concerns of officers from every law enforcement branch in the state, including the West Virginia State Police and university campus police officers, have been ignored by today’s action."

Poor Gov. Tomblin. He just doesn't get it. According to those around him, law enforcement already DISARMS 'prohibited persons' on a daily basis. From the LE perspective, nothing changes. It is up to the PROSECUTORS to bring charges and actually get the offender before a Judge. HB4145 gives JUDGES tools to ensure meaningful prison time by ENHANCING (lengthening) sentencing guidelines for crimes committed by prohibited persons while armed - in fact the "enhancement" DOUBLES for drug crimes committed by prohibited persons while armed. That's going to keep the 'bad guys' off the streets - and away from the men, women, children and Law Enforcement Officers of West Virginia for a LONGER period of time.

In short, Governor, our Legislators DID support not only the people of West Virginia but also our brave Law Enforcement Officers. Too bad you could not do the same.
