Would this be considered concealed?

I know it cannot be "seen" but would using a Sneaky Pete holster be considered OC or CC? I guess I'm most concerned how the state of Massachusetts would deem it. And before anybody berates me, I don't like the idea of using one. I was just curious about it from a legal stand point.

Yes it is concealed. I use one all the time during my job as a surveyor. I don't want to alarm any of my anti clients by carrying open and most of them think it is just another case for an electronic gadget. Why would anybody berate you for using a sneaky pete. It may not look like a quick draw macgraw holster...but then that is the beauty of it. I don't need to look like a cowboy to be one!
 
The Fanny-Pack of Holsters

As the firearm is fully concealed from view, it would be considered a concealed firearm.
Almost anyone who has ever shopped for holsters or read a gun magazine would recognize it,
others would likely think it's a case for a PDA type phone.
IMHO, it's the Fanny-Pack of the Holster Market. I'll stay with my IWB from Old Faithful Holsters.
 
Out of sight, out of mind. Yes, inside the case is concealed the same as a gun in an externally work fanny/belly pack is concealed.

What does your state consider a concealed handgun?

I live in Arkansas and AR's CHCL regulations state "......must be concealed from casual view."

Your state's law may be different.

The New York Police Chief told a CC holder there that he would be arrested because everyone knows what's inside it. I wish I could remember the link to post here, but I don't.

Does this really surprise anyone?

There was a thread here about the SP holsters, if you search.

My concern was sidearms sometimes have to be carried with the muzzle facing forward or backward in those holsters, sweeping everyone front and rear.

I just got off the phone with a local police chief (in the Commonwealth of MA there is no law against OC), who told me that this "holster" is okay by him. The long and short of it is that each town's CoP sets policy. An anti-gun CoP may have a different opinion. But the long and short of it is that "if it doesn't show, then nobody knows."
 
Yes, It'd be concealed. Don't forget Open Carry IS Legal in MA, you just don't see it a lot outside of Western MA. To me those holsters attract more attention than OC'ing. Where in MA are you?

I am in Westfield, just west of Springfield (exit 3 off the Pike). I've heard differing opinions on whether OC is legal here and some of the possible ramifications if you do OC. Can you post a link to where it says it is legal?

Open carry means people look at your hip and see a GUN, not a case that could be holding anything.

It's in a holster and carried on the outside. So I was wondering if the flap over the top made a difference legally as to whether you were OC or CC-ing.

The Staties have confirmed multiple times that it's legal but you won't find a law stating that, which is the problem with OC'ingin MA. The reason it's legal is because there is no law forbiding it, and the LTC's don't specify that a gun must be concealed. The problem is some CLEOs claim because there is no specific law ALLOWING it that it's illegal, The Staties and the FRB have confirmed the other way around but when your in cuffs because you OC'd in Boston, that doesn't help. I blame GOAL for this, they have no problem taking money from people year after year but can't get 1 simple sentance added to "allow" what's already legal. I've seen people OC a handful of times, if your dressed business casual 95% of people assume your LE and could care less, but that can go both way and sometimes not worth the hassle. As far as ramifications, YOUR Chief is the one that must suspend your LTC if it came to that, so in a way it only matters what he thinks but for many even that's not worth the hassle. Being West of Spfld, your PROBABLY ok, but like everything depends on your chief.
