Worst-Ever Homeschool Law Proposed in Ohio

With the introduction of Senate Bill 248 on December 3, 2013, by Senator Capri Cafaro, Ohio has suddenly become a frontline in the battle over homeschooling freedom.

SB 248 is breathtakingly onerous in its scope. It requires all parents who homeschool to undergo a social services investigation which would ultimately determine if homeschooling would be permitted. Social workers would have to interview parents and children separately, conduct background checks and determine whether homeschooling is recommended or not. If it is not recommended, parents would have to submit to an “intervention” before further consideration of their request to homeschool.

SB 248 was offered by sponsors as a way to respond to the death of 14-year-old Teddy Foltz-Tedesco in January 2013. News reports indicate that Teddy had been abused for years by his mother’s boyfriend, Zaryl Bush. After teachers reported abuse to authorities, Teddy’s mother withdrew him from public school, allegedly to homeschool him. Reports tell a sad story of a broken home where neighbors, friends, family, police, teachers and others knew Teddy was suffering ongoing abuse. Finally, Bush beat Teddy so severely that he later died of his injuries. Both Bush and Teddy’s mother are now in prison. A news report can be found online.

Even if, as SB 248 would require, his mother had sought social service’s approval to homeschool and was denied, he still would have been at home subject to abuse after school. Regardless of where he went to school, Teddy was left by authorities in a home where they knew abuse was occurring.

Clearly, SB 248 would not have saved Teddy.

SB 248 turns fundamental American values upside down. Parents have been deemed by the United States Supreme Court in Parham v. JR to act in their children’s best interests. In Pierce v. Society of Sisters, the Court ruled that parents have a fundamental right to direct the education of their children. This law replaces parents with unqualified social workers to make educational decisions for children.

What happened to Teddy Foltz-Tedesco is a tragedy that could have been prevented. If those responsible for investigating child abuse had done their job, Teddy might have been saved. The system needs reform, but Senate Bill 248 will increase the load on social workers by requiring them to investigate all families who want to homeschool rather than focusing resources on parents actually suspected of child abuse.

Our schools are already overly legislated and regulated into the ground when it comes to protecting our children. They are now looking at ways of legislating parents that homeschool their children out of sense of doing the right thing for their children.

I can see an underlying motive of using this kind of legislation to keep children in school for the money they get than to allow them to be homeschooled which would reduce their revenue stream.

No matter the reasoning another legislative intervention into the lives of law abiding citizens needs to be stopped. I ask that those of you from OHIO contact your representatives and let them know how you feel about SB 248 being dubbed Teddy's Law

It is the same as when I heard Phil Robinson was suspended bt A&E.

The rest of the family had better wake up and walk away from A&E, it's time for us the real Majority of Americans to stand up for our belief and stop being forced to accept this garbage from the unbelievers. Separation of Church and State is about freedom of Religion not what the Communist have changed into freedom from Religion. We have the Local, State and Federal Government establishing Gay Rights, Civil Rights, and doing their best to destroy Christian Rights. We already have a Declaration of Independence that covers it all, "We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness". Our American Freedoms are being destroyed every day, now the Government has decided if they don't like your Freedom of speech they can now call it Hate speech. Whatever isn't covered by hate speech can be covered by "Political Correctness" I wonder how long it is going to take them to outlaw the Old Testament? DEUTERONOMY Chapter 22 - 5 The woman shall not wear that which pertaineth unto a man, neither shall a man put on a woman's garment: for all that do so are a abomination unto the Lord thy God.

Maybe we need to start shutting the public schools down in Ohio so we can run a thorough background screening on every possible dirt ball that has interactions with the school kids. The public school system is the true breeding ground for child abuse, both socially and sexually.
 
As a homeschooling grandparent, this law would really make me angry, and that would probably result in an "intervention." The school system is sinking fast and taking the kids with it. Our local school board has even suggested that we need a casino, thanks again Cuomo, in our town to pay more school taxes so they can build bigger schools. For a district that has less than 1500 kids in all grades from K to 12.

From a different POV:

I know several people that either are currently or have in the past homeschooled their children and from personal experience about a 3rd of the "homeschool" kids are homeschooled because their parent(s) are to lazy to take their kid(s) to school.

There are a couple of the "Homeschool" private schools that specialize in the lazy parents and from $100/mo they will provide the required paperwork so you kid doesn't have to learn to read, write, basic math, etc.

Sad but true.

You just cannot help yourself. At every turn in the road you just need to see how big of a jackass you can be. We homeschooled our daughter for 12 years and know many of her homeschooled friends. We also know some of her public schooled friends as well. There is a difference for sure. The public school kids are druggies, runaways, knocked up, suicidal...probably a lot like your own kids that had to grow up under your thumb.

Our daughter is very bright, outgoing, intelligent, no drugs, nor any of the other negative personality disorders your kids exhibit. One of her pals was actually auditing pre med studies at 17 years old. Have your kids been potty trained yet or do they still crap in their pants...just asking...don't get all wound up.

Oh...I am sorry. I just noticed you claim to be from Arkansas. When a couple gets divorced in Arkansas are they still father and daughter. Just asking...inquiring minds want to know.

Social workers dont do their jobs anyways. I can guarantee if this passes, little to nothing will actually change when it comes to home schooling anyways. Ive called Social Workers regarding the safety of children at homes in communities I do Security for and first hand see the neglect and abuse by some of the parents. Social Workers allegedly visit the homes [often times drugs to include Marijuana and Cocaine are visible and tested by Police who do not make an arrest] and I get a letter saying there is insufficient evidence to support neglect or abuse taking place. So whats going to make a social worker actually do their jobs and deem a home unfit for home school especially when there will be some sort of box to check to say a home is unfit?
Either way, another pointless bill to give society an artificial security blanket and make politicians appear like they actually care even though they prove day after day in Washington they dont. I say let them do their magic trick and move on with your lives. Politicians and Big Brother will continue to miss the mark and do absolutely nothing to protect any of us.

Can't agree with you. If they aren't going to do something with the law DON'T INSTITUTE IT and leave everyone alone. Government intervention is at it's worst and needs to be scaled back not increased. Less is more, more freedom for the citizens to thrive in today's society, more freedom for family values to effectually correct discipline within the home, freedom to live our lives without fear of Big Brother interference just because he can. Any intervention by government needs to be resisted at every turn and every crack exploited to destroy the country they are trying to build today.

"Social workers don't do their job anyways" and this seems OK and because of this a boy 14 years old has lost his life. I find that intolerable and despicable, someone needs to have their head handed to them (since I am sadistic anyway, I am meaning this in it's literal meaning). But it won't happen and life will be pretty much normal for those social workers involved.

UNTIL they get the current system under control they need not look at anyone else to blame for their own short comings.

Giving up and letting government run my everyday life is not in my DNA and I will resist any way I can and with all that is available to me. Letting them have their way is not the way to freedom my friend.
 
Looks like child social services is looking to increase its fiefdom. As if they don't, in general screw up enough families as it is.

More government camel poking its nose under the tent.

Hope that bill dies a slow, painful death in committee.

When I posted this thread I sent e-mails to all the legislators involved, asking that they reconsider their thinking and look harder at the incidents that were the precursor to the final act.
