She told him she heard a noise and sent him to investigate. Then she shot him 6 times mistaking him for an intruder.
The district attorney has determine that it was an accident.
But I'm bothered by the part of the story that suggest it was a mistake because "she didn't lawyer up."
A person shouldn't be thought of as anything other than innocent simply because they retain a lawyer to protect their rights. Way too many innocent people have been convicted and then subsequently proven innocent to trust the prosecutor to treat one fairly. And most competent prosecutors know that the "I've got nothing to hide" guy is more than likely the one with something to hide.
