Why another delay?

I have yet to get a green light when buying a gun. Four times in a row I received a five day delay.
Is it just my luck or is there some connection to the gun shop I do business with?

Were you eventually able to purchase the gun each time? If so there is something in your information that causes them to have to conduct further research before you are approved. There are some options. You can be sure the FFL enters or gives all your data to NICS. That included optional data such as SS#, middle name etc. There is someone out there with data close to yours that has a problem with making a purchase and you pay the price.

I'm able to complete my purchase every time. I have a clean background.
My father and I share the same name, he being Sr. and I Jr. ...... my father is deceased maybe thats the trigger that holds me up?
I included my SS# on the last two buy's and still got a delay for five days.

Many tilme people get arrested on warrents because someone has the same name and dob. Usually they are released shortly after determing the mistake. If your name is Smith, Jones, Brown, or one of the many other popular names or if you have a surname like Mohomad you are more likely going to have to endure a longer wait while checks are made and its determined your one of the Good Guys.

Actually the delay is for three business days. If the FFL has not heard anything further from NICS, the sale can go ahead. In your case there might have been a couple of weekend days, which are not business days, or the FFL told a fib.

I ran into that. I've had delays from 5 min to a couple days. After I thought about it it was clear. I'm ex-Army, and had a job with a security clearance. 1st they just check for any record, then they have to hit a few more buttons on the key board to see if it's a good or bad record. Depending on who picks up the phone it could take them from a second to days to push a button. Now I just show my CCW, and that takes the place of the call.

I'm a Washington State resident and have the CCL .....
I'm thinking I will try another gun shop on my next purchase and see if I get delayed.

Each time your info is submitted to NICS, they have to start checking on you from scratch. If there is an issue, you'll get delayed each time.

Have you considered a VAF? Visit the FBI NICS web site and look for the Voluntary Appeals File application.

You can submit this application and give NICS permission to keep your info on file. If you qualify for a "Proceed", you'll get a UPIN (Unique Personal Identification Number) to put in box 9 of your 4473 form. It takes a few months to process the application and get the number.

The next time you get run through NICS, they only have to check you out as far back as the date your VAF was established. If you haven't done any bad things since then, you should start getting a "Proceed"

Hello from a fellow Washington resident. If you are purchasing online, not much I can offer as advice, but if you don't mind waiting I'd suggest buying from the private sector and not having to deal with the waiting periods, background checks, or registration with the gun shop (though I'm not sure that last one is just for Oregon or also in WA.)

GIFF, As frustrating as it is for you, it is usually that frustrating for the FFL. As stated previously it could be any number of things, not always bad things, that cause delays. I had 5 people in a row get delayed status, I started thinking it was me(or my shop) that was to blame. In WI, we(the state) run our own backround checks for handguns, we use the NICS system for long guns. I called to make sure it was not me as I was worried I was making mistakes, they said it was not me. I have never had a delay through the NICS system for a long gun purchase. I would make sure your FFL knows you are a Jr, as this could be the reason with your father being deceased,as they do not ask if you are a Jr/Sr/III on the 4473. Changing gun shops will not generally fix the problem. If you like the place you do business with, keep going there, but you might want to remind them to tell the NICS employee that you are a Jr and see if that helps. I hope you can figure out what the hangup is in your NICS profile!

+1 for the VAF. Seems like not many people have heard about it. Mywfesaidyes, explained it well. When NICS was established there was a law established dictating that they are not allowed to keep any personal information submitted through the system for more than 24 hours. Henceforth, every time a NICS check initiated on you, they are starting from scratch. If there is someone with a similar name or SSN as you that has prohibiting criminal history they look into further causing the delay. Unless your father had an extensive criminal history I don't see him being deceased as the cause of your problem because the DOB differential and death certificate would show up fairly quickly in the investigation. Regardless, signing up for VAF should solve your problem as it authorizes them to keep your information on file for as long as you chose to be in the program. My best friend is a Jones and had the same problem which the VAF solved for him. While waiting for my girlfriend to be fingerprinted for her CHL at the Sheriff's Office I was perusing through the jail roster that was sitting on the table and saw the source of his problem. There were at least 20 Jones's currently in the county jail.

Best of luck to you mate.

Hmmmmm I rolled into the gun shop made my selection and filled out the form, after a phone call I was rolling out of there with gun and ammo. Here in Indiana anyway......

No offense, but how does that help the original poster with his issue of constantly being delayed? I would guess most of the gun buyers here do not have any issues.

I feel your pain, I get delayed almost every purchase, usually only an hour or two though, then I get to watch people after me get approved in 5 minutes. Here in VA they don't use NICS, the State Police have their own internal approval system. People have been trying to dissolve it and go to NICS since it's supposed to be quicker but they just dumped a ton of money into it to keep it going.

I went to pick up the NICS packet from my local gun shop today and they were out. I'm going to make some calls tomorrow and see who has the paperwork so I can get the process underway. I was surprised to see there is no option for filing over the net, snail mail is the only way.

You will need to send in a hard copy set of fingerprints. That's why there is no online option.

The actual brochure and application is here:

You can also find the fingerprint card on the FBI site and print it out if you need it. You will need to have your fingerprints taken at a police station or sheriff's office. They have to fill out some of the info on the card.

Some LEA's will do your prints, some won't. Some will provide the card, some won't. Some will charge you a fee, some won't.

If you are interested in seeing your actual FBI rap sheet (criminal record as the FBI sees it), get a second fingerprint card done. It cost's $18 to order a copy of your rap sheet. That application is also on the FBI site.
