GunBroker.com?

I live in the Western half of South Dakota and because of the local Air Force Base there are many Pawn shops and used gun dealers. So the local market is fairly saturated with used pistols.

I have 2 pistols I would like to sell, legally with-in the continental USA, at a fair used price (and, of course, at a premium if at the right place at the right time).

What is your experiance with Guns for Sale - Online Gun Auction - Buy Guns at GunBroker.com

what would you recommend I do or do not do?

I have considered NOT selling to CA,IL, and NY right off the bat and requiring a signed copy of the buyer's (dealer's) FFL.

I've used Gunbroker to buy accessories numerous times and have never had a problem. I prefer not to buy guns unless I have a chance physically inspect them beforehand, therefore I won't use them to buy a firearm unless it's a nearby seller and I can see the weapon for myself.
 
I have only used GunBroker for purchase. Need to be patient. Some lists are ridiculously cluttered with repetitive overpriced asking prices. Patience got me a good price on a new firearm. For selling I would look at armslist.com. They can narrow down to geographic areas (local) that make selling easier and eliminates interstate stuff which can have some legal consequences and involves shipping, insurance etal. All contact is strictly email thru the site. I sold to someone who lives in Charleston, SC, where I live and I was able to meet him at a busy location, exchange firearm for cash and we both signed off on a homemade form attesting to our confirmed ID and legal ability to buy/sell in the state. We also added our CCWP #s for ID, although I would think that at least seeing each others picture ID (drivers license or CCWP) would be sufficient. First time for buy and sell this way and both worked out perfectly.

No. He will need the FFL's license number to verify the license via EZCheck, if he chooses to verify it at all. There is no requirement to verify the FFL by a private party. Many FFLs have stopped sending out signed copies of licenses a long time ago.

We have enough regulations and restrictions that are real and written in statutes, we don't need any more added to ourselves from within our own gun community.

I agree. Especially since the gun will be shipped to an FFL in those states anyway. Let the receiving FFL worry about their silly laws. It is next to impossible for the state of California, Illinois or New York to enforce their silly state laws outside their borders, especially when the seller/sender complied with all Federal laws and laws of their own state when they ship the gun to an FFL in one of those states. They would have to prove that the seller/sender knowing conspired with someone inside one of those states to violate that state's law and have the cooperation of the Federal government or the seller/sender's state government to extradict and prosecute.
 
I've only bought one gun via Gunbroker. I emailed the guy, made him a cash offer that was underneath the minimum bid, and told him to call me if nobody bought the gun. 2 days later he called and I drove an hour to see the weapon (I really wanted it) and bought it. No FFLs, no shipping, no "surprises".
 
I've used Gunbroker to buy and sell numerous times. I've only had one problem with a non-paying bidder and GB refunded my listing fee no problem.

I was just going to ask about armslist.com so I apprecite it being brought up already.

I now understand your points about the shipping restrictions I was thinking about. I was thinking that I could avoid some hassle by avoiding those states... But if they go through their ffl... I am reducing my liability.

I am greatful for a forum such as this to help us novices make informed decisions.

I've used Gunbroker numerous times for buying and selling firearms and accessories. I WILL use them again when the time comes. They are legal, safe, clean, reliable, and do not put up with nonsense from sellers or buyers. I've found some incredible deals on there, and also gotten twice and more than I had expected to get when selling. My advice, when selling, check out completed sales on similar arms to get an idea of the current selling price before you list. That way, you'll not be too surprised. It also helps to put a reasonable starting bid on it. With more unusual items, I've put a starting bid at my minimum acceptable price,with a Buy it Now quite a bit higher... crazy high, in one case, and had it sold quicky with Buy it Now. Whoopie!!

As to the legal end of it.... YOU are a private party, thus do not need to have an FFL to sell. HOWEVER, when selling interstate, OR other than face to face, you MUST ship the arm to an FFL in the SAME STATE as your guyer. HE will decide whom to use for this "transfer" service.. unconstitutional, yes, but until it is changed it is not worth the risks involved. It is a good idea to get a copy (faxed, mailed along with payment, PDF attached to an email) of the FFL to which you are sending it, in case some crazy guy thinks you are selling interstate against the law. That way YOU have proof it went to an FFL. Not required, but a cover your six sort of deal.

For ANYONE to ship any firearm into that state, it MUST go to an FFL, and the SHIPPER Must be on their Department of Justice list of "accepted and approved" sellers. No joke. SO, unless you are on the California DoJ list (you are almost certainly not), or you ship it through a local FFL who is (it will cost, but may be cheaper in the long run, later details), don't sell to California. Other states are fine... there it is up to the buyer to make arrangements on HIS end. He will know..... and make the needed arrangements.

Word of warning... you can NOT ship handguns via USPS. Illegal. An FFL can, though. In that case, Priority Flat Rate will get it anywhere for twelve bucks, Private parties can ONLY ship handguns interstate via UPS or FedEx... and THEIR OWN STUPID RULES mandate Overnight class... typically, eighty bucks or so. Thus, when buying, most astute buyers will not buy private party BECAUSE of this insane cost. However, if you have a local FFL who is willing to charge, say, twenty bucks to use HIS license outbound (it MUST be recorded in and out on his FFL sales book), add the twelve for Flat Rate, and you're out maybe $35 instead of eighty. Most pawnshops these days take the more valuable arms they end up with and sell them on Gunbroker anyway, maybe one of them will cooperate.

Long guns can be shipped USPS, however. Go figure. Sounds like a deal brokered by the Brady Brats. WHY UPS and FedEx insist on overnight, I do not know. Stupid....

Gunbroker can be used to great advantage, putting your wares before a nationwide audience. Just make certain your payment is secure in hand (as in, check cleared and IN your account) before you ship. Get the copy of the receiver's FFL, and ship ONLY to that address. Now yhou're covered. And beware of insane high costs to ship handguns. Or make arrangements with a local FFL (who MUST have receiver's FFL in hand before shipping interstate). Take the lowest price one and try it...
one more thing... grade honestly (I've always been surprised at how much BETTER my purchases have been than what I was expecting based on grading by seller), and take clear, sharp photos showing every side of the arm. Only as many as are needed.... good contrast, well lit.... most times it is the photo that sells the gun. And I've bought stuff with miserable photos for a song, because most others could not tell what was there.... and been shocked when it was far better than I had thought it would be. Or, in a different finish that what the photo appeared to show, worth twice what it appeared to be. (got lucky that time... oh boy.. a rare Brownign High Power in hard nickel chrome, when I thought it was only the matte nickel finish. And in as new condition, forty years old. Nice....

Almost entirely false information. The actual requirement in California Penal Code is:

Justice.


First, the requirement only applies to FFLs who are shipping guns into California. Second, the verification is that the RECIPIENT is verified with the CA DOJ, NOT the seller/shipper.

I'll say it again, we have enough problems with firearms restrictions that are actually in statutes. We don't need to be creating/perpetuating our own restrictions from within our own firearms community. But I am just nit picking, right Mr. Philip Gain? We have had enough of our rights taken away from us, one nit at a time.
 
Per my own local transfer dealer, HE (my local FFL) must get the verifidation number for the receiving dealer before he can ship anything to California. MY guy here needs to get verification before HE can ship the arm to the California FFL. That's what HE says.. it takes about fifteen minutes of phone work for him to contact the Calif FFL, get the paperwork done up, which he then must include along with the arm when he ships it. It is soch a hassle most FFLs on Gunbroker refuse to ship to California. and for some reason the quoted statute does not make clear, some FFL's cannot ship to California even if they try to get the authorisation number. Seems there is something about the shipping FFL needing to meet the approval of Calif DoJ. Besides, most Calif FFL's will not accept any shipments from private parties. Why? Dunnno, ask some. (a few FFL's in other states refuse to accept them too, don't know why, because it IS legal per 18 USC. Most Calif FFL's won't. That's why so many sellers on GunBroker just won't sell to California.
 
Shipping as private party

If I weren't going to use an FFL to ship I believe I would price the gun to account for the private party shipping cost. If you quote $80 or so for shipping the buyer will probably freak.

So far I am very disappointed with gun broker!
A lot of the item have undisclosed reserves. So if you bid, you are in the blind
on what you need to bid to get above the reserve. Bidding below is a waste of time and effort.
If I knew what the reserve was, I could out bid it or pass. The way it is now, the say min. bid is ?? and the current bid is ?? but the leave you wondering what it really takes to get a big in!
In addition, I have not been able to figure out how to tell them directly what I think of this policy!
