What 1st amendment--Police Detain and Draw Weapons on Student Activist

Gotta love the administrators who are obviously most concerned with the real safety of students as can be seen with comments like:

"You and I can debate that all day long and you have clear arguments," Gee said, addressing his remarks to Newbern. "But, I am in charge and we are not going to do it."
 
Everybody knows that an empty holster is more dangerous than any thug that wears a hoodie.

Well, Gee has the right to set policy. The university, while state sponsored, is not a public place. The university retains the right to set policy. If the students handbook contains any rule against this then he is in violation.
 
These Officers should themselves be prosecuted and have their standards revoked. They're a disgrace to the Badge.

But it is a place open to the public, and since when does violation of a school policy justify the government (police) abuse of Constitutional rights?
 
This is INSANE! The president of the University there seems to have it out for them. "vigilante" is a harsh word for protesting, with an EMPTY holster.....sounds like his wife needs to **** him, maybe then he wouldnt be such a **** jaws.......

Yeah, it's like stupidity and ignorance are favored over common sense, at least with the demoncratic socialists. I have to wonder if this logic is purposely initiated just to create confusion and tension among the populace.

It is not open to the public. Any person who is not a student can be booted out. Students must adhere to the published rules. Testing the limits of a gun policy by carrying an empty holster is baiting for a problem. The local mall is also open to the public but is not a public place.

Further there is no constiitutional right in America to carry a gun. This has been repeatedly decided by both the SCOTUS in Heller and McDonald and further by the U.S. ninth circuit court in September 2011. The second doesn't mean what WE interpret it to mean, it means what the high court interprets... same as any law.

Let him try to sue for violating hgis rights. The issue is DOA. It's already been to the SCOTUS.
 
Very disappointing. This student needs to switch schools and stop supporting that place.
And go where? What school will allow him to carry? Contrary to popular belief, his education is much more important in the grand scheme of life than his ability to carry on campus. I need more good lawyers and accountants, not a person with a CCW permit.

I think the only reason why you decided to debate with me over the idea of moving is that you live in New York by choice, where they have pretty restrictive gun laws, and you have trouble accepting it, or are just unwilling to move and have convinced yourself that moving is never the right option. That's your problem, just like its this kid's problem for attending such an anti-gun school. You guys both need to wake up and smell the fresh air and move if gun rights are important to you.

Here we go again with the NY gun laws. Did you read my tag line? I'm in the gun permit business.

People throughout this site write about problems in their "shall-issue" states. They're having problems carrying on public transportation, restuarants, etc. To me these are restrictive states. Here's some info for ya. Colorado has 5.1 million total residents. NYS has 1.2 million CCW permit holders. NY has no statutory requirement for training, testing or qualification for a CCW permit. Unrestricted permits are routine just 40 miles from NYC. Permits are valid for life. There are no laws restricting the carry of a concealed weapon in a bar, restuarant, mall, church, car, bank, hospital, doctors office, on and on. The only restriction in NY is for schools. We move about completely unmolested by restrictive laws. While not at the top of the pro-gun list, we're quite far from the bottom. Better than many "shall-issue" states. And we have the permit holders to provde it.

The NY many of us speak of is one of mountains, forests, beauty and privacy. Not pavement, glass and people. We're quite removed from that liberal city dwelling mass. NYC comprises 40% of the entire state population, rendering the upstate vote useless. But upstate NY is quite pro-gun. And you can't argue with the incomes here.

Rambling post? Well pardon my education. Produce any ruling by the SCOTUS that equates the right to bear-arms with the right to carry a gun. All the way back to Dred Scott. Won't find it. Unfortunately you're not grasping it. In case you haven't noticed, you don't actually have the right to carry a gun. Or to freedom of speech. Yours or my interpretation of the first, second or fourth mean absolutely nothing. Only the interpretation by those nine justices constitutes the weight of law. Christ almighty. Haven'tyou been paying attention to what the hell is happening in this country? Your rights are getting hammered every day. I'm not agreeing with it, I'm telling you the facts. I'm telling you how the courts are ruling. Your fight isn't with me for giving you the message. It's with those who trample your rights.

In the FREE States an empty holster is not a gun, so I have no idea why you're harping on the second amendment. And we absolutely do have a right to freedom of speech. Please cite us a relevant to this incident court precedent saying we don't.

And I'm still awaiting an answer to my original question.
 
That's why I'm grateful that my state does not statutorily prohibit campus carry and my school's rules define the "unauthorized use of firearms" as prohibited...not carry
