MESA, AZ (CBS5) - In Mesa, a man was inside a Walmart bathroom when a bullet struck just a few feet from the urinal where he was standing.

The big bullet traveled right through the metal door, ricocheted off the wall and took out a light fixture up above, then struck the floor only a few feet from where the victim was standing.

We had a simialer incident in Wentzville , mo recently where someone was shot during a church fund raiser. Somebody was getting ready to leave was putting his coat on, his pistol fell out of his coat pocket, hit the floor, went off shot someone in the chest. The gun owner has a ccw. No charges as he didn't break any laws.
Really? A daringer unholstered in your coat pocket ?

Interesting. Just read about a LEO/Instructor acting negligent at a shooting range and the result was someone being shot. That's called an accident.

Knothead with an antique revolver drops it in a Wally World resulting in a discharge with no injuries. This is called negligence and the Knothead can be charged with endangerment.

Just pointing out a double standard.

At least nobody was hurt or killed. Not so sure carrying an antique firearm is a good idea or not. They lack the modern internal safety components generally.

I believe everyone has a right to carry anywhere, but when you do something like this you should be charged with something. The excuse, it was an accident, IMHO is BS, it was carelessness. People that endanger others must take responsible for their stupidity.

Have I ever dropped my Glock? I had seen videos of it being abused but it will not discharge at all...what sort of gun did he have? It should belong to a wall display instead of on him. Silly! Hope he learned his lesson...

Yeah, some things are worth spending good money on. Like a modern gun that won't fire when dropped. What was it, a hundred years old?!

Been there, done that... At my old age, I was at Wal-Mart several months ago when the "urge" hit so hard I thought I was going to soil my drawers! At my old age and with lightning speed, I waddled to the front of the store with cheeks as tight as humanly possible to where the restrooms are located. 10-9-8-7, man it's coming and ain't no stopping it! 6-5-4, in the restroom door with belt already unbuckled and gun starting to droop. 3-2, it's here passing through my uncontrolled sphincter muscle. One... over the toilet bowl a wet unstopable nuclear explosion occured with the toilet seat up, gun and holster laying on the unsanitary floor, and a big smile on my face from all the relief.

I didn't even have time to secure my weapon on the provided gun hook inside the bathroom stall...

Moral of the story: You just never know when or where a negligent discharge will occur

NOT negligent discharge..."accidental" discharge if you did not reach the toilet on time....LOL

There is no such thing as an accidental discharge...negligent yes, but introducing live ammunition to a firearm was intentional, so an "accident" is impossible.

In full agreement. What kind of modern handgun discharges when dropped? I've had mine fall out of its holster twice (immediately went and bought a new holster after the second one - once I'll grant as my mistake, not twice,) and no discharge. I've slipped and dropped at the range once, no discharge.

Anyone know if there is a snap-cap that can tell you if it received enough of a hit to have "fired" had it been a real round? I'd be curious to know exactly what it would take to ND my firearm (without using live rounds, of course!)

Accidents *DO* happen, but this is the kind of accident that, if you know you have an antique that can fire when dropped, you should take better care, use a more secure holster, for one.

Kenai...and CharonPDX: this one is for you...

"Accidental"discharge when you did not reach the toilet on time, means all over his pants, not his gun, OK? Now, you want me to spell this out to both of you? I hope not. It will not be for public consumption anyway...aaahhhhhh....sometimes, get out of your cave and experience the realities of life. "Accidents" do happen sometimes...<tongue-in-cheeks> LOL

Now, I better get back to serving dinner. My timer is sounding off...do't want my dog getting hungry now, do I???

Have to disagree, when talking about a firearm, an accidental discharge is completely impossible as somebody had to intentionally introduce the ammunition, therefore, it can NEVER be an accident, only negligent (read unintentional) as they may not have intended the weapon to fire, but they created the discharge through some negligent scenario be it handling or whatever...but it simply CAN'T be called an accident.

Now, when it comes to other things in life, accidents can happen since you may not have control over bodily functions via outside forces...lol!

If you truly believe this, then you are grossly misinformed. (Whether you feel like agreeing, or not, remember I warned you!)

Here, in an effort to keep things simple I'll provide information on the 1992, 'Glock Frisbee Tests'. There's A LOT more to this than just the Frisbee Tests; but, this should get you started towards being more careful with your Glock.

My compliments! Your reasoning is, almost, identical to that of the Commandant of the United States Marine Corps. There are no AD's in the Corps - Only ND's.

For those that didn't read the article, it was an antique 357 revolver so no hammer drop safety. He should have had an empty chamber under the hammer. It is negligent not accidental in my opion because he should have know the potential dangers of his particular weapon.

An he was OCing in a western style holster.

Ah, the Old West. Load one, slip the rolled-up $20 (your burial money) into the next, load 4 more, let the hammer down gently on the $20 bill chamber. Or so the story goes. Greatly appreciated when you, your revolver and the Bronc you were busting all manage to part company. Hard to get anyone to turn a shovel to bury a jackrabbit for $20 these days.

Oh, jeez.......

That's what I get for not following along.
