Should the impasse in Congress prove unbreakable for raising the debt ceiling, some legal scholars say Obama still has a constitutional escape hatch at his disposal, although he has expressed reluctance to resort to it.

He could bypass lawmakers and invoke a little-known clause of the 14th Amendment of the U.S. Constitution, which states that the United States' public debt "shall not be questioned."

Shall not be questioned. Hitler, Castro, Pol Pot, Hugo Chavez ALL have said that should not be questioned. Hell, after a little car mishap, Teddy Boy didn't want to be questioned either.

I dunno. I read it and it sounds like the opposite of the intention--that US debt is valid, not simply erasable. But I'm no Constitutional scholar.

Actually Obama's only allowed to allocate previously approved (by the House / Congress) funding. He is not, by any constitutional device, able to raise the debt ceiling.

In his inaugural address of 1933, President Franklin Roosevelt said, "It may be that an unprecedented demand and need for undelayed action may call for temporary departure from that normal balance of public procedure."
Posner and Vermeule wrote that, in the current case, "the president would derive authority from his paramount duty to ward off serious threats to the constitutional and economic system."

Other presidents have also decided to go it alone when faced with with a potential crisis.

Harry Truman, faced with a potential steel workers strike in 1952, ordered a government seizure of the steel mills, saying a strike created risks for U.S. troops then fighting in Korea.

FDR had a bad habit of playing loosely with the Constitution at times. (Like a certain current Oval Office dweller I could name.)

Besides, it only states "shall not be questioned"..... don't say squat about paying them! LOL!

I could also mean that if Joe the Congresscritter uses taxpayer money to bet on the Lakers and loses.... if he tells OBM to pay xxx kilobucks to Willie the Bookie... it "shall not be questioned?" LOL!

Kind of like ".... shall not be infringed upon." As soon as one states something that seems set in concrete, there are ever so many Lawyers who are willing to make their "name" by coming up with an exception to the "rule".

With a pet "Holder" at the reins of the Justice Dept., if Obama thought he could get away with a 14th Ammendment "play", he would do it. But, there are a number of citizens who are (finally) beginning to look askance at his free and easy disdain for the Constitution he is sworn to uphold.

Let me give you an example, OK?

President Obama goes to a primary school to talk to the kids to get a little PR. After his talk he offers question time. One little boy puts up his hand and Obama asks him his name.

" Walter," responds the little boy.

"And what is your question, Walter?"

"I have 4 questions:
First, why did the USA Bomb Libya without the support of the Congress?
Second, why do you keep saying you fixed the economy when it's actually worse?
Third, why did you say that Jeremiah Wright was your mentor, then said that you knew nothing about his preachings and beliefs?
Fourth, why are we so worried about Brazil drilling for oil, but we aren't allowed to?"

Just then, the bell rings for recess. Obama informs the kiddies that they will continue after recess.

When they resume Obama says, "OK, where were we? Oh, that's right: question time. Who has a question?"

Another little boy puts up his hand. Obama points him out and asks him his name.

"Steve," he responds.

"And what is your question, Steve?"

Actually, I have 6 questions.

Chicago, Is that not Obama's old stomping grounds? Posner is the son of a noted political liberal... No surprise...

Obama would try and paint himself as the savior... Most American's are not in favor of a continued raising of the debt limit.. Maybe doing the will of the people would be a nice refreshing change we all could believe in...

Ohhh Nooooooo! I see this thread being railroaded into a "CCW Armband" discusion. I guess that goes along with the CCW sash, CCW Cape, CCW headband, and of course the infamous CCW Badge.
