Virgina CCW Question

I have a florida Permit, but I dont have a permit in my home state.. Will my ccw permit will be honored in Virgina? I know in PA I cant carry because I dont have my home state and was curious if Virgina would be the same way.

Because it's honored in more places than the FL non-resident permit.

In re: the VA permit, you won't have a problem with the FL non-resident permit. The VA non-resident permit (if you're really looking to CYA and are going to be in the great Commonwealth frequently) isn't difficult to get.
 
Just one caveat for you...if there is a reason virginia will not issue you a permit then you cannot carry concealed in virginia. The operative word is
"Permit" which simply means that Virginia has given you permission to carry concealed. Florida cannot give you permission to carry concealed in Virginia if Virginia, your home state, says you do not have permission. A bit like a drivers license. If Virginia does not give you permission to drive a vehicle on Virginia highways, Florida cannot give you permission to drive on Virginia highways by way of giving you a license to drive on Florida highways. Sometimes Virginia citizens have their permits revoked for cause. The permission is revoked and a permit issued by another state does not supersede the Virginia revocation.

How would the person obtain an out-of-state permit valid in Virginia if they could not qualify for the Virginia permit?

§ 18.2-308.014. Reciprocity.

A. A valid concealed handgun or concealed weapon permit or license issued by another state shall authorize the holder of such permit or license who is at least 21 years of age to carry a concealed handgun in the Commonwealth, provided (i) the issuing authority provides the means for instantaneous verification of the validity of all such permits or licenses issued within that state, accessible 24 hours a day, and (ii) except for the age of the permit or license holder and the type of weapon authorized to be carried, the requirements and qualifications of that state's law are adequate to prevent possession of a permit or license by persons who would be denied a permit in the Commonwealth under this article. The Superintendent of State Police shall (a) in consultation with the Office of the Attorney General determine whether states meet the requirements and qualifications of this subsection, (b) maintain a registry of such states on the Virginia Criminal Information Network (VCIN), and (c) make the registry available to law-enforcement officers for investigative purposes. The Superintendent of the State Police, in consultation with the Attorney General, may also enter into agreements for reciprocal recognition with any state qualifying for recognition under this subsection.

If the Superintendent of State Police and the Office of the Attorney General determine that the out-of-state permit is recognized by Virginia, and the person holds one of those permits, it is good in Virginia, period.
 
Thanks for the responses.. I just wanted to be sure that not having a permit in my home state wouldnt invalidate my non-resident permit in VA. I live in Delaware so currently I cant carry in delaware or PA with my florida non-resident. Just wanted to make sure it wasnt the same in VA..

Somehow I knew you would chime in with the legaleeeze...I will simplify it. Let's presume that the OP has both a Virginia CCW or a Florida CCW and for whatever reason his Virginia CCW gets revoked for cause. His permission to carry a concealed handgun in Virginia is revoked (not the piece of paper). Lets say he came to Virginia and only had a Florida CCW and while living in Virginia he gets charged with drunk in public. In that case he is disqualified from obtaining a Virginia Concealed Carry permit which would allow him to carry concealed in Virginia. Florida has no authority to override Virginias disqualification. He may still have a Florida Permit but it don't mean squat in Virginia if permission to carry a concealed handgun has been denied. He could have ccw's from every state in the union, as well as guam and puerto rico and throw in the us virgin islands for kicks. If Virginia says he is not allowed to carry a concealed handgun...he cannot carry a concealed handgun regardless of how much florida stomps its feet and demands that Virginia allow him to carry under their permit. Now he can go to Florida and carry all day long if he likes...just don't come to Virginia and carry concealed. I hope this clears it up before you get someone sent to prison by telling them it don't matter. Please read my post again!

As a Delaware resident, this also means that obtaining a non-resident permit from Utah is not an option for you either since Utah requires you to have a permit from Delaware as a prerequisite. Your FL license is the way to go for you to legally carry in VA.

Let me get this straight. You mean to tell me that if a person has 1 public intox misdemeanor in VA that is a reason for disqual? That seems absurd.

Simplified? Personally, I'll just stick with what the statute states, its a lot shorter and holds more weight than your opinion, which doesn't apply to the OP anyway because they are not a resident of Virginia.
