I was convicted of DWI in 2007 in VA. I fully understand the gravity and implications of this big mistake, so I'm not looking for comments regarding that; please refrain. I want to get a VA concealed carry permit if possible. I attended VASAP Alcohol counseling as part of the whole deal. One of the questions on the concealed carry form is "Have you ever been ordered to mandatory outpatient treatment." I'm wondering if this DWI related VASAP counseling constitutes answering "Yes" on this question, or not. Any insight would be extremely helpful.

I don't think VASAP counts as "mandatory outpatient treatment", but that is only an opinion, not fact. I base my opinion on two things:

1) My roommate recently completed his VASAP "counseling" for a DUI, so I'm familiar with the process and what the "counseling" entails. I put "counseling" in quotes because I do not consider VASAP to be true counseling or treatment. Instead, I consider it to be court ordered punishment, if you will, to ensure that you do fully understand the gravity of your mistake. (I also fully believe that everyone is entitled to make mistakes as long as they learn from and do not repeat them.)

Also, the Virginia state code on the commission of VASAP (LIS > Code of Virginia > 18.2-271.2) and the acronym itself refers to an "alcohol and safety action program", not counseling or treatment.

2) I am a Virginia resident and have had my concealed carry permit for over a year and am familiar with the form & question. I completed the required training course provided by Proactive Shooters (Proactive Shooters).

As a suggestion, you might consider contacting them with your specific question as they would be in a much better position to answer your question from a legal standpoint.​
 
Another suggestion that just occurred to me - you might also try contacing the Virginia Citizens Defense League (Link Removed).
 
Have you looked at the VA CCW application, does it ask about any alcohol related convictions? Another route might be contact the VA issuing agency; they could tell you fairly quick if you will have a problem.

You are not the only person to go through this.

You can still get one, as long as you don't have a aggrevated assault charge on you , your ok:pleasantry:
 
VA CHP DUI disqualification

In Virginia, a person who has been convicted within the last 3 years of DUI or public intoxication is disqualified from obtaining a concealed handgun permit. Va. Code § 18.2-308(E)(9). Since OutdoorRat did not indicate the exact date of his conviction, I do not know whether that date has passed. However, in Question 8.A.2. of the Link Removed, he would need to disclose the conviction.

The reference to mandatory outpatient treatment in Question 8.D. of the Link Removed refers to an order of mandatory outpatient mental health treatment, which triggers a state law firearms disability under Va. Code § 18.2-308.1:3 and a disqualification from obtaining a concealed handgun permit under Va. Code § 18.2-308(E)(1).
