How did Maryland policemen know that a Florida tourist owned a gun? Is there a system in place whereby police everywhere know you own a weapon and, in this case, wanted to confiscate the weapon? Seems like the Gestapo has been revived and we all may be in peril of losing our weapons on the whim of some renegade law enforcement agency.

UNITED SOCIALIST STATES OF AMERICA: Maryland Transportation Police Pulled Over Unarmed Concealed Carry Owner, Only to Ask for His Gun
By GJWHG / 17 January 2014 / 40 Comments

Maryland_Transportation_Authority_PoliceA Florida man was traveling South with his family on the way home from a wedding in New Jersey when the Maryland Transportation Authority Police (MTAP) began tailing his Ford Expedition. After about 10 minutes, the police pulled him over and told him they knew he owned a gun. They demanded he produce it for them on the spot — even though the firearm was locked away in a safe 1,000 miles away.

John Filippidis of Hudson, Fla., told The Tampa Tribune he wasn’t speeding or doing anything illegal when the cops took an interest in his car. In fact, he’d intentionally left his Kel-Tec .38 pistol locked up at home precisely because he understood the potential legal headaches that can arise when traveling through multiple State jurisdictions with a firearm.

“I know the laws and I know the rules,” he said. “But I just think it’s a better idea to leave it home.”

So when the Maryland police pulled him over, they took his license and registration back to the patrol cruiser, then returned to the car and ordered him to get out. Here’s the Tribune’s narrative:

Ten minutes later he’s back, and he wants John out of the Expedition. Retreating to the space between the SUV and the unmarked car, the officer orders John to hook his thumbs behind his back and spread his feet. “You own a gun,” the officer says. “Where is it?”

“At home in my safe,” John answers.

“Don’t move,” says the officer.

Now he’s at the passenger’s window. “Your husband owns a gun,” he says. “Where is it?”

First Kally [John’s wife] says, “I don’t know.” Retelling it later she says, “And that’s all I should have said.” Instead, attempting to be helpful, she added, “Maybe in the glove

. Maybe in the console. I’m scared of it. I don’t want to have anything to do with it. I might shoot right through my foot.”

Maybe Florida is one of those states that make that info available with the driver's license? Glad CO doesn't, though I've heard of CO residents having issues out of state because here the CHP is issued by county, not state.

I have yet to hear why the LEO pulled Mr Filippidis over and what did Mr Filippidis get a warning ticket for? Does anyone know?

I am very pro cop. I was in law enforcement for 29 years. However, these Barney Fifes that want to abuse their authority and use that authority to push their own political beliefs make me sick to my stomach.

Since you were in law enforcement, is there some way that out-of-state police can determine you have a carry license or have a weapon other than questioning you in person? But, as you said, was this just a case of Barney Fifes reacting to out-of-state license plates and hoping to catch someone who may have looked like a gun owner? Seems like this action could become a cash cow for someone suing the state for violating their rights. Wonder what the man's kids thought of the way that was handled?

In NC ours is issued by the sheriff but is cross referenced to our driver licenses.

In the State of Maryland a citizen does not have to notify LE immediately, but must respond appropriately when asked about a license or weapon.

With this in mind could it be that the LEO asked if he had a gun instead of a declarative statement that he had a gun. Looking to put the motorist in the position of having to acknowledge possession of a weapon.
~
I find if more than improbable that a Maryland Transit police officer could access Florida weapons database while mobile and without some jurisdictional permission. This has appeared in several threads and the same question is being asked, how did the LEO know of the weapon? I don't think he did, I think he made an assumption about the occupants with them being from Florida (possible drug transport) and acted accordingly, making the inquiry in an attempt to be safe (so he will say) or an attempt to violate the motorist in some way to justify his stopping the vehicle in the first place. As there was not mention of why they were stopped to begin with and there was no mention for what the warning was issued. (no citation for a traffic violation was issued)
~
IMO the LEO was looking for something different and settled for what he could to cover his behind.

LEOs should be shaking this guy's hand for CC, instead of violating his rights on a bogus stop.

And the LEO community wonders why citizens have disdain for them?

I have lots of LEOs for acquaintances, and none would stoop so low to harass citizens like this.

Could it be that he had a pro 2A bumper sticker on his vehicle that caused this.

My opinion is that every LEO has a secret desire to thrash the citizens. This is why many of them go into that career field to begin with. If you aren't one of those types of LEO what the hell are you still wearing the uniform for. You need a job??? You are too much of a coward to clean up your own ranks so I personally have no sympathy for you when someone pisses on your shoe.

Why was he stopped in the first place? Do you own a gun? Yep under the 2nd amendment to the constitution of the United States, in case you don't know it's a lot like the Health Care Bill nobody read.

In NY there is no cross-reference to the driver's license. But this wouldn't matter anyway. When they run a plate they get registration information not DL info. Could be anyone behind the wheel. I'm not sure how running the plate tells anyone who's driving or what's in the car.

In some states, such as mine, when an officer runs your drivers license it shows if you have a CC permit. I'm guessing that this is how the cop knew that the gentleman was a gun owner.

Florida's CWL are issued through the Dept. Of Agriculture. They are not tied into the DL system.
