That's a sad story alright. What sort of firearms did the man have? Since it's not mentioned in the article, and by the reaction on the local police, I'd have to bet on handguns. They may have been registered and legal in Oregon, but you and I both know that it doesn't work that way in NY.

It sounds like the hospital violated the HIPAA law, and that the hospital security man was way out of bounds asking the fellow to sign off on a police search for the police.

He admits an addiction to prescription drugs. He admits to mental health issues. He admits to gun possession at the same time. He caused his own trouble. This is not something that will befall all Americans under Obamacare, it's already in most law. States who issue permits require you affirm you are not addicted to drugs or alcohol or suffering any mental illness on the permit application. The same questions appear on the BATFE 4473 form.

Addicted is much different than prescribed. If all persons prescribed pain meds or anti-anxiety/antidepressants are to be relieved of their firearms, that's a HUGE number of LEO, ATF, FBI, Secret Service, Sheriffs, Court Officers, DA's, judges, investigators and military personnel.

Just so no one gets confused, Oregon does not require firearms to be registered..

Since I just noticed this and I was one of the so called people who "went off", I thought I would respond. My Lewis/Tresmond posts were not contesting what is actually contained within that law. I was relaying information provided by the legal team with regard to how NYS was violating what they had on their own books. In fact here is a quote from one of my posts :

When the SAFE Act was passed it also added a new section to the state Mental Hygiene Law, Section 9.46. When a mental health professional believes someone in their care may be a danger to self or others, the caregiver is required to contact the Director of Community Service. If they agree there is a danger, the Director of Community Service passes their recommendation on to the Division of Criminal Justice Services, which includes State Police. But it remains a mystery how State Police received information that David Lewis could be a danger. In fact no agency even knows who the Director of Community Service is.

What the Tresmond's further investigation revealed was that there was/is a NYSP Gun Squad that was violating HIPAA laws. They had been rifling through private individuals medical records without permission. This was quickly discovered when Lewis's doctor told investigators he had never forwarded info to anyone with regard to David Lewis. And now there are at least 2 witnesses who have agreed to testify to the actions of the NYSP. Since that time the Tresmonds have put a lid on any more public disclosure. I do however know a member of the legal team and a few weeks ago I asked him if anything further has transpired with the Lewis case. Here is his reply : "Yes, and that issue is still very significant and is ongoing. There are other things that we have uncovered that have never been publicly disclosed. You will be shocked at some of the facts we have uncovered."
