Terrorized family: SWAT team raids wrong home

MIDDLETOWN — Steve Tuppeny was in the garage of his Middletown home having a smoke at 6:15 a.m., his wife and daughter asleep inside, when the Wilmington SWAT officers made their move.

Dressed in black, several officers rushed Tuppeny, ordered him to lie face down on the ground and handcuffed him. Other SWAT officers smashed the storm door in the front of the Tuppenys’ two-story colonial-style home, then used a battering ram to break through the red front door.

Jennifer Tuppeny, a teacher at Marbrook Elementary School near Prices Corner, said she was asleep upstairs when officers threw open the door to her darkened bedroom and ordered her at gunpoint to get up.

The couple’s 8-year-old daughter was awakened out of a “dead sleep” by “men dressed in black with guns shining flashlights in her face,” Jennifer Tuppeny said.

Police carried out the early morning raid in search of a man whom they called a “person of interest” in a homicide. The man, in a Sept. 19 court appearance, had said he lived at the Tuppenys’ address in the 100 block of Willow Grove Mill Drive. Police had a search warrant authorizing them to obtain a DNA sample.

The man was located later Thursday in Smyrna, was given a DNA swab and released, said Wilmington police spokesman Officer Mark Ivey. Police did not release his name, and Ivey said late Thursday afternoon that the man is neither a defendant nor a suspect.

“The person of interest had resided at the residence and provided court officials with this address within the last month indicating he currently lived there,” Ivey said in a statement released Thursday afternoon. “In compliance with standard operating procedure, officers verified that the person of interest was no longer residing at the home and did not search the residence any further.”

By that time, Steve Tuppeny said, his family had been terrorized.

“I’m lying on the garage floor at gunpoint and they are invading my home terrorizing my family,” Tuppeny said. “This is America. We’re innocent people here.”

SWAT raid to swab somebodies cheek! Shouldn't voluntarily or by warrant giving your DNA be covered under the 4th and 5th amendment unless you are arrested and charged for the crime?

Government "social worker" was brought in to "talk" to their 8 year old girl. ggrrrrrr!!!!!!!!!!!!!!!!

If I'm a cop-hater for thinking this kind of stuff is detestable, well, all I can say is that I'd rather be called a cop-hater than the Constitution-hater that anyone who thinks this is kosher would necessarily have to be.

what an outrage this shyt has got to stop and the family should be well compensated for this tragic infringement on their rights as well imo although nothing can take the memory away..........well with today's technology they probably could but dayum just dayum
 
Since when does it take a SWAT raid to find a guy and take a cheek swab?

Especially when the person is neither suspect nor defendant? Person of Interest - what a vaguely defined and ill used term.

This whole story, if accurately reported, stinks worse than the old Omaha stock yards.

How about having an SOP that verifies the address given is in fact the perp's address. It's so easy for a clerk to have missed or transposed digits, for the perp to not tell the truth (they're always so honest, right?), or for the SWAT to misread the warrant.
 
Anyone else notice that the SWAT raiders were from a different jurisdiction? WTF they doing raiding outside their town?

Is it pillage and plunder season?
 
My 7 year old son can use a GPS and the internet but this SWAT team can't even verify public information. Since when do SWAT teams from another county bust down someones door to collect DNA? I guess they needed to try out those cool automatic weapons and flashlights. It's Bullcrap like this why people don't trust the cops anymore.
 
If this story is true, this is horrendous. A single police officer with a swab kit should have knocked on this door, and taken the sample. If this truly happened, there is much more to this story than what we have heard and if there isn't, this is a complete and utter abuse of authority.
 
If the story is in fact as it has been related, this is an outrageous trampling upon the rights of everyone. Raises a bunch of questions too. Was the suspect actually verified to have lived there in the recent past, or was that simply where he told them he lived? Though described as being wanted for murder, we don't know the specifics of the crime. Overwhelming response can be justified in some cases to prevent a hostage situation from developing while trying to apprehend a truly dangerous suspect in a dwelling where there are other people known to be living. Looks like extremely poor intel here, and to take that level of action without having verified that your suspect is in fact in the building is unforgivable and a breach of the public trust. If the story really is as posted these folks stand to win a bundle in court (and however much it might be, it won't be enough). Local community needs to really make some noise about it too. Scary.

Amazing isn't it... ONE fricking bank robbery in Los Angeles back in the 80's has resulted in tyranny such as this. Makes me want to puke.

They were the ones looking for the guy. The idea that law enforcement can only operate within it's own jurisdiction is pretty much a Hollywood myth. Most states allow any LEO to have enforcement authority anywhere within the state. They rarely practice outside their own jurisdiction as a matter of courtesy to other departments because it really messes things up logistically and paperwork-wise if they do, but they're still allowed to. And just as it mentioned in the article, they normally notifiy the other department when they're going to operate within their jurisdiction. In some circumstances this can work across state lines too. I work at DUI checkpoints all the time and we have officers from multiple jurisdictions there.
 
Many SRT and SWAT teams from sparsely populated areas are comprised of members from several jurisdictions.
 
If you want a swab from me contact my lawyer, kicking in my door requires you to get by alarm, cameras, dogs and serious gunfire.
 
I can see this as getting real expensive real quick for police departments and municipalities...with the right lawyer and a sympathetic jury, this could break the bank of most small towns!!!!
 
Almost forgot to mention, even if I am dead my family will be set for life, not by my life insurance but by a really good lawyer we have.
