Tanglewood Mall against Weapons

I recently talked to management at Tanglewood Mall in Roanoke Va. The told me that No weapons signs are not needed to tell anyone about their policy. Unarmed Security will be asking people about their Legally concealed Weapons and asking for permits. Then People will be escorted out or Arrested. Can they legally do this ?

Uh... concealed is concealed, right? If they do determine you have a firearm, all they can do is ask you to leave the property. Failure to leave can result in a trespassing charge. As for the rent-a-cops asking to see a carry permit? Fat chance. And, I don't think I've ever seen any security at Tanglewood Mall.

Sounds to me like mall management is just making stuff up. How did this discussion come about, if I may ask?

Its private property so yes, but it should be posted and you don't have to show them anything, most likely if you refuse they'll feel inferior and call po-po anyway. I carry anyway. I'll be damned if I get caught in a deathtrap like that when someone decides to start shooting.

Private security have no arrest powers they have to call local police to have you arrested.

A follow up to my previous post:

Here is the mall's "Code of Conduct" from their web site. No mention of firearms in addition to none of the entrances being posted. Again, it's their property, they make the rules - even if those rules aren't fully enumerated anywhere. Carry it concealed and don't worry about it.

This mall is practically a ghost town anyway. There are more empty storefronts than occupied ones. If management wants to drive away lawfully carrying customers, that is their prerogative.

Tanglewood Mall is a smoke-free facility. Smoking is allowed only in designated areas outside of the mall and away from entrances.
Guests who do not act responsibly may be asked to leave. Uncooperative guests may be arrested and prosecuted for criminal trespass. Tanglewood Mall prosecutes persons committing crimes on the property through the Virginia Court System, and may ban subjects from the property.

If it is their "policy", then by law it has to be posted according to STATE regulations regarding wording and size for permit holders. The signs that say "the unlicensed possession of a weapon is prohibited" etc. do not apply to permit holders period. Otherwise all that they can do is ask you to leave the property. They can not ask for your permit if you agree to leave.

Blanket statements like that are not helpful, especially when they're completely incorrect. Every citizen has the right to a citizen's arrest. This naturally applies to security as well. Citizen's arrest laws vary from state to state, but in the majority of them they require the citizen to have either personally witnessed the commission of a felony, or a breach of the peace, such as an assault. I work in security in WA and have made several arrests in my life.

It is indeed a ghost town, and chasing away customers as well as businesses seems to be their thing.

Concur with the other folks who have stated that a properly concealed weapon shouldn't attract attention.
