In what police describe as a ''tragic accident'', the 3-year-old son of a San Jose police officer was shot and killed Wednesday evening at his home in Gilroy.
The boy was at home on Kentwood Court in Gilroy before 5 p.m. with his family and other children.
"Unfortunately, emergency personnel were unable to save the boy and he was pronounced deceased while enroute to a local hospital," Sgt. Chad Gallacinao said in a statement.
He added that the investigation will focus on how the gun was stored inside the house.
The Gilroy Dispatch reports that his mother ran outside screaming and crying.
The paper reports that three other children were inside at the time, indicating this might have happened during a play date. Police won't say who pulled the trigger of the handgun: Whether the boy accidentally shot himself or another child accidentally pulled the trigger.
Part of the investigation will focus on how the gun was stored and why a child was able to get their hands on it.

These types of incidents make me SO ANGRY!

This cop and his wife were both beyond 'Negligent' with their duties as parents and as a firearm owners!
He should lose his badge, and they both should probably serve some sort of jail time i.m.h.o.

if it been a civilian that is most likely exactly what would have happened! he'd have been locked up lost his job and perhaps the other children taken into some seedy state child agency to boot!
sad story Outlaw but i don't see how taking him to jail is going to help him or his family at this terrible time for them all........ yes take away his guns and give him a desk job perhaps is imo a must in this case....but even though that man done a terribly neglectful thing to leave his gun unguarded in a house full of children .......i just don't see how jail time will fix that kind of stupid and he and his family probably need each other now more than ever for emotional support and continuing some kind of employment as well to keep a roof over their heads and fed.......there is still much not being said in this incident and i won't even begin to speculate.......sad situation all around no doubt

While I want to agree with you about the family needing to be together at a tragic time like this,
I just cannot see how this very irresponsible cop should be allowed to keep his job...I'm sorry, but he needs to be terminated from his Law Enforcement career a.s.a.p. imho. Let him get a different job doing something that does not involve carrying a firearm & public safety.

And if a taxpaying citizen would go to prison for something as negligent as this, then a cop should also have to go to prison for this sort of negligence. No one person should ever be 'above the law'.

Why should this dude continue to benefit with a cushy desk job, a good salary and full benefits at Taxpayers expense?

Fire him and let him get a job in the private sector like the majority of us 'citizens' have to do.
And although some prison time may seem a bit harsh, then tell me, What other form of punishment would be fitting for the negligent death of an innocent child?
If you are an enforcer of the rules (a cop), then you should be held to a higher standard i.m.v.h.o.

Quite an interesting discussion that pops up once in a while. I am more inclined to agree with outlaw on this one.. Yes the family has to grieve, however, the fact that he is a police officer does not excuse him from his responsibilities as a gun owner or a parent. One of the biggest problems for anyone who deals with a firearm on a daily is the complacency that comes with it. Which is more than likely the issue in this instance. Complacency is no excuse for any behavior especially one that cost a 3yr old his life. Now add in that this was a cop and you have someone who was "trained" to know better. I'd be willing to bet that if you observed 20 cops and 20 legal gun owners, and studied their habits, you would find the legal gun owners are safer and more respectful with their weapons. Is this a tragedy, yes, should he face charges and termination for his actions, yes.

the death of his child i feel may be more than enough punishment in his case.. and his peers at the job rather than shun him should offer moral support and guidance perhaps? i agree cops should be better citizens but they are human just like the rest of us regardless of their job position and titles or badges and guns.......and treated just like you yourself would like to be treated
social sciences cannot be written in stone as no social encounter or situation is the same but the basics should be our foundations for forging forward in most mindful manner .......imo

However, the father, being a police officer, should have had sense enough to not leave a loaded firearm where children could access it.. At the least he should lose his job, if not be charged with being an idiot. But then being and idiot isn't a chargeable offense.

I have to agree with Outlaw on this one. While the family has to live with the horrible loss of a child, a cop is NOT above the law. As I understand the 'Peoples Republik Of Kalifornia' law the cop was at the very least careless in firearm storage and 'Kalifornia' law requires firearms to be locked up. The law applies to everybody or nobody. The question is would a non-leo be treated any different? In this case I fear the answer is yes, the cop will NOt be charged and will keep his job. He will at most get some kind of repimand at work, basically a slap on the wrist. A citizen would probably land up in jail. IN THE END A CHILD IS DEAD BECAUSE OF AN ADULT BEING CARELESS WITH A GUN. This is an example of what could happen to any of us. And my heart does go out to the family.
