This is one of the most ironic articles I've read lately. It's pretty hard to feel sorry for the deputy under the circumstances. It was the one killed that requested the "no-knock" warrant. Homeowner shot and killed him when he knocked down the door without identifying himself.

If the article presented the facts correctly, than I would say this homeowner has committed no crime.

Ironic how the deputy who wanted the "no-knock" warrant is the one that got shot and died.

Much more blood will be spilled. These alphabet soup agencies and militarily equipped police will suffer losses, as will citizens.

How many citizens will die before the government gets the message we won't tolerate Police State, oppression, or Marxist socialism?

How many jack-boot, murderous thugs will die bastardizing the oath they took as officers?

Someone breaking into my home without identifying themselves will suffer the consequences, by their illegal action.

This military police exercise across the country should raise some eyebrows.

In your lifetime? This federal government led by a narcissistic moslem communist thug and his henchmen have 3 more years and may then decide that they need more time. Impossible? I am not a sheep. I am not like my fellow jews in Germany. Someone will go to hell before I go to heaven. When I watch these sort of SWAT operations on TV, even with their "knocks on the door", I see stormtroopers, I see gestapo. So they have a warrant--did the judge really know for certain that something was really criminal needing this kind of militant invasion? And when everyone was wrong or when you do not even have to knock, what then as in this possible case (too little info right now). When I watched the breakdown in rights taking place after the Boston bombing, where police ordered whole areas to stay in their homes without any right to do so because of the "emergency", I can see emergencies everywhere that our godking can allow to happen (does Occupy come to mind?) or decides there is one and I see this new federal police force doing whatever they want.
 
In a similar case in NYS the conviction was reversed on appeal. The jury was not properly instructed that the homeowner had the right to shoot. The LEO was kicking at the door without announcing himself and was shot through the door. See. People v. Raymond Zayas.
 
I am sorry to see a death like this happening in a "no-knock" raid that, on the surface, appears unnecessary. Just like the raid on the Koresh compound by BATFE, many lives will be lost in this manner. Why wasn't this raid held in daylight, by regular officers, and not by the officer who swore out the complaint? This whole thing seems irregular at best, and were I the D.A. in this county, would do a LOT of investigation before leveling charges against a citizen who was rudely awakened at 6am by an armed home invasion team. In my home state of Tax&Spendifornia, I personally watched a Cal. Highway Patrol training exercise, wherein officers were simulating a building entry drill on some SASS-style buildings I had built. These are officers who ostensibly are charged with enforcing vehicle code. It gave me the creeps...I saw them as brown-shirted storm-troopers, training to disarm the populace, just as they did in New Orleans during Katrina...that's right, folks, they were there disarming citizens defending their property! There is video evidence of them disarming an elderly woman with enough force to injure her....it's coming...
 
A great book on this topic is Radley Balko's "Rise of the Warrior Cop: The Militarization of America's Police Forces." There is a real need for change. These "no-nock" warrants are a clear Constitutional violation, become the standard for arrest for non-violent crimes (i.e., drug possession and recently regulatory violations), leading to the deaths of innocents who were wrongly served, needless injuries to officers, and the breakdown in any confidence in law enforcement. They are usually served by SWAT teams (often wearing camouflage- go figure). In cases where the persons of suspicion are really a danger, law enforcement are more creative in using ruses to arrest the person without risking the lives of officers or others. We need to stop the grants (a VP Biden project) to provide military equipment to law enforcement. (The small town of Salinas, CA, just received a tank capable of withstanding IUDs. Apparently that's a concern there.) Balko's book details many of these problems and what can be done to reverse direction.

It is happening in your lifetime and it needs to stop in our lifetime.
 
Swat teams are only needed in very few instances. They are given equipment, receive training and have to justify the expenditure. No knock warrants go against the constitution and should be eliminated. They kill innocent people and nothing happens to them. Each officer involved in a no knock warrant where a person is killed or badly hurt should stand trial like any other citizen does when they harm someone.
 
Guess this is what happens when you try to be sneaky. Had they openly announced themselves, this deputy would most likely be alive today. How many more times will this happen before they wise up? The "law" that is.
 
I have gone back and read that article several more times and every time I do, it makes less sense. And that's aside from the inadequate reporting.
I think there's more to the story than the obvious. First, the warrant was for drugs and/or possible stolen guns. Does that really justify a no-knock warrant? There were no stolen guns found and only a misdemeanor amount of marijuana. Sounds like more of a case of a deputy that had it in for the homeowner.
The guy had a record, two DWIs and a misdemeanor drug conviction. If 5 years had passed, he could legally own a gun for the home. It may ultimately come down to how long it has been.
But what really surprises me is that the homeowner was arrested rather than killed.
 
Id blame this incident on the behalf of the SWAT team IF all facts are correct. If the officers did not announce themselves as Police, loudly, clearly and enough times for an awaking person to realize, then fault is on the Officers, homeowner was protecting himeself/family with lawfully possessed weapons.
Im sure myself or anyone on here would have done the same thing. Family first, ******* the Bad Guys
 
What I am most surprised about in this thread is that there arent any badgefluffers here yet......

Maybe it is because they are starting to wake up to what is happening? I sure hope so, I hope everyone in this country wakes up before it is too late.
 
Even if the cops yelled out that they were cops, at 6am when one is asleep, would you hear that? Would you readily understand it? No, it's just a noise that woke you up.


I suppose it's only really surprising that the rest of the team didn't unload on the man and woman.

It is surprising, given one of their own had fallen. Very strange. I'd like to find-out more specifics of this incident as time goes by.
 
I would reserve judgement until we know all of the facts. Very tragic indeed.

In this case it is the police who should have used proper judgement. It is tragic but the whole thing could have been prevented. As others have stated there is more going on then whats being reported.
