Questioning in the Senate Appropriations Committee revealed that on two occasions, in November 2011 and again in January, the patrol asked for and received the full list from the state Division of Motor Vehicle and Driver Licensing. The investigation was triggered by fears that concealed weapons data was being shared with federal authorities.

Questioning in the Senate Appropriations Committee revealed that on two occasions, in November 2011 and again in January, the patrol asked for and received the full list from the state Division of Motor Vehicle and Driver Licensing. Schaefer later met in his office with Col. Ron Replogle, superintendent of the patrol.

Testimony from Department of Revenue officials revealed that the list of 185,000 names had been put online in one instance and given to the patrol on a disc in January.


Schaefer has been investigating a new driver licensing system. He and the committee grilled the revenue officials for several hours in the morning and again at midday before they admitted the list had been copied. The investigation was triggered by fears that concealed weapons data was being shared with federal authorities.


Under Missouri law, the names of concealed weapon permit holders are confidential. The only place in Missouri where the names of all concealed carry permit holders is stored is among driver license records. Permit holders have a special mark on their licenses indicating they have been granted the privilege of carrying a gun.


The list was given to the Social Security Administration Office of Inspector General, Schaefer said he was told.


“Apparently from what I understand, they wanted to match up anyone who had a mental diagnosis or disability with also having a concealed carry license,” Schaefer said. “What I am told is there is no written request for that information.”


He said he intends to ask Replogle for full details at an appropriations committee hearing on the patrol's budget on Thursday morning.


The patrol responded by confirming that it had shared the list of concealed weapons holders with federal authorities.


"The information was provided to law enforcement for law enforcement investigative purposes," Capt. Tim Hull wrote in an email response to questions from the Tribune.


The only way to obtain the full list is through a special request. Only law enforcement is supposed to have access to concealed carry information and then only on an individual basis. When a law enforcement officer looks up an individual's driving record, it shows whether they have a concealed carry endorsement.


The information raises numerous questions, Schaefer said.


“When they turn over the entire list of concealed carry holders in the state of Missouri to the federal government, where is it going?” he said. “I want to know who all was involved in this transaction because if this is just some phone call saying give me the list of all concealed carry holders, how did the person at the patrol who fulfilled that request know who was at the other end of the phone? How did they know where to send it? How did they know what it was being used for?”


The fact that the list had been copied two times was revealed when Sen. Rob Schaaf, R-St. Joseph, followed up on testimony that it was possible, through a batch request, to extract the list. Revenue Deputy Director John Mollenkamp said it had been done twice, for the highway patrol.


Mollenkamp said he wasn't sure what the patrol did with it while it was in that agency's possession.


Schaaf immediately suspected what Schaefer learned from Replogle later in the day. “Now we know two things,” he said. “We know that somebody out there, probably in the federal government, wants the list of all the concealed carry holders in Missouri. We know that now.


“We know one other piece of information – we know the department is actively and purposefully concealing that information from us,” Schaaf said.

AMHERST, NY -- It could be the first foul up involving the state's new gun legislation. Who's to blame? That's still being hashed out.
The attorney for a Western New York gun owner who Link Removed says his client will get his guns back. The Erie County Clerk is now blaming New York State Police for making the mistake that could have cost the 35-year-old librarian his gun collection.
"Who messed this up?" asked Channel 2's Kelly Dudzik.
"I think that first and foremost, it stems from a flawed law that was passed so quickly without forethought on how something would be implemented. Certainly, I am disappointed on the fact that we were given information from State Police that this was an individual that we needed to act immediately on," says Erie County Clerk Chris Jacobs.
That individual is David Lewis. He is a 35-year-old college librarian. His attorney says he has an anxiety-related medical issue which prompted a doctor to prescribe him medication. Lewis owned seven guns until he received a letter from Jacobs' office. That letter told Lewis the New York State Police wanted the County Clerk to suspend his pistol license right away.
"They made the mistake. They handed the mistake to us, to our local judges, and it's really disappointing that they're not standing up and taking responsibility here," says Jacobs.
Jacobs feels the State Police are targeting his office, which he says only serves an administrative role when it comes to enforcement of the SAFE Act.
New York State Police issued a statement Wednesday saying "No guns are being taken because an individual is on anti-anxiety medication" and refused to answer our questions or do an interview.
"Are State Police trying to blame your office?" asked Dudzik.
"Yeah, I think they're saying that it's myself or the Supreme Court judge who's assigned to this that it's our fault, but they were the ones that gave us the information. We're not privy to any of that mental health information that they had and that's what they acted on to send this dictate down to us," says Jacobs.
Jacobs showed us an email indicating a State Police sergeant followed up with his office to make sure the guns were turned in.
Wednesday night, Jacobs said in a news release that the information he got from police about the man in question was incorrect.
"Somebody is not being exactly honest," says James Tresmond who is the attorney representing Lewis.
Tresmond tells us that someone along the way felt his client's personal medical information fell under the reportable mental health provision of the SAFE Act.
"It's negligence on either the State Police or Erie County Clerk's Office. Someone was negligent if my client has been put through this ringer," says the attorney.
Tresmond still plans on filling a lawsuit, but will not say how much he plans on suing for in federal court. He says it will be the maximum, and he doesn't know who he will sue until he knows exactly who is to blame for suspending his client's pistol permit.
"Has he gotten his guns back yet?" asked Dudzik.
"No, but we will get them back. They are his property," says Tresmond.
In order to get his guns back, Lewis still has to go to a hearing in front of a judge.
The Erie County Clerk says he typically sees the State Police as good partners, but he blames them for this mistake.

Senator Says Universal Background Checks Could Lead to National Registry


Nothing short of a rejection of any gun bill should be acceptable to the American people if they wish to retain a modicum of liberty

Senator Mike Lee, a Republican from Utah, expressed his concern on the Senate floor about a universal firearm background check system now under consideration in Congress.



“Some of the proposals, like for example – universal background checks – would allow the federal government to surveil law-abiding citizens who exercise their Constitutional rights,” Lee said. “One of the provisions we expect to see in the bill based on what we saw in the Judiciary Committee – on which I sit – would allow the Attorney General of the United States (Eric Holder) to promulgate regulations that could lead to a national registry system for guns. Something my constituents in Utah are very concerned about, and understandably so.”

Senator Lee said the government has no authority to monitor the legal exercise of constitutional rights.

“You see, the federal government has no business monitoring when or how often you go to church; what books and newspapers you read; who you vote for; your health conditions; what you eat for breakfast; and the details of your private life– including your lawful exercise of your rights protected by the Second Amendment and other provisions of the Bill of Rights.”

Democrats are aware of the growing alarm over the prospect of a national registry and ultimately confiscation. On Thursday, vice president Joe Biden went on Morning Joe to sell the fallacy that the gun bill supported by Obama does not contain a measure for a national gun registry.

“They don’t say what kind of gun you’re buying,” Biden said. “They don’t say where you’re going. They don’t say what it is, what the transaction is and when denied, they don’t say denied because of mental health. Nothing. And the record, even the notice that you picked up the phone at ****’s and called and asked about Joe Biden, is, has to be destroyed within 24 hours.”

“So this idea that there is a national registry, there is no place in the federal government where you can go, not a single place, and find out everybody who owns a gun.”

The gun bill Democrat Senate Majority Leader Harry Reid is peddling in fact contains what amounts to a national registry.

The “Reid bill enacts a new section 922(t)(4)(B)(ii) of title 18 of the U.S. Code to direct Attorney General Eric Holder to issue regulations ‘requiring a record of transaction of any transfer that occurred between an unlicensed transferor and an unlicensed transferee.’ The legislation does not define the term ‘record of transaction,’ does not specify any limitations on who creates and who keeps the record of transaction, and does not explicitly incorporate the existing prohibition on a national firearms registry,” writes David S. Addington.


Thus, the loose language could be construed to allow the Department of Justice itself (or another agency specified by the Attorney General) to keep centralized records of who received what guns and where, by sale or gift from one individual to another. Any provision of a bill relating to firearms that authorizes the Attorney General to issue regulations should explicitly be made subject to section 103(i) of Public Law 103-159 to eliminate any risk of misconstruction of the provision to allow creation in whole or in part of a national firearms registry.

Biden, Obama, Democrat gun-grabbers in the Senate and other advocates of federal power over the individual led by Nanny Bloomberg in New York are determined to strike the Second Amendment and disarm the American people. Nothing short of complete failure of any anti-Second Amendment legislation in Congress should be acceptable to the American people if they wish to retain a modicum of liberty and protect the Bill of Rights.

No notice was provided if the solicitation was subject to sequestration limits, which means this will all come to fruition.
Clearly, this is sand in the face of the American Taxpayer.
In September, 2012, Link Removed 12 McLellan bagpipes at the tune of 27,060. For the same price, they could have bought 27 of the same pipes from Amazon.
There is no logical reason to buy 10 more bagpipes. This is either going to be used for graft, or political payback.
This also raises the question: Who’s funeral are they playing at?

When a NICS call in is done it is for a Handgun, Long gun, Both, or Other. The record is kept as a sort as the bound book and the 4473 both record the NICS number. And a FFL that goes out of business sends the bound books and the 4473s to the BATFE. Denials do not go away after 24 hours, period. They are kept so that BATFE can investigate. The A&D books and 4473 data is in the ATF Firearms Tracing System after a business closure. Anyone with a lick of programming knowledge knows if it is in a computer system, a list can be generated.

Location is Martinsburg, W.Va facility of BATFE.

Colorado, and apparently Texas (next) are being targeted with an attempt to set up a federal authority framework that will enable Secret Service agents (not just those guarding the president), and others of the U.S. Secret Service including uniformed division officers, physical security technicians and specialists, and other ‘special officers’, to arrest and remove an elected sheriff for refusing to enforce the law (or anyone breaking the law).

The bills being introduced defines law as including any rule, regulation, executive order, court order, statute or constitutional provision.

Why are they doing this? Here’s why…
It would establish federal authority police powers in a State, enabling an enforcement arm reporting directly to the president (Secret Service).

It would enable the president / executive branch to theoretically override the actions and preventative measures that are now being taken by many States throughout the country who are trying to preserve 2nd Amendment gun rights and who are prohibiting the enforcement of unconstitutional law passed by Congress or pushed by executive order.

As some of you may know, a growing list of sheriffs (more than 340 so far) across the country have expressed that they will not enforce a Washington mandate that clearly violates the Second Amendment.

Many State laws to preserve gun rights are gaining momentum. States include Montana, Ohio, Kentucky, Idaho, Louisiana, Oklahoma, Texas, Arizona, Michigan, Utah, and New Mexico.

However, in Colorado, Senate Bill SB-13-013 has evidently just passed, and is now ready to be signed by the governor, giving police powers and arrest authority to the federal/executive branch of government (Secret Service) within the State. In Texas a similar bill has just been introduced in the State legislature.

The president and vice-president Biden have been actively pursuing state legislatures and pushing for passage of the bills. Obama is scheduled to visit Colorado in just a few days. “Colorado is a pawn for the Obama-Biden plan,” and then on to the next… at least those that won’t fall into line.

It is a full court press by the federal government to empower themselves even further by inserting themselves as police authority within the state, to eliminate opposition.

Obama's policies attract unforeseen violence
As the Obama administration continues campaigning against violence, new laws are being signed that actually perpetuate crime. To some, all the gun grabbing laws seem like conspiracy, but maybe the Obama administration is really just ignorant of the facts. Obama continues to welcome several gun laws that actually promote violence in the end. As seen in the Sandy Hook shooting, a gun-free zone attracts violence. As seen in Aurora, Colorado, a helpless defenseless crowd is a target. This is why the president and other high ranking officials have armed body guards at their side.


The Colorado bill grants Secret Service power over local sheriffs
The Colorado bill, SB-13-013, has quickly passed, giving Secret Service agents arrest powers by granting them the title of peace officer. This places them on the same level with state law enforcement officials, granting them power over local sheriffs.

As the bill was debated, no one could explain why it was even brought up.

"I was told it was so we can exercise 72-hour mental holds on our own citizens," Sen. Kevin Lundberg said. As the federal government covertly injects its power into new state laws, framework is being set up to begin a purge of Constitution-abiding sheriffs. It seems the federal government is secretly planning to expand its powers unchecked, and rule over the states, bypassing the Tenth Amendment.

As confusion mounts with this sweeping new power grab in Colorado, one can only wonder, "Is my state next?" "What might happen to my local sheriff?" "Is the federal government really this capable?"

Law enforcement officers across the country are fighting back, standing against the Obama administration. The Constitutional Sheriffs and Peace Officers Association is compiling a list of sheriffs, associations, and police chiefs who have vowed to uphold the Second Amendment in the wake of any unconstitutional action by President Obama.

In January, 28 of Utah's 29 sheriffs signed a letter to Obama stating,

"We respect the office of the President of the United States. But make no mistake, as the duly elected sheriffs of our respective counties; we will enforce the rights guaranteed to our citizens by the Constitution. No federal officials will be permitted to descend upon our constituents and take from them what the Bill of Rights - in particular Amendment II - has given them. We, like you, swore a solemn oath to protect and defend the Constitution of the United States, and we are prepared to trade our lives for the preservation of its traditional interpretation."

So is the federal government capable of arresting our local sheriffs?

Yes, with laws like these on the books, they can obviously affect and manipulate the legal system, but as real law is destroyed in America, more free people are going to grow wary and dismiss the law altogether, standing together with fellow sheriffs, oath keepers, and constitutionalists in defense of a free America.

In the end, liberty will prevail, for it has always stood the test of time.

The words are written in crayon, in the haphazard bumpiness of a child's scrawl.
"I am willing to give up some of my constitutional rights in order to be safer or more secure."
They're the words that Florida father Aaron Harvey was stunned to find his fourth-grade son had written, after a lesson in school about the Constitution.

Harvey's son attends Cedar Hills Elementary in Jacksonville, Fla. Back in January, a local attorney came in to teach the students about the Bill of Rights. But after the attorney left, fourth-grade teacher Cheryl Sabb dictated the sentence to part of the class and had them copy it down, he said.
The paper sat unnoticed in Harvey's son's backpack for several months until last week, when his son's mother almost threw it away. The words caught her eye in the trash, and she showed it to Harvey, who said he was at a loss for words. He asked his son, who said Sabb had spoken the sentence out loud and told them to write it down. Harvey said he asked some of his son's classmates and got a similar answer.
"Everybody has their opinions," Harvey told TheBlaze. "I am strongly for proper education, for the freedom of thought so you can form your own opinion and have your own free speech in the future... [but] the education is, 'when was the Constitution drafted, when was it ratified, why did this happen, why did we choose to do this...all these things, why did they particular choose those specific rights to be in our Bill of Rights.'"
Kandra Albury, a spokeswoman for Duvall County Public Schools, which includes Cedar Hills, told TheBlaze she didn't know what prompted Sabb to have students write the sentence.
She said the principal had fielded one parent's concern about the lesson in January, but it wasn't Harvey. She said Thursday the district and principal were "checking into" what had happened.
Harvey, rather than asking the school for answers when he found the paper, wrote his concerns in an email, which was then forwarded to TheBlaze. He said he did it that way because he wasn't sure he would have gotten a straightforward answer if he asked the school directly.
He said he just wants to see a "proper, unbiased education" system and doesn't want any kind of religion or politics brought into the classroom.
"I believe in our Constitution. I am a veteran, I served for six-and-a-half years proudly and I served to protect our rights," he said. "Now whenever I have someone coming in and trying to pollute my child's mind with biased opinions...there's no education in that."
