No waiver absolves the trainers of liability for intentional acts. Insurance doesn't absolve them either. If they're NRA certified I would file a complaint. Request a refund. Call your state AG. These guys are dangerous.

I'm not a lawyer, but I would file a small claims court suit against the company for the medical cost and cost of training. Let a judge settle this. Then file a complaint with the state attorney generals office. Them file a complaint with the BBB.

around on the internet and file a battery complaint then find out who certifies these douchenozzles and file a complaint against their instructor standards. This kind of behavior is unacceptable.
 
I would call them and tell them you want a refund and what the instructor did was un called for and not part of the training. Due to his stupid actions that he thought were funny, you suffered. If they don't refund your money and the money you spent at the doctors, Tell your lawyer will be in touch with them for assalt charges and damages. You will win.
 
I witnessed firsthand one of the 2 so called instructors actually 'threw' a 1.5 lb rubber training knife from about '6 feet' away without any warning whatsoever into a students face! I was that student, and it was my face!


File a police report and ask for him to be prosecuted for assault with a deadly weapon. I know you stated it was a training knife but look at the damage it did...They are not designed to be thrown at people....


I would not speak with them...Let your attorney make contact. He can obtain a list of all the attendees and contact information. (Hell dude you might be able to retire) I'd take the job of cleaning your guns for you after we go to the range or hunting on the range in Africa!!!
I'd then let his insurance company prepaid for the follow up law suite...

This guy never needs to train another person!


Nothing beats god advice from an attorney...We can all speculate remedies for this but, when it comes to following forum advise it can make your case weaker....For your own protection and benefit get the best attorney you can find. Now I'm not a big fan of attorneys but in a case such as this. they are worth their weight in gold....

I finally found and spoke with a decent attorney...He confirmed my suspicions.
There is basically 'not enough money' to be made in this case to merit hiring an attorney because I did not suffer a serious or life threatening injury.
He recommends that I file a small claims court lawsuit.
I will also report this incident to the Texas DPS, The BBB and the AG.

Let me start off by saying you are a way better man than me. I am afraid of what I would have done to be laughed at over his stupidity. 1. If they were going to be throwing rubber knives as a training purpose they should have supplied you with eye protection ( what if this guy had put your eye out). 2. I am sorry these guys had to act in such a unprofessional way, all I can say is WOW!. I hope it works out for you.

Seriously!? WTF??
I ended up with a very large goose egg shaped contusion, 2 inches by 3 inches in diameter, bulging out just above my left eye on my left forehead area and a small cut/scrape below my left eye on my cheek.
When the practice knife struck me, I was immediatly in quite a bit of shock & pain and I quickly responded angrily by shouting at the instructor; "What the fk was that about?! What were you thinking dude!?"
The instructors both laughed (nervously) as if it was supposed to be funny and the lead instructor tried to blow it off as if it was nothing serious to worry about.
But the other students seemed to be in shock & disbelief at this instructors wreckless behaviour as was I.
Even after using an ice pack on the contusion for over 1.5 hours, it was still very large.
I wanted to 'check out' of the class and get a refund, but they refused to refund me my money for the level 2 & 3 classes. I was supposed to finish the level 3 training class the very next day (Tuesday), but I decided to not even attend. Training with 'live rounds' around these clowns did not seem like a very wise idea to me.
Now I'm out the $250.00 with not even the level 2 or 3 certificates to show for all of my time & efforts.
The lead instructor tried to contact me over the phone when I was over an hour late on Tuesday, but I chose not to take nor return his phone call. I'm hoping that maybe I could have some legal options in this case. I did go to a prima care to get checked out by a Doctor and I do have documentation and photos of the injuries.
It still hurts a bit even if I barely touch it or wash my face.

I am not being sarcastic, but I just want to know the difference, and why you did not level the instructor who hit you. I would have gone right after him. Screw the money and lawsuit.

First off, Believe it or not, I'm actually not a very violent person. Sorry if that makes you scratch your head.
Secondly, Heath (The Idiot Instructor) is over 6' 4" tall and weighs in at around 300 lbs. I'm barely 5' 8" tall and I weigh 190 lbs.
3rd, After Heath nervously laughed about it, He actually apologized to me.
4th, I probably wouldn't be able to take the moron to small claims court and win if I turned it into an all out brawl (2 wrongs don't make a right).
5th, Do you and your battle buddy 'rdm6680' both work at DFW Gun Club??

I agree with ncic. and do not mind the guys who always said THERES MORE TO THIS STORY! They do that all the time they are dumb bastarxs who like to cause problems thanks for posting so we know who not to go to for training. I hope your ok. get a lawer and let us know how your doing? the very least we know is they are dingbats Good luck

Jeez, man, like has been said to you before, relax. It was a legit question. So the instructor who violently assaulted you was bigger than you, so you did not fight back. Got it. I guess you are thinking it was children you would have fought at chuck e cheese, making it much more appealing.

When I lived in Texas, people were not so sensitive. But that was almost 10 years ago.

Seriously, I have no idea what drug induced thoughts you are spouting, but it is funny and somewhat sad, to see someone self destruct into the valley of the dolls. There is a program, you know.
 
I was at one time a few years ago a Texas level 3 armed guard and a level 3 instructor. I do not recall any physical training other than side arm/shotgun qualifying at the range.
