While being threatened and "held at gunpoint" is certainly an extremely serious threat to the guy at the register, it was not described as "had a gun to the clerks head." Do you have additional information? Part of my point is, when the bad guys come in with guns and you are still in the holster, you're way, way behind, and intervening at that point may cause the death of the person you intend to save. Did he know the robbers were going to shoot the clerk? No. We know that now, because they didn't shoot the clerk. They just shot the guy who manifested a threat to them.
Exactly! I would think very seriously before pulling a gun against three armed thugs. Odds are against you, even if you get one, two others are shooting at you. Never take it for granted that criminals will automatically run if you pull a gun. Some will shoot. I would have tried to get behind cover and if they started shooting then shoot back. Did the bad guys know the CC guy was there? If not he might have stayed hidden and called police on his cell phone. Then he could have drawn his weapon and watched from behind cover to see what the thugs would do. Unless you are a well-trained super shooter I would not take on three armed thugs. Only in the movies does that work, and remember, they have no real rounds.

I live in Vermont - take a look at Vermont's law below. What is "attempting to commit murder" in (2)? I'd imagine it would describe someone in the process of repeatedly stabbing someone, but perhaps not someone who's "only" pointing a gun at someone, unless he's actively robbing, raping, etc. It would seem there's more to go wrong defending someone not named in (1), so I'd probably only defend family - I'm not overly anxious to go to jail to protect a non-family member.
§ 2305. Justifiable homicide
If a person kills or wounds another under any of the circumstances enumerated below, he or she shall be guiltless:
(1) In the just and necessary defense of his or her own life or the life of his or her husband, wife, parent, child, brother, sister, master, mistress, servant, guardian or ward; or
(2) In the suppression of a person attempting to commit murder, sexual assault, aggravated sexual assault, burglary or robbery, with force or violence; or
(3) In the case of a civil officer; or a military officer or private soldier when lawfully called out to suppress riot or rebellion, or to prevent or suppress invasion, or to assist in serving legal process, in suppressing opposition against him or her in the just and necessary discharge of his or her duty. (Amended 1983, No. 23, § 2.)
