self defense on the road

I agree. Sounds to me like there may be more to this than we know.
I personally have witnessed instances of two drivers exchanging the "You're Number One" salute to each other, and then using their cars to out jockey the other for position on the road, and then one of the drivers finally pulling out a video camera to film the other's actions, after he has enraged the guy. For all we know, the guy filming may have attempted to run the shooter off of the road, and when he pulled up next to him, thought he might try it again, so he took a shot at him. Using a car as a deadly weapon is no different than using a gun as one.
I have also seen where a driver attempted a lane change while not noticing another vehicle in their "blind spot", and unintentionally cut them off. This too will set off some of the idiots on the roads.
And then, there are the ones who are just having a "bad day", and are just looking for someone to take out their aggression on.
Best bet, IMO, slow down, get his license plate number, call 911 and report the incident, and then take an alternate route on a different road to your destination, and get the hell away from the guy. As some of the other posters have said, if you pursue him, then you are now the aggressor.

oh, so now it's OKAY to shoot at people, just because they videotape you committing outrageous acts, eh? If you try that on me, you'd better make very certain that I am dead, because I will devote the rest of my life to finding you, and you won't like it even a little bit.

Dam dude you are one dumb SOB to say something like that on a open forum, now if you should be involved in something, even if you did not start it, a DA may find that post and hang you with it, now I'm sympathetic to what your saying but you just don't do that it will come back and bite you, you may get away with saying **** like that with your buddys around while hanging out at a bar, and even if you truly feel that way you should keep quiet about it

Just this morning I heard a story about a road rage incident in which a driver was video taping a reckless driver on the road and pulled up beside him. The video shows the ********* driver roll his window down to reveal him pointing his pistol at the guy doing the videoing, and fired at him. This happened in my state of KY where we have stand your ground laws. Now normally I would understand 'stand your ground' laws, but am confused as to how this would, or any other self defense law, apply to while driving down the road.

What would ones rights be in this situation???
The guy with the gun couldn't have claimed castle doctrine (stand your ground) because the guy with the camera wasn't trying to get in his car. But if the guy with the gun had misinterpreted intent or mistaken the camera for a weapon as someone else suggested, he still could claim self defense. The guy with the camera could claim stupidity.

This guy was banned a couple months ago.

IMHO there is always a 'choice' to do something. A choice to be aggressive or a choice to remove yourself from the situation if possible. That's the responsibility we CCW folks have to think and consider very carefully. This situation had an avenue of escape that should have been taken and eliminated a very serious personal result.

Your comments are not why (and why) we have many current threads on the attack on Stand Your Ground. What you have just said is that you would not Stand Your Ground and ya know--I agree with you. I understand and support and am aware of SYG. There are, IMO, two options open to you before you get to the point where you actually intend to discharge your firearm or even intend to invoke some kind of SYG. The first is situational awareness (SA)--if you conduct your 24/7 business with an eye toward potential problems and adjust accordingly, you will minimize a "what if". 72 years of never ever ever having a problem makes me believe that I am right in my life decisions when it comes to my actions. That is me and others may have situations that just do not give them that kind of latitude in their daily lives. The second is evade, run, hide, drive away--you name--"get out of Dodge". If it is not imminent, then imminent does not exist; the presumption of imminent danger is the ONLY reason for using a firearm. Presumption of imminent danger, however, leaves open a big door for anyone. SYG, in an aberrant form, seems to have cases where it starts to get difficult to recognize imminent danger anymore. Ambiguous wording of ordinances and inventive attorneys have managed to make some SYG cases, or at least the legal arguments at trial, almost a free ride to killing someone. Hey this is a forum and there are plenty of replies that wholly embrace your ability to SYG regardless of the decisions you could make to avoid a problem--I prefer to avoid them as much as possible.

I just want to make sure I understand... are you referring to say, me making bad decisions like going somewhere I know is dangerous resulting in a self-defense situation where I choose to stand my ground whether I need to or not? Or any situation where I did everything possible to remain safe (situationally aware, not intentionally making a dangerous guy mad, etc) and yet someone attacks me anyway?

I can see your point for the first scenario... though it would likely come in to question whether SYG even applies. For the second.... while I'll avoid killing someone any time I can, retreating presents it's own danger as it doesn't guarantee the BG will stop attacking, and he might be faster! (Highly likely he would be in my case... I'm not exactly quick.)

Give me a break. If you do not understand what I am trying to tell you there is nothing else I can add. Pick at my words as you see fit. Of course there are instances where, through no fault of your own and your lack of ability to run and hide etal, you must either stand and fight or give in to a BG--this is called Presumption of Imminent Danger and it is the cornerstone of most if not all firearm laws. The idea that SYG has been twisted to the point where you can just make the SYG statement (or your defense attorney can make the statement in court) and just do whatever you want to do is ridiculous--some of these latest cases cast serious doubt as to what is imminent defense is and what SYG should really be about. Popcorn in the face in a theater? A bunch of kids in a car with loud music? A drunk outside your house? I truly believe you understand what I am trying to say--may not be perfect but I surely understand it. Don't like me? Don't like what I said? Fine with me. Have a nice day.

Hey, it was an honest question. I was pretty sure I got where you were going-and if I did I agreed, but if I didn't, I wanted to understand why. I like learning about other people's points of view. What's wrong with asking for clarification?
