School Safety Zones in Ohio

I'm getting wrapped up in an argument on another forum about the part of ohio law that says, more or less, if you are dropping little Johnny off at school or picking him up, and you are not breaking any other laws, the prohibition on carrying in a school safety zone does not apply. Have I missed something important? All I did to begin with was quote what USA Carry says about it and now someone claiming to be an Ohio cop is telling me I'm wrong and it's a felony and I'll never be able own a gun, blah, blah, blah. I looked up the actual code, Section 2923.122 , and it appears I, and USA Carry, are correct but I'm no expert at reading legalspeak. Opinions?

(3) This section does not apply to a person who conveys or attempts to convey a handgun into, or possesses a handgun in, a school safety zone if, at the time of that conveyance, attempted conveyance, or possession of the handgun, all of the following apply:

(a) The person does not enter into a school building or onto school premises and is not at a school activity.

(b) The person is carrying a valid license or temporary emergency license to carry a concealed handgun issued to the person under section 2923.125 or 2923.1213 of the Revised Code or a license to carry a concealed handgun that was issued by another state with which the attorney general has entered into a reciprocity agreement under section 109.69 of the Revised Code.

(c) The person is in the school safety zone in accordance with 922.

(d) The person is not knowingly in a place described in division (B)(1) or (B)(3) to (10) of section 2923.126 of the Revised Code.

(4) This section does not apply to a person who conveys or attempts to convey a handgun into, or possesses a handgun in, a school safety zone if at the time of that conveyance, attempted conveyance, or possession of the handgun all of the following apply:

(a) The person is carrying a valid license or temporary emergency license to carry a concealed handgun issued to the person under section 2923.125 or 2923.1213 of the Revised Code or a license to carry a concealed handgun that was issued by another state with which the attorney general has entered into a reciprocity agreement under section 109.69 of the Revised Code.

(b) The person is the driver or passenger in a motor vehicle and is in the school safety zone while immediately in the process of picking up or dropping off a child.

That's why you don't ask LEO about laws. Generally, they don't know the correct answer.

With the exception of Code #s...that is the wording that should be included in the Federal GFSZ statute.
 
If you are still not sure, contact the local sheriff's office, they are usually the be all, end all source for up-to-the minute information.

Hmmm...I definitely would NOT consider any law enforcement agency to be the best source of expert advice on legal technicalities.

Just reading the numerous threads about gun owners being hassled or even arrested while not violating any statute should bear that out.

I would suggest your state's Attorney Generals office for specific rulings.

You are exempt if you have an Ohio concealed handgun license. The license must be from the same state the school zone is in in order to exempt you from the Federal 1000' rule contained in 18 USC 922. The license also exempts you from Ohio law, when in the act of picking up or dropping off a student:

(4) This section does not apply to a person who conveys or attempts to convey a handgun into, or possesses a handgun in, a school safety zone if at the time of that conveyance, attempted conveyance, or possession of the handgun all of the following apply:

(a) The person is carrying a valid license or temporary emergency license to carry a concealed handgun issued to the person under section 2923.125 or 2923.1213 of the Revised Code or a license to carry a concealed handgun that was issued by another state with which the attorney general has entered into a reciprocity agreement under section 109.69 of the Revised Code.

(b) The person is the driver or passenger in a motor vehicle and is in the school safety zone while immediately in the process of picking up or dropping off a child.

(c) The person is not in violation of section 2923.16 of the Revised Code.

Seems pretty clear and plain to me.
