SAN ANTONIO -- A man is dead and another is recovering in the hospital after police say they were shot while trying to steal an SUV from outside a home in an affluent neighborhood.

San Antonio police said the shooter, who was visiting family at a home in the 600 block of Lightstone Drive in Stone Oak, heard the men breaking into his Toyota 4Runner around 1:30 a.m. Tuesday.

The 25-year-old man stepped outside with a gun, confronted the men who were rifling through his vehicle and opened fire, according to a police report.

He later told police that he thought one of the men also had a gun.

Neighbors reported hearing five to eight gunshots, although the number of gunshots was taken out of the police report.

Officers said the shooter is not expected to face any charges since he was protecting his property.

One of the suspects, who was standing by the getaway car, drove off after getting shot but crashed into a parked car about a block away. He then rolled out into the lawn.

A homeowner near the crash said he went outside and tried to get the wounded man's name, but all the man could say was "I feel like I'm dying."

Officers and emergency responders tried to revive the man but could not.

The other man was taken to San Antonio Military Medical Center.

Later Tuesday morning, a neighbor condoned the actions that were taken to stop the suspected thieves.

“I fully agree with it. I spent 30 years in military; I'm familiar with firearms,” said David Oliver. “I think they have a right to intervene.”

Try that crap in South Carolina, particularly at 1AM and you can not only be citizens' arrested but if you decide to run away and avoid the arrest, you can be shot in the back. I can use any means to eliminate the probability of escape, even if the life of the person should be taken. If you do not believe this comment kindly refer to SC Code of Law--Title 17, Chapter 13--Arrest, Process, Searches and Seizures.

You're badly misguided if that is all a human life means to you.

You steal from me, you break into my house, you do anything that endangers my life or that of my family and I have absolutely, totally and completely no respect for you or your life. My only concern should you meet up with me and "my little friends" in my home is the cost to replace a door jam and the carpet you fell on. I will leave the compassion to you FNWylde, if you survive the delay in your actions as you think about the "human life" in front of you and how precious it is.

And you are talking out your ass if you think you know me well enough to suggest that I am liberal.

If some people really had the balls they think they had then something would have already been done about politicians on both sides who claim that they don't want deficits and acknowledge that spending is out of control but then continue this debt ceiling and fiscal cliff theatrics. These 'thieves' are stealing from my, your and our children's futures and for all the pissing and moaning I'm hearing am really puzzled that it hasn't been handled in the same way as the thieves in the article. Or is that different?

It is different one can be justified generally. The other will get the key to your cell thrown away.

Hmmm his first post screamed out in anguish for the violent criminal, his second post was an attempt to deflect attention from his first statement. Let me guess, his third will be to the effect of name calling everyone who doesn't agree with him.
