I guess it's that time of the year for these types of questions. You can! If I sit on the jury I can convict you of aggravated assault too! Ultimately, the circumstances decide if your actions were lawful or not. Please take a look at the threads in the Deadly Force and The Law sub forum. Here is my standard response:

As with all these of "could I shoot someone" discussion threads, the OP is asking the wrong question. You never ask "could I shoot someone"! The question is, "do I have to shoot someone". I highly recommend to either take a legal training class or get some legal reading material about what happens after the fight. Realize that you will get taken into custody and you will go through the legal system. You better immediately spend some money on a lawyer (several thousand Dollars) to protect yourself. You may be spending a night (or more) in jail. You will need to post bond and spend more money on the lawyer if you get charged.

In short, shooting someone is a life changer. It will impact your personal life forever. You may lose a lot of money, your job, friends, family members, your mental health, and possibly your freedom. There is a basic cost/benefit trade off. Are the benefits of shooting someone outweigh these costs. If you defend your own life or the life of a loved one, it obviously is.

So, the real question is, is your life or the life of another person you care about in imminent danger that justifies you using deadly force based on the fact that you may still pay a significant price for your actions? Are there other options that would be more wise, such as calling 911 and driving to the nearest PD?

Lastly, get some training! Let me turn your question around to a different viewpoint. I am driving on the road a little bit aggressively as I am late for work. A signal turns red and you, in front of me, hit the brakes hard. Unbeknownst to me, you looked the entire time in your rearview mirror and perceived me as a road rage threat due to my aggressive driving. Since you hit the brakes hard and I drive aggressively, I sightly hit your car in the rear. The next thing I see is you waving or pointing a gun at me.

What you don't know is that I am trained and know how to draw and shoot from within a vehicle. You will have a few holes in your body within 3 seconds and die on the scene, because you thought it was a good idea to draw your weapon. I was better trained and had the law on my side. You are dead. Play stupid games win stupid prizes.
 
Back in '84, a guy tried to run a friend and me off of the interstate while we were returning to Ft. Knox from Jefferson Barracks, St. Louis, MO. I pointed a loaded HK93-A3 at him. He decided he needed to be some place else and needed to get there going 100mph.

Nobody tries to ram your vehicle or run you off the road unprovoked for a GOOD reason. They especially don't at 2:00am.

  1. We'd be videoing him trying to run us off the road.
  2. If he's videoing me drawing down on him, he's also videoing himself trying to run us off the road.
Of course today, I probably would have LET him force us off the highway, and then lit him up with the H&K.

Yep. My Spidey senses were tingling on the OP right away just like the guy who wanted to "blast" someone rummaging through their vehicle in another thread. You can spot these clones, trolls, and plants a mile away.

I thought the same thing about S&W 29 but now I think he's just a misguided soul wanting to lash out after the November ass kicking. I don't know if he is on here for the politics or the concealed carry aspect. There are over 700 people in my gun club and I've met most of them and have met maybe only 3 or 4 libs and I actually try to help them as much as I can. None of them have much gun training but they are safe at the range and aren't afraid to ask good questions.

Good defensive driving requires both hands on the steering wheel. There is a time to drive and there is a time to draw and shoot. Trying to do both at the same time is something for the movies, where a gun-hating Hollywood actor plays the superhero that kills everyone with single shots and never runs out of ammunition.

How about using your knees to steer the car and dual-wield handguns or pistol-grip shotguns?
 
To the OP:

Situational awareness applies even when driving. The car would've had to be visible in your mirrors and you knew what was going on. Avoidance is the best way to handle these things. As quick as you (try to) draw your gun things elevate very quickly from a jerk on the road being a jerk to you being a jerk and going to jail for it.
And you said "Could I draw?"
My answer is that if you draw it better be justified for you to fire (Danger of imminent severe bodily harm or death that can be stopped by firing until the threat stops).

So sure you could draw, but really? And what kind of question is this for someone who is carrying? If you are carrying you need to know this stuff before you're in a situation that may warrant pulling the gun. Besides, there are wayyy too many variables in a given situation for anyone to answer that question for you. It's your gun, your freedom, your decision. But please don't put a black mark an all carriers by making the wrong decision! There's enough criminals out there without a licensed concealed carrier becoming one by a dumb move and making all of us look "less than" we already do to the anti's.

May ought to consider thinking these things through before posting to the 'net about it because if you think a DA wouldn't dig up posts like this to tell a jury you were looking to shoot someone from your vehicle for pissing you off (true or not, doesn't matter), then you're sadly mistaken.

Please get some legal training.
