Jan 5, 2011: REFERRED TO CODES

Will be voted on in the Committee meaning the next step is the Senate Floor.
Is it requiring licensing of long guns in NY City Only or the whole State
If it is just NY City then we (upstate's) must look at it as a precursor of things to come.
I mean WTF does this really say ANYWHERE IN NEW YORK STATE WHERE A LICENSE IS REQUIRED TO CARRY OR POSSESS A PISTOL, REVOLVER, RIFLE OR
SHOTGUN, COMPLETION OF A THREE HOUR WEAPONS SAFETY TRAINING COURSE

And then there is this
OUTSIDE THE CITY OF NEW YORK, NO DEALER IN FIREARMS SHALL SELL A RIFLE OR SHOTGUN, WITHOUT RETAINING FOR THE RECORDS OF SUCH ESTABLISHMENT

So now dealers have to have your Certification on file?

Lawyer speak to give the impression of a flowery peace loving pro 2a bill when infact this just adds more bullSchidt on top of bad guns laws in NY.
ANYWHERE IN NEW YORK STATE WHERE A LICENSE IS REQUIRED TO CARRY OR POSSESS A PISTOL, REVOLVER, RIFLE OR SHOTGUN, COMPLETION OF A THREE HOUR WEAPONS SAFETY TRAINING COURSE, CERTIFIED BY THE DEPARTMENT OF ENVIRONMENTAL CONSERVATION AND ADMINISTERED BY THE LOCAL LICENSING OFFICER, SHALL BE A PREREQUISITE TO THE ISSUANCE OF SUCH LICENSE.
OUTSIDE THE CITY OF NEW YORK, NO DEALER IN FIREARMS SHALL SELL A RIFLE OR SHOTGUN, WITHOUT RETAINING FOR THE RECORDS OF SUCH ESTABLISHMENT, A COPY OF THE CERTIFICATE OF PARTICIPATION IN A CERTIFIED WEAPONS SAFETY TRAINING COURSE OR A COPY OF A NEW YORK RESIDENT HUNTING LICENSE ISSUED BY THE DEPARTMENT OF ENVIRONMENTAL CONSERVATION AND CURRENTLY VALID FOR HUNTING WITH A RIFLE OR SHOTGUN, OF ANY INDIVIDUAL PURCHASING SUCH A WEAPON. FAILURE OF A DEALER IN FIREARMS
TO RETAIN A COPY OF A CERTIFICATE OF PARTICIPATION OR HUNTING LICENSE
REQUIRED TO BE RETAINED PURSUANT TO THIS SUBDIVISION, SHALL CONSTITUTE A
VIOLATION, PUNISHABLE BY A CIVIL FINE OF TWO HUNDRED DOLLARS.
(B) INSTRUCTORS FOR THE COURSE SHALL HAVE COMPLETED THE MUNICIPAL
POLICE TRAINING COUNCIL'S FIREARM INSTRUCTOR TRAINING COURSE AND BE
CERTIFIED AS QUALIFIED INSTRUCTORS OF SUCH PROGRAMS.
(C) THE AMOUNT OF THE FEE FOR TAKING SUCH A COURSE SHALL BE ESTAB
LISHED BY THE MUNICIPALITY ADMINISTERING THE COURSE WHICH SHALL DEPOSIT
EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

Don't sweat these proposed laws. historically, there have been many tries at this. They really never get much past codes. Even the Dem assembly rejects them. The GOP controlled Senate kills them on arrival.

Take microstamping for example. Certain Dems are pushing for this bill. Meanwhile anti-gun governor Cuomo is scrapping the COBUS ballistic fingerprinting program as it's too costly and hasn't solved any crimes. He's not going to endorse another hair-brained, costly scheme to try catching criminals by tracking legal guns. Just imagine a perp throwing a handful of empty shells at a crime scene just to tie up LE with tracing down all the innocent people who's shells apear at the scene.

In order to enact such statutes, NYC must codify them into state penal law. They will find a receptive audience when the change applies only to the city as that's what the people of NYC actually want but they are not successful when trying to impose their will statewide. For example, your pistol permit is no good in NYC because they have codified that provision into NYS penal law. Yet that permit is good everywhere else in the state.

I hope it will die with the slim majority in the Senate but that could all change one day.
NY City already has licensing of long guns don't they. Tell this beeeaaccchh to leave us in upstate alone.

This is more Bloomberg influenced BS. Same with Brooklyn Senator Adams I think is his name. Do you know that the state assembly voted the Microstamping bill to something like 18-7 (can't remember now; maybe even 24-7?). Everybody in the state voted party line. I know because I called everyone of them in their Albany offices, and then called their local district offices. I was really in shock hoping and thinking there would be some common sense here. I explained over and over on each call how this would not be effective. I can't believe COBIS is going away. It's simply a miracle.
