Received personal letter from Judge today requesting all police reports

I'm in the process of getting my CCW (Upstate NY) and yesterday I received a personal letter from the judge stating that he wants to see all police reports generated in connection with the charge and arrest for criminal possession of controlled substance in the 5th (misdemeanor - performance enhancing meds). I had this charge 10 years ago and YES I listed it on the app with all specs related. This was my only run in with the law. Went to the records dept today and they will have my records for me in the next 3-5 days, then I will give them to the judge. Is this normal? Thanks all
 
Would you tell us which county in New York?

Some are awful and some understand that the Constitution has a Second Amendment.

A friend of mine got his when the judge or sheriff, I forget which, discovered that he and my friend went to the same college.

I have my permit in Saratoga County. My buddy who also has his permit had a DWI in the passed. The judge sent him a letter asking him to explain the circumstances and why he feels he deserves to have a permit. He wrote a letter of explanation and ended up receiving his. So you should be fine.

I did write a letter (2 pages to the judge, which I imagine he has read). I handed my application (letter also) in 5 weeks ago. I received the letter yesterday from the judge. I was told 1 week ago that everything is done and all set, just have to wait for the judge to decide Y or N. They make this so damn hard, but for good reason. I bet many others just quit because off all the trouble it is to get a CCW, esp in NY

Yes many quit because of all the trouble it is to get. I will not argue the pros or cons of should you be required to have one as that is not the question here. At this point the judge may be just wanting to see how badly you want it and what are you willing to do, sort of a test to see what kind of a person you really are and if you follow through then you pass.

Years ago I gave up on getting my Professional Engineer certification due to the difficulty of the application rather than the actual test. Also I had just changed jobs where I no longer needed it so I just quit on it. I have regretted that many times since and wish that I had gone on with that last step. The test wasn't the problem, just all the documentation and references. So the judge is probably looking at you the same way. Are you willing to go all the way. I know you should not have to play that game but it is the law so hang in there.

Yeah i went to start the process of getting my permit when i was 22 but just heard so many discouraging stories that i put it off until i was 26-27. Me and my buddy i mentioned decided to go through and do it together so we would just keep each other motivated to follow through. We got put on the bump up list for the safety class and both had our permits after about 3-4 of starting the process. And my county from what i understand is one of the worst in NY to deal with for the process. It takes anywhere from a week to 2 weeks just for an amendment approval.

Just called the County Court to ask where I can drop off my required documents that the Judge requested, and believe or not, I get to meet with the Judge personally in 10 days. This is perfect, as I always wanted to be able to speak personally with him. This is my final and only chance for that matter in getting my CCW (meeting the Judge I believe is the last process and hope for some), hopefully as goes well.

If you want a pistol licence, you can be a non-resident with a business in NYS. But you still have to go through the same application procedure.

Residence? I think it depends on the county. You can go to the web pages of the counties you want and check there. I was looking a couple of years ago, and as I recall, some want two years.

You would have to show a NYS Dr. Lic. probably proof of residence and some counties want three references from residents of the county.

I'm sure you already have a handle on what you need to do to get over this last hurdle, but just in case you don't, try some of these things:

1. Tell the judge you don't understand his concern about your past interaction with law enforcement. Ask him "WTF, what part of "shall not be infringed" don't you understand?"

2, Tell the judge you need a firearm to protect yourself and your family from "ObamaCare."

3. Tell the judge you plan on practicing a lot with your new firearm so that you'll be very proficient with it when the communist socialist nazi people running the government come to take it away.

It is a term of art, not science.

Some of the major factors considered, but not exclusive or controlling, are:

1. Where does your driver's license claim you live?

2. where does your federal tax return claim you live?

3. Where does your NYS resident tax return claim you live? (If you didn't file a resident NYS return because you claim you are not a resident of NYS you can forget about getting a resident pistol permit.)

4. where are you registered to vote?

5. do you have a place to live in NYS?

6. where do you work?

7. If you attend a church or similar institution, where is it located?

Given that info, and given the level of NYS taxes, the NY permit must be the most expensive in the country. :biggrin:

I guess I could but don't think I would give up stating my current residency for NY though I would like to have a NY carry permit since I live on the border. Oh well maybe things will change with a new administration both in NY and Federal...won't hold my breath!

NYS law does not prohibit issuance of pistol permits to non-residents. But there are two problems. First, the law requires that one apply in the county of their residence (but a non-resident can get around that limitation by applying directly to the appropriate state agency.) Second, the state as a matter of policy does not issue pistol permits to non-residents (although there are some instances in which non-residents employed in NYS can get a pistol permit.)

Several years ago a non-resident took the state to court to try to force it to issue a pistol permit to him. Bach v. Pataki, 408 F.3d 75 .

He lost the case, but one of the grounds he asserted was dismissed by the court because at that time the controlling cases had held that the 2nd amendment did not apply individual ownership of a firearm. Now that Heller has resolved that issue, the case might be decided differently and a court might force the state to issue a pistol permit to a non-resident who otherwise qualifies.

I think ach is going to refile. He probably has more resources then I do.
I used to live in NYS And work there. I don't any longer but do own a house there now. I don't have a reason other thern I consider it my responsibility to be able to defend myself, my wife and family. If there was a chance I would apply in the county where the house is. I don't know how States can still totally den my right given Heller and also McDonald!
 
Judge's Request

All judges in New York State want to be a part of your past & future. This will be another form of challenge they wish to use as a deterent(In their minds) to either slow down or halt the process while people are being assaulted throughout this Liberal mess we call a state. I would have left this state 2 years ago but the wife would get 1/2 of everything I've earned over my lifetime. I'm Stuck on Stupid! Good luck with your goal!
