According to The (Riverside, Calif.) Press-Enterprise, a 72-year-old Lakeland Village, Calif., man shot and killed an intruder, 51-year-old William Ragsdell, climbing through a window into his residence on October 5.

The homeowner, identified as Jerry Duncan, told a reporter during a phone interview, “He had a flashlight and I told him to get out.” When Ragsdell didn’t leave, Duncan fired his pistol once.

“I tried to scare him more than shoot him,” said Duncan. “He hollered. I thought he ran off. He was just gone out of the window. He made it about 15 feet. The police found him.”

In Kalifornia? They didn't hang the homeowner from the nearest tree?

Surprisingly, Kalifornia has case law that supports shooting anyone who breaks into your house with the home owner being able to assume the twit breaking in means to do physical harm to the occupants.

Good riddance to the perp. If he cut power lines, he was in it for mayhem at the very least. Agree with author of article, no warning shots. Anytime things get to the point where you feel you need to press a trigger, make it count. Stop the threat.

Castle Doctrine is a simple and understandable legal basis for a good shoot in many, if not most, states in the US. You force entry into someone's home, it can easily be presumed by a reasonable person that imminent danger to the occupant(s) is evident. The other thing that struck me by this story is the undeniable advantage of owning a firearm--disparity between the BG and the victim, whether it is size or age or just the plain ability to defend one's self (ie disabled).
