When Mitchell Crooks checked out of the county jail last month and checked into a Las Vegas hospital, the 36-year-old videographer knew he had a fight on his hands.
His face was bloodied and bruised. His $3,500 camera had been impounded by police, and he faced criminal charges for battery on a police officer.
One month later, things have changed for Crooks.

"This whole incident is questionable. The second thing out of the LEO's mouth is "do you live here" to which the victim answers "Nope"!!! When you lie to a LEO and do not follow their instructions, you are asking for trouble!! Not justifying the LEO's actions, but I think when you consider that probably a very large percentage of the people they come into contact with are sleeze bags, and when you do not respond to their commands they are going to be very aggressive in how they deal with you. If you are looking to make an example of a LEO's actions towards you, being non-compliant which them during a confrontation is not the smart thing to do. Do what they say and then when it's is over, call your lawyer. Read in another forum that this victim has has other run-in's trying to be antagonistic with LEO's and filming the contact.

The proper LEO response should be to completely ignore his lawful activity.

In the OVERWHELMING majority of cases where an LEO unlawfully attempts to stop himself from being recorded, it's because he's doing something he knows he shouldn't be doing. This is true across the board, from the videos of various unlawful assaults by LEOs to the armed robbery gang operating inside of the Philadelphia PD.

I recently got my first smartphone and the FIRST app I downloaded was "Cop Recorder 2".

And there is a difference between "compliance" and "consent".

If you are unlawfully forced by an LEO to do something, comply if you need to in order to avoid his unlawfully harming you. Don't ever CONSENT to ANYTHING. Consenting to an unlawful search turns it into a LAWFUL search, for which you have neither basis for complaint, nor cause of action in civil court.

When detained by police (unless armed in a state requiring notification), the FIRST words out of you mouth should be "Officer, am I free to leave?" If the answer is "yes", do so. If the answer is "no", your next and LAST words should be "Officer, I have nothing further to say without benefit of counsel." Then SHUT UP until your lawyer is present.
