Police arrest mom after she requests to see a warrant (which they did not have).

Slaton police came to a woman's house, who wishes to remain anonymous, to arrest her 11 year old son. But by asking one simple question, she found herself behind bars instead.
"I told him, 'I will release my son to you upon viewing those orders.' Those were exactly my words," The complainant said. "He said, 'This is how you want to play?' He took two steps back, turned around to the officer and said, 'Take her.' They turned me around, handcuffed me, and took me in."
The complainant said she was aware police would be coming to try to apprehend her 11-year-old son based on a bogus criminal complaint, and that she just wanted to see the warrant first. As it turns out, that warrant didn't even exist.

I would have agreed with you at one time. Now, I really have doubts. It seems like all the people in positions of power can do almost anything they want to and then say they are sorry or whatever and that is the end of it. I am losing faith very fast that this country will ever get back to the founding principles. It hurts me to no end to even think this let alone say it.
 
Seems like the small town cop syndrome. His mouth has overloaded his but. With proper representation she should do well.
 
I would appear that the police acted in a unprofessional manner in this situation if what this lady claims is the whole truthful story. However, there are two sides
to every story.
It is a fact that police in general have become more bold and with less accountability, who is the blame ? I say the citizens are, if we continue to allow this sort of
behavior to continue unchecked, we have only ourselves to blame.

We have given the police the power they have today because we are tired of all the crime, and they took it and are running wild, why ? because we allow them to,
it is time for every good citizen to write their elected officials and demand accountability, if not than stop complaining.
 
I agree she did the right thing and was fully within her rights. If you read the comments on the article though, her 11 year old son was accused of raping a 5 year old girl. Not that that changes her rights at all, but it does make me lack sympathy for her plight.

First and foremost. These are two separate things. Two wrongs do not make a right. Period.

I hope if he's guilty of doing what he's accused of, that he gets the full punishment he deserves. But, do you know for sure that he is in fact guilty? No you don't, and neither do I. To arrest her, they had to falsely accuse her of something, so what's to say he's not falsely accused? Since when is an accusation, a guilty verdict? What happened to a trial first?

Oh... so they're only sorry, if she doesn't sue them? But if she sues them, they're not sorry they did it? She better sue, because obviously they haven't learned anything from this. And they're not actually sorry.
 
File a lawsuit lady. Those black booted thugs have to learn, not the to infringe on peoples rights!

If the kid is guilty or not, there is no reason to violate her constitutional rights! Some small town cops think they can get away with whatever they think is right. Slaton PD NEEDS to learn they must obey the laws just like us lowly subj...uh..citizens!
 
But.. it just cannot be true.. The Cops would NEVER do anything wrong.... where are all the badgefluffers? Maybe even they know that the cops screwed the pooch on this one?

Police dont need a search warrent to pick someone up for questioning. What they need is probable cause, which is defined as the mere facts and circumstances that would lead a man of prudence and caution to believe that a crime has been or is being committed.

If she would not allow this to happen she can be guilty of: impeding a lawful investigation, harboring a fugitive, or just plain old disorderly conduct. Which of these would obviously depend on the circumstances. And being that I was not there I dont know which one would apply.

Being that she knew the cops were on their way, this wasn't some cops being the gestapo.

There you have it, someone to play devils advocate for you.
 
If the department issued a formal apology it could hurt them in court as it could be sign of admitting wrongdoing. So why would they risk losing a lawsuit?

Yet again, I am playing devils advocate to make axe45 happy.

Im starting to think that axe45 and gecko45 are related....

Nope, but it would probably get him placed under investigative detention if you filled out a police report stating that you saw it happen or were the girls guardian.

About the same as taking a womans side against the police after hearing only her side, isnt it??
