Oregon CHL Question (re: moving)

Mr. Idaho

New member
Greetings,

In January of this year I was issued a CHL out of Malheur County because I lived in Idaho. The license is valid through January 2016.

I have since moved to Washington state. Malheur County will only issue out-of-state licensed to Idaho residents (because they border one another). When I called to ask about updating my CHL information, the rep (Kim) seemed to be under the impression that I need to get a new permit from a Sheriff who issues to Washington state residents. While that may be true at renewal time, that shouldn't effect the validity of my current CHL, right? She confirmed that my current permit is still good, but seemed to seem uneasy about it all. I want to make sure I do whatever is necessary to maintain a valid permit, so I'm looking for some feedback.

I plan to call a county that issues to WA residents and get their opinion as well... but wondered what the thoughts might be in this neck of the woods. Ideas anyone?

Thanks,

Mr. Idaho
(well, not really)

Just a quick update... I spoke with the Multnomah County Sheriff's office, who had a little more insight on the matter. For all intents and purposes, the previously issued license is valid until its expiration. At renewal time, I would be required to have one issued from a county that will issue to Washington residents. Since Malheur County will not, I'd be done with them at that point.

However, she suggested for the sake of simplicity and so there are no lingering questions, that I can "transfer" to her office for a $15 fee to cover new fingerprints and background check. They'll let me keep the Malheur permit until I get it from their side, then I'm in where I need to be, with no further question. This is a matter of convenience, however, and is not required to be legal.

You must update your CHL if you move. From my reading, you have a valid CHL, and you are not moving to another Oregon County (therefore jurisdiction for the license hasn't changed,) so they should just update the address for you. But if your issuing county is refusing to do so, you can either try to fight it in court (my reading of the law says that they can't just revoke it because you moved to a different - but still qualifying by Oregon law - state,) or just transfer to another county that WILL allow you to have it and not deal with the fight.

Multnomah County has no problem issuing to Washington residents, by the way.

You must update your CHL if you change addresses. It becomes invalid if you don't.

This is covered in ORS 166.295 2:

"(2) If a licensee changes residence, the licensee shall report the change of address and the sheriff shall issue a new license as a duplication for a change of address. The license shall expire upon the same date as would the original."

In Washington COUNTY (Oregon) they want you to update DMV before updating your CHK.
