I just got stopped for open carry. And every thing went fine untill the end. The cops told me that they are going to pull my state permit for cc. I live in LA. Any one else have a similar experience ?

I wouldn't worry about it, they were blowing smoke. Besides...if they pull your state permit to conceal carry, then open carry is all you have left! Your concealed carry permit has nothing to do with it. Louisiana is a shall issue state - they cannot deny you a permit unless you have been convicted of something disqualifying. Just more cops abusing their authority trying to act like big shots.

I had a cop tell me exactly the same thing in Oak Harbor, Washington. I told him to try it.

It would be interesting to hear the details of your story.
 
This is the New Orleans Code:

Sec. 54-341. - Illegal carrying of weapons.Link Removed

(a)
It shall be unlawful for any person to commit the crime of illegal carrying of weapons. Illegal carrying of weapons is the intentional concealment or attempted intentional concealment on one's person of any firearm or other instrumentality customarily used or intended for probable use as a dangerous weapon.
(b)
The provisions of this section shall not apply to duly appointed law enforcement officers or any other person duly authorized to carry concealed weapons.
(c)
Whoever commits the crime of illegal carrying of a weapon shall be subject to a mandatory sentence of not less than three nor more than six months in jail and, at the discretion of the court, a fine of $500.00. The mandatory jail term shall not be suspended. The clerk of the municipal court shall keep a separate log or registry of the disposition and explanations for disposition of all prosecutions for violation of this section and shall report thereon to the city council and the superintendent of police on a quarterly basis.

Nothing about open carry.
 
To LOCAL -Since your organization is located in the state of LA I will tell you exactly ware it happen at. the department that stopped me was East Jefferson Levee District out at bonnabel boat launch in Metairie. A Sgt stopped me at first then he called his Lt out there and the Lt told me........
1. no one can carry a concealed handgun or open carry unless you are engaging in a high risk job... like transporting money.
2. He asked me how i even got a CHP he told me that the state only gives them out to people who engage in activities that are dangerous by nature.
3. Then he tells me that he can take me in for causing alarm to others.

and many other things.

The way I look at it, everyone risks their lives by going out in public these days. The police should be glad to have legal, responsible, carrying civilians there to back them up against the "bad guys."

At that point you tell the officer "I have nothing further to say with out speaking to a lawyer" or you tell them to arrest you then and there and start planning your retirement on the proceeds of the law suit

But you have to remember police have no obligation to tell you the truth. They can lie all they want to get something on you, while we civilians have to tell the truth.

Sorry to hear this happen NOLA, don't let them get away with this.
 
Actually, if a cop tells me he's going to take my permit, I'd just say, "Go ahead, my lawyer needs the money." And then I'd shut up after that. Save all your comments for your lawyer. Antagonizing cops can be dangerous. So I would advise caution with any verbal retorts.

Just my opinion.
 
Whare I messed up is that day I did not have my recorder on me so I did not get the encounter on tape I wish I had.

I get that same feeling on days my phone dies prematurely...hoping that that day is not the day I need it...I've lucked out so far..but I really need an extra battery for my phone asap. Beware though, if you record it, you run a good chance of being labeled confrontational and/or an escalator.

You'll get that label for not consenting to warrantless searches or refusing to speak without legal representation.

I need my rights protected.

I DON'T need to be liked by cops or their groupies.
 
East Jefferson Levee District ? I don't think i would worry about him. Sounds like a rent-a-cop job.He can't take your license since LA is an open carry state. I open carry occasionally and never had a problem.
