NYS Police Departments Revoking Pistol Permits because of Anti-Anxiety Medication Use

This appears to be quite serious and Max Tresmond has given permission to spread the word around on it. There is an individual who has retained the Tresmond Law Firm for legal representation in the matter of having his NYS pistol permit revoked and his guns confiscated (by the NYS Police).

Max Tresmond reports the following :

NOTE : Tresmond Law's client was willing to release the information regarding his case on a redacted basis. The facts are as follows :

John Doe, an upstanding professional with no outstanding criminal convictions and no history of violent action received a letter from the Pistol Permit Department informing him that his license was immediately revoked upon information that he was seeing a therapist for anxiety and had been prescribed an anxiety drug. He was never suicidal, never violent, and has no criminal history. The New York State Department of Health is apparently conducting a search of medical records to determine who is being treated for anxiety drugs and using this as a basis for handgun license revocation.

I would like to add that the police departments are demanding that whomever turns in a pistol also turn in accessories for that pistol such as magazines, despite the fact that these magazines are not firearms themselves and anyone can purpose a magazine without a pistol license. Even more troubling was the fact that the police officer taking custody of the pistols cheerily informed the client that "the department" would be destroying his pistols if they were not retrieved within one year. When she was questioned as to what he should do should he choose to sell the pistols out of state, given that he has a property right to the monetary value of the gun, she became confused, her expressions changed to perplexed, and she made a referral to another officer.

I thought it was illegal for anyone to divulge health information, unless stated by the patient. So much for privacy rights.

It appears that the NYS Police Dept. is initiating this by accessing medical records. Since April 19, 2006, Public Health Law requires that all prescriptions written in New York State be issued on an official New York State prescription form. These are NYS supplied (bar-coded) prescription blanks. There are no longer any different blanks for different classes of drugs. Information from these blanks is transmitted to the State for all control drugs (not just narcotics). This includes hundreds of non-narcotic drugs commonly used for hundreds of different conditions.

BTW, Max Tresmond has indicated that there are now two cases of this that have come in to their law firm and he said if anyone has an urgent problem, please email : [email protected]

According to the initial investigation by the Tresmonds, the NYS Police are now going through people's medical records and upon finding drug prescriptions, they are then having the county revoke pistol permits.

Rediculous. If this continues don't even think about asking your doctor for a one fill script of Xanax if you're a nervous flyer going on vacation, your permit might get pulled!
 
My wife has had disk problems for many years. She had nerve pain due to compression of the vertebrae on the nerves running to her leg, but her condition is not severe enough to warrant surgery. Her neurologist prescribed an anti-depressant because one of the side effects is that it relieves nerve pain.

I'm sure they're not doing any follow up to determine WHY certain meds are prescribed, just that they ARE.
It's scary to think that we would have to surrender any of our weapons because of a back injury!

You folks need to move out en masse. That will be the only way you can get them to cry uncle...otherwise enjoy the detention camps.

I strongly agree. Mistake made...... we got the wrong person ??? Holy crap, that is pretty damn lame coming from an organization with the responsibilities and resources of the NYS Police. What was the nature of the mistake ? The last name was spelled the same as someone else ? His home address was similar ? What was the offense of the "so called" correct man ? The same thing ? Some totally unqualified (medically speaking) cop rooting through personal medical records and just happened to make a mistake with the guy's name, address, meds, what ?

What in the name of God's good green earth are the chances of "accidentally" finding a pistol permit holder who was prescribed a med who also had a similar name, address, whatever ? If this was a mission of "flying a kite", these guys really aren't too bright but I can't believe that Coumo would risk the inevitable SHTF scenario that would follow. If this was to "fly a kite", surely in a state with well over a million pistol permits out there, they could have picked a much better target.

This whole incident is akin to dumping 5 gallons of gasoline on a bonfire already beginning to roast the pages of the SAFE Act (thanks to the good folks at Tresmond Law, et al.) Plus, if this was truly a mistake, why did it take 4+ days for these guys to say Oooops. You don't need 4+ days to realize that a screw up was let out of the cage. More like that time period to feel the national heat and make up a story to CYA.

Also, I'm curious about the other incident that the Tresmond's reported (they said there were 2 cases). Was it an identical case ? Is it also a mistake ?

One statement (made by Max Tresmond) said it was a NYS Police sergeant rooting around. I'd almost buy that one, maybe some cop bucking for a promotion ? For obvious reasons, I imagine they would circle the wagons pretty damn quick.

Privacy rights are only for the liberals and those who agree with Emperor Cuomo.....Where is the ACLU and all the liberal privacy advocates on this one?????
 
NY State Police Gun Squad is up and running. Some will be normal some will be Under Cover. Just sayin.
The UC ones scare me because first they join a club or show up at a range. Engage you in conversation bitching about the SAFE Act. You show them your legally owned pre-ban 30 rounders. Quietly they bust you. Now they offer you a deal.
Turn in some others with 20 and 30 round mags and we will drop the charge. Then they sit back and let you and others like you (CI's in their world) do their dirty work.
They need arrests to show results before this crap is overturned.
 
'IF' I had now illegal magazines, the last place I would show up to shoot them would be where others I don't know would congregate....
Whether or not someone from the UC State Police Gestapo is there or not....loose lips sink ships.... Somebody will innocently open their mouth in the wrong place and the NY Gun Squad will ultimately track you down and make a highly publicized SAFE ACT arrest.
The only time I would pull out an "illegal" gun, mag or accessory at a club facility is when I'm there either alone or with only people I know and trust...who happen to have similar items...so they have skin in the game. If ANYBODY shows up that we don't know...the 'illegals' are quickly packed up and casually taken to a locked trunk.
The better option (not so easy) would be to find a trusted friend with land where you can share a nice day outdoors enjoying your hobby.

For those in other parts of the country, it's interesting that NY has just been caught in violations of OUR civil and constitutional rights. They have created a secret, clandestine task force to scour medical records in violation of HIPPA and the 4th Amendment...WITHOUT WARRANTS.... all with the express purpose of taking ALL guns from the citizenry of NY and will be used as a model for the rest of the country. This is the BETA TEST of the Obama gun confiscation plan.

A Federal suit is being prepared by the Tresmond law offices which will fight for our rights.
It has also been reported that as the NY State Police are part of the Executive branch of NY State's government, so it may be proven that the Emperor...Gov Cuomo... may have given the directive to the State Police to form this task force, and if so has personally directed and 'ordered' them to violate our Constitutional Rights. If so, this could hopefully lead to his removal from office and to put a stop to his political aspirations.

Anybody but me see a problem with this as part of Obamacare as well? Remember...Obamacare requires that ALL MEDICAL RECORDS BE CONVERTED TO DIGITAL RECORDS......because it's REALLY HARD to search those pesky paper medical records WITHOUT A WARRANT!!!

Both the NY SAFE ACT and OBAMACARE must be repealed!!!
 
My doctor is a huge gun guy, and he and I agree since guns have noting to do with my health, we only talk about health in his office and shooting when we are on the range.
 
Even if my doctors ask if I have guns...it's none of their business!! Until I hurt myself, or they need to treat me for something HEALTH RELATED, they don't need to know. Last I knew, their degrees were in Medicine...not Criminal Justice!
