Thank you so much for this bit of information. I moved up here to NC from FL in May of last year and have had some questions about the OC & CC "rules & regulations". This helps clear some of them up. :biggrin:

So long as it is in a holster and in plain view, you should be OK. Be prepared for the few thousand "is that a real gun?" and "Is that loaded?" questions that you will get. N. Carolinians still aren't on the open carry bandwagon yet, but it is not illegal.

Just remember, just because you are openly carrying a handgun is not reasonable suspicion for a cop to detain you and interogate you. "Going armed to the terror of the people" (GATTOTP) is an offense only if you are pointing, waving, or doing something with your gun that would make a normal, reasonable person fearful. State V. Huntley is a good piece of paper to have in your wallet. This case clearly defined that simply wearing a gun on your hip does not constitute GATTOTP; that any person (who is not a felon, etc.) has a right to open carry a weapon for any lawful purpose, including amusement or pleasure. Note the exception in Cary and Durham.

I'll have to look that case up.

If it's on my hip, the shirt stays tucked in. Once I get my CCW then I have a few options. Also one thing in my "favor" I'm a state licensed security officer so the "non-felon" thing is a must. I'm just waiting to be qualified to work armed which means I'll be OC more often. What I find sort of amusing is that in NC security guards have to qualify an additional 10% then LEO, and to company I work for it's 25% higher to get on their tac team.

I too used to work as an Armed Security Officer for a well known Contract Private Security Company both in NC and Va. It was thing of concern to me also that I was required to qualify at a minimum of 80% and an LEO only had to shoot 70%. I was rather proud of the fact that as a "Rent-a-Cop" I was better prepared than some Certified Sworn LEO's. :yu:
 
thanks for the info...im in afghanistan and plan to purchase a new rifle when i get back home to catawba county and was wondering about the OC laws ..oh and stop in around hickory area if people think carolinians aint on the bandwagon lol
